Another 5-4 SCOTUS Win

| April 26, 2020

Supreme Court of the United States

It’s just a matter of time until RBG retires. If the Kavanaugh hearings were any indication, whoever Trump nominates as her replacement will go through the Dem grinder, too. I well remember when he had put up with enough, and came out swinging at the Dem Senators. The press went insane, calling him “unhinged” and his comments “deeply political.” But I digress. Trump can rack up another SCOTUS win.

WINNING: Supreme Court Sides With Trump Admin, Rules Criminal Immigrant Can Be Deported

Posted by: Jason Hopkins

The Supreme Court sided with the Trump administration on Thursday, finding that the government can deport criminal immigrants from the U.S. even if they have been living legally in the country for a long time.

In a split split 5-4 decision, the court’s conservative bloc agreed with the administration that Andre Martello Baron, a non-citizen from Jamaica, is eligible for deportation after being charged with drug and firearm offenses, despite him living in the U.S. since the 1980s. The decision makes it more difficult for green card holders with criminal offenses in the U.S. to fight deportation orders.

Barton’s crimes made him eligible for removal, but he argued that he was not, citing a 1996 decision that allows some long-term legal residents to avoid deportation. Under the law touted by Barton’s legal team, green card holders can request to have their deportation orders repealed if they’ve been living in the U.S. continuously for at least seven years.

The Supreme Court’s majority, however, ruled that legal residents who have committed certain crimes before reaching this “inadmissible” period can be deported.

Justice Brett Kavanaugh, writing for the court’s majority opinion, wrote that “when a lawful permanent resident has amassed a criminal record of this kind,” the country’s immigration laws deem them ineligible to request to remain in the U.S.

Hasta la vista, Andre. The rest of the article may be found here: CDN

Another WIN, fuck the left!!!

Should have been unanimous. How those four buffoons can think that a non-citizen has a right to stay here after committing multiple felonies shows how politicized they make the court.

I really hope the Republicans have learned from the lesson from the Kavanaugh hearing that they didn’t learn after Thomas. They always let Democrat presidents appoint far left judges, with large margins of bi-partisan support. They don’t get the same courtesy from Democrats when it’s time for a Republican appointee. They play a nasty, mean, dirty game to push their agenda at the courts. An agenda they can’t win at the ballot box or Congress.

Trump at least understands the rules of the game. One of the reasons they’re so pissed off. He isn’t a limp dick shill for the Democrats like “Maverick” McCain or Romney.

The Other Whitey

Good.

Whatever fell sorcery they’re using to keep Ginsberg legally alive can’t last forever.

Commissar

Her strong sense of duty to her country keeps her alive.

Hondo

“Sense of duty to her country”? First time I’ve ever heard that phrase used as a euphemism for “desire to promote a Socialist agenda”.

SFC D

You said that without throwing up in your mouth just a little?

More like lots of prescribed methamphetamine…

marinedad61

Commissar,
Ha!
Had she retired in, say, 2014, like a normal 80-year-old,
instead of assuming Hillary had it wrapped up in 2016,
Ginsburg wouldn’t be in her frail bind today,
either staying alive until 2025 (at the least),
OR….
Going down in history, due to her arrogance,
for handing over a Supreme Court seat to her own enemy.

OldManchu

Excellent point on the arrogance!

Mason

She’s the type that will cling to life by her bony, wretched claws until she can turn the seat over to a Democrat. There are not a whole lot of Democrats who retire with dignity. Once they’re entrenched they have to die to get them leave office. A lot like a tick, another blood sucking parasite.

Slow Joe

Commissar, remember what you felt when Antonin Scalia died?
That’s exactly what I am going to feel when Ginsburg kicks the bucket.

Sapper3307

Pron production?

The Other Whitey

Given her history of positions that contradict the United States Constitution and its Bill of Rights, I think it’s safe to say you’re full of shit, Lars. Again. As usual.

USMC Steve

NO, it might be her strong sense of responsibility to her unhinged liberal socialist philosophy. It certainly has nothing to do with her duties as a judge, as she doesn’t let the law, justice, or reality interfere in her votes.

OldManchu

You’re just funnin’ around Larsy.

Now on the other hand, a strong sense of smell is what is keeping your Presidential hopeful Joe Biden alive.

It’s “bodily fluids” from Keith Richards….

I don’t care if a person has been here since the hippies. If they are not citizens, whether they commit a crime or not, they are eligible for deportation. I don’t care if they’re stopped for a broken tail light, not a citizen, then what the fuck are you doing here. I give 10-1 odds this guy is on public assistance of some sort and perhaps every option available as well as supplementing his income with crime.

So, fuck him and it’s back to Jamaica dipshit.

A Proud Infidel®™

“I give 10-1 odds this guy is on public assistance of some sort and perhaps every option available as well as supplementing his income with crime.”

You and me BOTH!!!

David

If someone has been here 30 years illegally and has committed no crimes… he has been violating civil law for 30 years. He is a criminal and needs to go.

Next up to the Supremes: In LA an intelligent judge named Martinez ruled California’s background checks on ammunition purchases was unconstitutional. In less than two days the 9th Circuit overruled him and said yes, they are Constitutional and legal (I’ll skip the arguments pro and con.) Expect this to head to the Supremes most rikki-tik.

rgr769

Next, Commiefornia will pass a law limiting ammo purchases to no more than some number of rounds each month. I am sure there are progs in the legislature who believe one shouldn’t be able to purchase more than 20 rounds at a time.

Anonymous

More like one, taxed at 5000% each, with a social media check for any conservative “hate speech” (in addition to an ammo license and registration) first…

Inbred Redneck

David- that’s the most concise and logical approach to the problem I’ve seen in a long time.
Must be too simple for our friends on the left to understand.

Roh-Dog

I find it kinda funny (I find it kinda sad?) that the Left really believes well-written and explicit immigration laws are malleable yet clearly written individual rights expressed, not f’ing granted, in the Constitution… well its ‘open to interpretations’.
If someone wants to stay here they should, bold statement alert: FOLLOW THE RULES.

Five to four is too close to be sure and should
automatically trigger a do over.

Said some liberal progressive somewhere.

Slow Joe

Hold on a second.

How can anyone live legally in the US since the 80’s and not being a naturalized citizen?

With 40 years of residence, he must have been a permanent resident. All permanent residents can become naturalized citizens after 5 years of permanent residency in the US.

So, what happened here?

This guy was either illegally in the US for most of that time, or he became a permanent resident and decided to not become an American citizen. Why? Hate America much?

SFC D

Green card.

Slow Joe

The so called green card is permanent residence. Five years of that and that guy could have applied for naturalization.

He didn’t want to. So kick his ass out.

Mason

I think so many of these people just don’t prioritize becoming a citizen. It’s like that vet a year or so back that got himself booted from the country. It’s really idiotic and shortsighted, but those are the people I’m OK with booting. You’ve been here 30+ years and can’t be bothered to get your citizenship? See ya.
