Dover shooting death ruled self-defense

DOVER — The person who shot and killed Raymond Eldridge II outside Castaways Boathouse bar and restaurant in December and claimed he acted in self-defense will face no charges stemming from the incident, authorities announced Wednesday.

New Hampshire Attorney General Gordon MacDonald and Dover Police Chief Bill Breault said in a statement that while Justin Sabbattis, 46, had credibility issues, “the state cannot disprove Mr. Sabattis’ claim of self-defense beyond a reasonable doubt.”

Around 10 p.m. on Dec. 18, Dover police officers were called to Castaways for a report of a man brandishing a handgun. When police arrived, Eldridge was outside the restaurant fallen by a pickup truck with a gunshot wound to the chest, Gordon and Breault said. Despite attempts to assist him, he died from that single gunshot wound.

Homeowner shoots, kills intruder, Clayton County police say

A Clayton County homeowner shot and killed a man who broke into his home overnight, police said.
Officers were called to the residence in the 9000 block of Jenni Circle just before 3 a.m. Friday after a man called 911 and reported shooting the intruder, according to Clayton County police spokesman Officer David Portis.

Upon arrival, police found a man lying at the bottom of the stairs with gunshot wounds, authorities said. He died on his way to the hospital.

The homeowner told police he was awakened by a loud banging at his front door. According to police, he said the man broke a glass pane next to the door and reached through to unlock the door before heading up the stairs.

The homeowner grabbed his rifle and fired several shots at the intruder, police said.

Allentown man allegedly pulls knife in road rage incident
Chase started in Allentown, ended in S. Whitehall

S. WHITEHALL TWP., Pa. – When South Whitehall Township police responded to a reported road rage incident Wednesday, officers arrived to find the suspect being held at gunpoint by a witness.

Matthew J. Gavilanes, of South Fifth Street in Allentown, faces assault charges following his arrest in the 3000 block of Tilghman Street. District Judge Rashid Santiago arraigned the 18-year-old hours after his arrest, setting bail at $25,000.

Township police were dispatched to the scene about 1 p.m. for a report of a fight involving a knife. Officers arrived to find Gavilanes on the ground being held at gunpoint by a witness, according to court records.

The victim told police that Gavilanes started chasing him through Allentown over a road rage incident and followed him to the scene, according to records. The chase started at 24th and Hamilton streets, and Gavilanes allegedly ran red lights to catch the victim. Court records do not detail the alleged road rage incident that sparked the chase.

The victim alleges Gavilanes swung a large knife at his abdomen, threatening to kill him. He reportedly punched Gavilanes in the face and wrestled him to the ground.

Township police said a surveillance video of the incident shows Gavilanes pull into a parking lot, begin arguing with the victim and back into a parking spot. He’s seen taking something from the trunk of his car and putting it in his waistband. Gavilanes then approaches the victim, pulls the item from his waistband and slashes at the victim.

A witness told police that Gavilanes continued to try to stab the victim and threatened to kill him while on the ground.

Deputies received calls about a disturbance between neighbors arguing over feeding feral cats in the area, Ivey said.

One of the residents then became severely agitated when approached by the deputy and went behind a vehicle and charged a rifle, a sound the deputy, a military veteran, was able to recognize.

When he came around the vehicle, he fired at the deputy and the two exchanged several rounds of gunfire. The deputy fired off all rounds in his magazine, reloaded and fired several more shots, according to [Brevard County Sheriff Wayne] Ivey.

The subject was pronounced dead at the scene, and the the deputy was in stable condition. Neither the deputy nor the deceased subject have been identified by the Sheriff’s Office.

When visited by Ivey at the hospital, the deputy told him simply, “I won.”
