Seems the wheels are coming off the prosecutor’s wagon in the SOC Gallagher case.
Just the other day witnesses were bailing like the proverbial rats from a sinking ship, and now this?

NCIS witnesses refuse to take the stand in SEAL war crimes case

By Julie Watson and Brian Melley – Associated Press
SAN DIEGO — A military judge has removed the lead prosecutor accused of misconduct from the war crimes case of a decorated Navy SEAL.

Defense attorney Tim Parlatore says Capt. Aaron Rugh made the ruling Monday after he and other attorneys for Chief Edward Gallagher excoriated prosecutors for tracking their emails without court approval to find the source of news leaks.

Rugh unexpectedly released Gallagher from custody last week as a remedy for interference by prosecutors.

The removal could delay the trial scheduled to start June 10.

The lead prosecutor shitcanned- any evidence he touched is now tainted. Three witnesses for the prosecution no longer interested in testifying. IANAL but I did take a practice LSAT once, so If I were on the list for replacement prosecutors I’d find something else to do, and someplace far away to do it in.

As for CDR Czaplak, the shitcanned ‘lawer’ I suppose he can now find work as a paralegal in some ‘Slip-n-Fall, Ambulance Chasers’ law firm.

Hat tip to ChipNasa for the link.

These clowns were made lawers (lawyers) during the berryhussein administration (I’ll wager). It’s gonna take a long time for that ratbastards influence to be removed from our military (and civilian) folks.

Ships deserting the sinking rat, this is NOT going to look good on that Prosecutor’s Resume’!

Ex-PH2

Like none of us saw this coming, right?

I hope Chief Gallagher can get his life back together in one piece now. As I understand it, shooting carp jumping out of the waters of the Mississippi River can be very, very therapeutic.

Dumbass deserves getting kicked off the case. Don’t know why anyone would think tracking e-mails would be a good idea for a prosecutor.

Cobrakai99

Probably saw himself as Tom Cruise. He wanted “The Truth” and he was going to get it anyway he could.

Ex-PH2

And then he really couldn’t handle the truth!

Commie-Tsar

I handle the TRUTH every day when I go tinkle… the FLACCID MICROPENIS OF TRUTH!!!

SSG Kane

Well in his defense it was an NCIS operation to find the leak. He still shouldn’t have gone along with it.

David

Pretty sure that if you break into a store in the hopes of finding the perps you think will break in later, you still get charged with B&E. Good intentions do not excuse premeditated crimes as a general rule.

Looks like there prolly won’t be a need for a Presidential Pardon after all. Larsie boi will be disappointed betcha, betcha. He was looking forward to bringing the empirical data showing the guilt.

Commie-Tsar

Gotta have that empirical data… live and die by it!

Reminds me somewhat of that POS Nifong of the Duke lacrosse team who was willing to throw young white men under the bus so that he could enhance his career. May they both rot in hell.

Dustoff

My boy was a freshman at Duke when that went down. There was so much crap , that the public was not privy to. The corruption you heard about was the tip of the iceberg.

Cameron Kingsley

Hey, don’t be dissing paralegals now. That’s what I’m studying to become. Though, from what I am reading here, I wouldn’t trust him as a dog catcher, let alone a public defender and you can forget about prosecutor. .

HMCS(FMF) ret

CDR Czaplak must have been a graduate of the Nifong/Bernath School of Legal Misconduct… hopefully someone has the guts to have him investigated, punished and disbarred.

(The Good Idea Fairy paints on another kill mark…)

But did he say “Hold my Writ and watch -this-!”

ArmyATC

Was it a rat writ, writ for a rat?

JimmyB

I’m in Raleigh NC and remember that Duke case very well. The local paper (suitable for training puppies) was all about the poor pitiful “victim” of those rich white boys. But after the truth came out and Nifong was thrown out along with the case, do you think there was a bold apology? Nope – no big march, no nothing. I hear the boys got a good payout from all this and that’s fine with me.

Dustoff

The Raleigh News and Observer is the biggest left wing fish wrap since Pravda.

Sapper3307

This does not happen on the T.V shows.

They can’t handle the truth.

Billy

So a psychopath with a license to kill is going to walk free. Great.

STGCS Ret

@Billy if you go back and read all of the reports from the Navy Times – you will see that this was character assassination – The Chief is not a psychopath and is highly regarded by real warriors in the teams. This was an attempt by a disgruntled assistant AOIC who couldn’t handle the Chief being a Chief.I am confident Eddie will get a book and movie deal out of this mess and I hope it sets him up for a great retirement with his family.

AFCombatCAM

Where can I get one of these licenses? Will it be added to my customized license plate? Perhaps a patch that I can add to my vest full o’bling.

SFC D

What does Teddy Kennedy have to do with it?

Sapper3307

O.J?

In one of the articles I saw a picture of prosecutor in his dress whites. He has the basic Scuba pin. It makes me wonder if he got the Scuba bubble, then tried out for the SEAL’s and didn’t make it. So his feelings got hurt and he tried taking it out Chief.
