Ladner trial update

According to the folks at Fox5 Atlanta, things are not going well for self-proclaimed war hero, Shane Ladner in a Cherokee County, Georgia courtroom. The prosecution hosted the testimony of the commander of regional operations where Ladner claimed to have been wounded, his unit commander and the commander of medical operations for the region.

“We had no combat operations conducted out of our facility. Classified or unclassified,” retired brigadier general John Walsh flatly stated. “They didn’t exist.”

Walsh was an Army colonel commanding Joint Task Force Bravo in Honduras in January 1991 when Private First Class Shane Ladner arrived to be a military police officer.

“When I was the commander of Joint Task Force Bravo, we never conducted combat operations of any sort of kind,” he told the jury. “No counter-narcotics operations. It wasn’t even part of our mission.”

Colonel Percy Dunagin commanded all medical operations on the Honduran base during the time Ladner says he was wounded.

He testified his people never handled any wounded soldiers.

“No,” Dr. Dunagin stressed. “Never.”

Dr. Roland Weiser commanded medical operations in the second half of 1991. When asked about the possibility his hospital treated a combat wounded soldier that year, he said “no,” then answering the question more like drill sergeant than doctor, “I said I thought it was bulls—.”

Investigators even found Ladner’s battalion commander from that time. Retired Colonel Walter Wright said no one got a Purple Heart while he was there.

“If someone had been awarded a Purple Heart, would it have been important for you to know?” asked assistant district attorney Zachary Smith.

“It would have been important and it would have been rare.”

Ladner faces six counts of defrauding the Georgia Department of Motor Vehicles with this forged DD214 in order to save a couple of bucks of licensing fees for his car;

The Army has no record of the award of the Purple Heart, according to the Freedom of Information Act release of his records and his NGB-22 National Guard discharge record;

Fox5 speculates that the prosecution could wrap up it’s case today, then the real entertainment begins as Team Ladner defends him.

I may be late to the party, but I must say I’m a little surprised that investigators would go to the lengths of rounding up three C.O.s from his old unit just to dispute a claim on his department of motor vehicles form. I suspect I’m missing something.

Nonetheless, I’m encouraged by it all if they are going after the purple heart claim.

Ladner is being prosecuted in the county where he served as a police officer and from which he rec’d all of that community support. Yeah, it’s payback time.

I think that they have him up against 6 or 7 felonies at this point, with 10-20 years in prison. There is also a chance that, if found not guilty, he can sue his former employer and come back as a police officer. They started the trial saying this is not about license plates…it is about the lies …so many lies. He wasn’t in it to save money…he wanted to parade the pick up truck where ever he went with Purple Heart tags for everyone to see! The prosecution sliced and diced Ladner’s claim yesterday. The state’s witnesses gave scathing and damning testimony. One stated that if there was a DD214 for Ladner that bore a Purple Heart entry, it would have to be false. The witnesses weren’t paid experts. They were there and in the best positions to know the truth of the matter. Blam! Blam! Blam! Ladner must have acquired his doctored DD214 years ago, perhaps contemporaneously with hus actual one. He got many thanks and many gifts and many accolades and, all of it, undeserved. He is toast, unless the OJ jury is in that courtroom.

The judge refused to allow that testimony. The defense argued at the Jackson-Denno hearing that it would be only relevant to a character assassination, not the criminal matter at hand. The judge bought it and refused to allow it at trial.

I don’t think the prosecutor needs it, actually. They are doing a damn good job with what they have.

I wonder, was he offered a plea deal and was too dumb to accept it or is the prosecutor just trying to make an example of him? There are violent felony trials that don’t last this long.

And while I applaud the prosecutor for putting in the work to make a solid case, if I were a taxpayer in this county I would wonder if the offense Ladner is charged with warrants this expenditure of public funds.

Because it’s a zero sum game, isn’t it? Every dollar that is spent prosecuting Ladner for unlawfully obtaining a waiver of his license plate fees is a dollar that can’t be used to prosecute a wife beater, a robber, or someone else who is actually a threat to public safety.

And when Ladner is convicted (which he surely will be), I can’t help but think the story won’t be “Shane Ladner, lying sack of shit whose lies cost his wife her leg” but rather will morph into “Shane Ladner, victim of a vindictive prosecutor who was out to get him.”

I see where you are coming from. Here are some answers. Yes, he was originally indicted on 1 felony and 5 or 6 misdemeanors. That was a gift from the prosecution because he was a good cop and a good soldier. He even had a righteous shooting as a cop in Canton, GA. He refused that offer.

So given the magnitude of the lie: wife lost her leg, thousands of dollars spent on him in Texas, many thousands received by him for help with medical expenses while he waved his fake purple heart around, and because of his absolute refusal to admit ANY wrongdoing, they are really going after him.

They are ‘white collar’ offenses. But he definitely knew better. And he knew the consequences of going to trial yet he demanded it. Its his right to take a trial by jury. It definitely wasn’t the prosecution’s first idea. Since he wanted it, he’s getting it. Looks like the prosecutor definitely did their homework. I’ve been to several felony trials. I’ve never seen such preparation and gathering of witnesses. It’s amazing. Shane is toast.

You are missing another point. People do get out of punishments by making cases go on forever. It costs an arm and a leg in legal bills (too soon?). However a good prosecutor will dig in when that happens, especially for a media intensive case. Otherwise everyone would see what happens and do the same. Sticking with it sends a message.

He was a MP for the SCIF at MI LI. At the time time all troops were confined to Soto Cano B/C of the threat from the MPLC & FPN. Col Walsh was the commander (they used to call themselves POWs Prisoners of Walsh) So this clown was a SCIF guard on Soto Cano, I bet he didn’t even to get off base to go to town.

The defense has no witness to say, “Yep. I served with him. I visited him in the hospital after he was wounded” No witness to say, “Yep, I treated him for a wound.” No witness to corroborate anything. All the defense has is a piece of paper that a state’s witness said can’t be genuine if “Purple Heart” is on it. The state’s closing argument should be a humdinger.

We should start a pool on how long it takes the jury to come back with a Guilty verdict. I’m wondering if they even bother to sit down in the jury room.

Is it just me or does the fact that the DD214 that says he has a PH is a Nov 1988 version when it was prepared in 2004 a big red flag.

I’m pretty sure that later versions came into being in the intervening years and they had the previous versions obsolete caveat on them.

So, yesterday, wifey appears as a witness in hubby’s trial. There isn’t much about it and I saw nothing of her cross examination. She testified about the float disaster, which should have allowed the state to go through a doorway previously barred: how she and he came to be on that float. The violins were playing loudly and her value to the defense was just that: a sympathy appeal. After all, she wasn’t in service with him and wasn’t present in Panama when he was wounded. No one was. Cheap theatrics, replete with a teary-eyed shit bag. Trail continues today.

They had excellent and relevant witnesses. Actual witnesses to his military service! I’m still impressed they found the CG, his BN CO and the medical officer.

The defense, since they aren’t putting Shane up on the stand has….no witnesses to his service that vouch for him. No medical records. Nada. Well, the altered DD214, of course.

She wheeled into the courtroom and, I’m sure, rec’d every consideration for minimizing discomfort from the judge, probably, with a “Are you okay Mrs. Ladner? Are you ready to answer some questions” from the def atty. She probably winced and said, in a pained voice, “Yes, sir.” With the scene set, the practiced Q/A began. Of course, the state, after also showing her due care and consideration (Never ever be rude to an invalid in front of a jury!) asked her something about the event, why she and her husband were chosen. And that’s all the state really had to do for evidence and to set up the closing statement about undeserved reward for fraudulently claiming a PH. I am looking for an update, figuring no way this will go into next week but, so far, I have found nothing.

Atty John Cook also testified that Ladner’s DD214 was not where it was supposed to be, in St Louis, and that they sought the help of a now-former US senator to no avail. It could not be found in gov’t records

Pretty clever choice of defense witness, I’d say. The state couldn’t go where you might have hoped, thanks to the atty-client privilege. So there sat Ladner, silent, sometimes tearing, maybe sniffling, as his two impartial, disinterested witnesses, his wife and his mouthpiece, went to bat for him. And if you’re on the jury, you just have to be wondering, “Is that the best he can do, his own wife and a professional advocate? Why isn’t Ladner himself speaking to us?” And you would likely answer yourself with, “Because he’s hiding something.”

Unless sequestered, juries go home and come back the next day, during normal court hours. So, we should get the verdict today. We weren’t present for the trial and we were given only snippets of testimony. Based only on that and assuming that there isn’t some knucklehead or two on the jury, the next step should be a Guilty and probably release pending sentencing at a future date. If a pre-sentence investigation is mandatory or ordered, it will be at least a month before sentence is meted out. I thought we had at least one TAH commenter present in the courtroom but I guess not. Let’s hope there’s a verdict reported by Fox 5 Atlanta noontime news.

Well, the news hour came and went and…nothing. One of the two stations I am following had posted that their reporter would be on-air at noon, expecting, as I was, a verdict. That posting has now been changed to 4:00 p.m. Dahell is going on? If the jury found that he falsely claimed to the tax office that he had a PH when he knew the truth to be otherwise, that covers five or six of the charges. The remaining one is lying to investigators. All charges go to the lie. This, now, has me worried.

The jury has been at it nearly 12 hours and one juror asked whether another juror could be removed. Then, the foreman told the judge that one juror was using a larger notepad than the rest of the jury and there was concern about what was written on it. All it takes is one moron and it sounds as if the Ladner jury has that one.

And now you know why people settle court cases, because the number of fucktards in the jury room is exponentially higher than in the general population for several reasons. Most of those reasons involving lack of brain power sufficient to avoid being selected for a jury…here in the PRoM all I have to do is wear a tie to the jury room in Springfield Mass and as a middle aged white guy there is zero chance of me getting on a jury. For thirty years I am regularly removed as a peremptory challenge by defense counsel based on the color of my skin and my socio-economic status.

Apparently no one believes the part about being a dirt poor white trash kid in my youthful pre-military days. All they see is an affluent white guy so I must be racist and can’t be on the jury. It’s an interesting experience.

Meanwhile the guy sitting next me talking about all the n-words in the courtroom sails on through because he’s wearing a Phish T-shirt and has a fucking man bun…..juries of our peers indeed.
