Andre Shepherd’s asylum rejected by German courts again

We’ve been following Andre Shepherd since he first deserted and applied for asylum in Germany in 2008. He was a mechanic for Apache helicopter gunships who was to deploy with his unit for a second time. We’ve been told by people who deployed with him that he wasn’t very dependable anyway – he ran their dayroom during his first deployment. According to someone who knew him before he joined the Army, he wasn’t very dependable back then either.

German courts denied his application for asylum back in 2011. I guess his lawyer appealed that decision, and they were in court the other day where asylum was denied once again, according to Russia Today;

Andre Shepherd, 39, deserted his post at Katterbach Kaserne military base in southern Germany in 2007 after being told he would have to return to Iraq for a second tour. He claims he felt that he would be forced to take part in what he called “war crimes” if he did.

However, that excuse failed to hold up in court and the case was dismissed on Thursday, with presiding Judge Josef Ruber ruling that Shepherd had failed to exercise all available options to leave the military before deserting, making no attempt to join another military unit.

Ruber also said that Shepherd – who served as an Apache helicopter mechanic for the US Army – was unable to prove that he would have been forced to commit war crimes on returning to Iraq….

I think he was more scared that Jody was going to steal his German girlfriend than he was about being forced to commit war crimes, to the extent that a depot-level mechanic can commit war crimes while mopping up the dayroom.

What? How can they not understand how often war crimes are occurring in the day room? He might even end up being put in charge of the MWR tent and have to deal with war crimes daily like Soldiers’ wives flashing their cans on webcam or trying to play World of Warcraft online!

Those damn Germans just don’t get how harsh war can be in day rooms and MWR tents across the combat zones.

Problem is, most of them who come back are just being put in the brig while they get processed out of the military, depending on how social justicey their lawyer is depends on how harshly they get discharged.

I will say my unit was able to charge a guy with desertion all the way to our CG for not showing up to mobilize and deploy. But we also had information indicating he was purposely avoiding it and hiding out…….from his Myspace page. (Back when myspace was facebook of course)

On my last OIF tour in 2007 I had a 42 year old SPC who took an extra 3 weeks of mid tour leave and was pending charges when he refused to go out on route clearance missions because he was claiming we were committing war crimes.

Believe it or not I could not get him into the stockade down in Arifjan Kuwait and we had to sit on this turd while his charges ground through the system. He got busted to PVT but because he had a wife and about 5 kids he didn’t get much in the way of fines.

We were finally able to pawn him off on FOB maintenance where he subsequently tried to reenlist (there was a bonus don’t you know)and I even had the FOB CSM talk to me about the bar for reenlistment that was on him to see if I would support his request to lift it (I was a Co 1SG).

So, long story short….ain’t no firing squad in this douche’s future.

sounds sadly, to me, that the UCMJ isn’t what it used to be. Back in my day, if you even looked cross eyed at your platoon sgt, you’d be headed for a Company Grade article 15, 30 days of extra duty, and confinement to the barracks, as well as forfeiture of pay, etc…
