Christy Russell sentenced for VA fraud
Associated Press reports that forty-one-year-old Christy Russell was sentenced to pay back more than $32, 000 that she stole via credit card from 55-year-old Steven Reis, an Air Force veteran, while he was a-moulderin’ in a shallow grave beneath his home for nine months. She was also sentenced to four years in prison.
Authorities aren’t sure how Reis came to be buried underneath a vacant Dayton home.
Reis’ body was discovered in September and authorities believe he died in January 2015. Police said in a statement that an autopsy couldn’t determine his cause of death.
There were four other people living in the home and Russell was his caretaker. No one called 9-1-1 when he died. The police couldn’t figure out who buried him under the house so the only thing they could prosecute was the theft.

As a healthcare fraud investigator, specializing in VA/DoD false claims, I will tell you that prosecutions THEMSELVES are rare and that most cases are plea bargained down and never go to trial. Four years for this cretin is a probably because of priors and a below-average PD.

Yeah. It’s a strange one. Aside from PTSD, for which he was receiving benefits, reportedly, his other med issue was diabetes. Again that’s what I found. In other words, he was not bedridden or so sickly that his death was imminent. So, he dies, either of natural causes or at the hands of another, and is buried in a basement. Police arrive at the house on another matter and someone says he knows where there’s a body. The body is located, and an autopsy is inconclusive. What is known is that Miss Piggy continued to use his card. The “caretaker” business goes unexplained. She is not a nurse or licensed caregiver. One hopes that this isn’t the end of the matter and that while she is in prison, the cause of death will be found.
She might have kept his insulin away from him. Then it would look like a natural death.

Sadly, absent a confession that might be very difficult to prove after the remains have had months to decompose.

3E9. I think they got that buried part figured out but there is no probable cause to believe that anyone took his life. And burying a corpse may or may not be a crime and, if it is, it may be no more than a misdemeanor wherever the hell this happened. Originally, Miss Piggy had been charged with evidence tampering, too, but that was dropped. It’s hard to tamper with evidence when there hasn’t been a crime.

No evidence of murder, several possible suspect residents- whom do you charge? – and I’ll bet her story was that “He told me to keep using the card because he was such a sweet old guy” – she got four years for that. There is no mention of which veteran benefits she took advantage of… at a guess, he may have had a retirement or disability income, somebody was compensating her to be a caretaker.
$32,000? Would you think that someone may have at least been making the minimum monthly payments to keep the account from being suspended or closed?
Somehow, I doubt that she will ever have $32K to pay off a judgment. It could be insightful to know much of that amount is interest/penalties, how much was already outstanding on the debt by the estimated date of Steven Reis’ demise (January, 2015) and how it was that investigators came to discover a grave underneath “his home” in September.
Even though it’s not real far from Dayton to Sporty’s Pilot Shop, I am inclined to think that Dead-stick Dan was probably busy with other stuff, last January.
A four year sentence sounds more like a means to keep her available while they sort out the rest of the story. Digging a grave, in Dayton, Ohio, in January, could have been pretty difficult.
It sounds like he was getting a VA penision going to his bank Direct Deposit. She had his ATM Card and PIN, so she could simply make withdrawls throughout the month.

She probably was doing the same when he was alive and providing little care.
Elderly abuse. It happens way to much with VA and SS recipients. Often its the family members that do it.

J Dog….you present a serious dilemma few want to discuss these days. Some of the older vets have little if any family they remain in contact with. Making it worse, too often an alternate is paid an additional $300 + per month to handle one’s affairs. Bothers me just as much as it does you, and probably many others who know what is going on behind closed doors. Truthfully, I’d LOVE to see the V A and the police investigate this and make an example out of it. How can we start some sort of contact with both sets of authorities to see how they follow through? If we could just get one case such as this one rolling and go postal public with it, perhaps the likelihood of it spreading further would be less. We have to start some where and I’m willing to commit some time to the effort. Not smart enough to organize, but aggressive enough to do some serious grunt work to see it through. Name it if I can help. Willing to bet a lot of others would be interested and willing to pitch in a few hours to make this happen.

One caveat…all helping are to be volunteers. If any money were to be collected to help, it need be handled ONLY by some one who can be bonded. The VERY LAST thing I want to be associated with is some veteran’s-related group being embarrassed by financial malfeasance. If someone seeks a Rolls Royce for their help, a child’s bicycle up the rectum would be just the order.
You, J Dog, and anyone else who would consider this…let’s make it happen. A lot of us would eventually go to our grave with a smile on our face if we could prevent these things from happening over and over. Accountability is the KEY…..PERIOD!! Open books available on request and all questions answered. How could we go wrong?

Some states have established regulations and licensing standards for home-health aides. She may have been “free lancing” or providing “other” services.
