Galloway’s civil case against Spodofora proceeds
Back in March, we wrote about our buddy, Earl Galloway who made a parody Facebook page about valor thief, John Spodofora who pretended to be a Vietnam secret squirrel. Spodofora, now the mayor of Stafford Township, NJ, used the force of his police department to investigate the Facebook page and Mr. Galloway. So Galloway is suing because the police chief and mayor tried to intimidate him according to the Ashbury Park Press.
Galloway alleges in the suit that Spodofora and [Police Chief Joseph] Giberson used the power of their respective public offices to intimidate him, violating Galloway’s constitutional right to free speech and his right to assemble. Galloway also alleges that the investigation jeopardized his civilian employment at Naval Weapons Station Earle in Monmouth County — after Stafford Police asked Naval criminal investigators for assistance — where Galloway’s security clearance is essential to his work. Galloway is also a retired Navy command master chief petty officer.
Well, the judge says that the case can go forward.
After the hearing, Galloway attorney Michael Ansell, of the law firm Ansell Grimm & Aaron of Woodland Park, said the next phase of the case will be discovery — a long period of fact-gathering and deposing witnesses.
Ansell said this case will mark the first time Spodofora will be compelled to answer detailed questions under oath about issues concerning his biography, particularly Spodofora’s service in the Navy from 1966 to 1973.
Funny how these phonies stick to their guns so long that it only gets worse for them, isn’t it?

Well, it looks as if Galloway will be able to choose Door #1 or Door #2, with the former putting money in his pocket by settlement and the latter being to go forward and get a favorable verdict that makes mincemeat of Spoddyoddy Fedora. Galloway has already won, in a sense, and the award may be nominal (he didn’t lose his job) so I’d take Door #1–the money.

I’m not a Navy type, but isn’t a Command Master Chief the equivalent of the All Mighty himself?
The hierarchy of a Naval command usually works as follows: 1) The commanding officer, 2) the command master chief/chief of the boat, 3) God, 4) everyone else.
And depending on who you have in both those billets, in some cases, I’d rather piss off the CO than the COB.
The COB can end signatures all on your qual card with one comment in the goat locker. The CO, not so much.
True. There’s only a few enlisted watchstations that require CO to sign off (RO/SRO/EWS back aft for starters) but for EVERY watchstation or qual, you have to go through SOMEONE’S LPO somewhere along the way.

Free speech on Facebook is becoming endangered all the time. I’d like to sue a certain veteran’s organization because they choose to muzzle free speech instead of allowing it because of the political correctness rubbish, and the unreasonable fear that individual speech is the speech of the organization at all time, which is not true.
While I agree with this premise, Unfortunately, The internet is not bound by the constraints of the Bill of Rights; much less the U.S. Constitution.
Albeit, The spoddy character is an asshat and deserves to be nailed to the wall.

I hate to be the one to tell you this but “Free speech on Facebook is becoming endangered all the time” makes no sense. Facebook is not the government. They actually don’t have to let you say a blessed thing. In fact, if they want to lock down your ability to say anything (or censor any post by you for any reason) they have every legal right to do so. Because Facebook is not the government. The First Amendment gives you the right to say what you like without the government interfering. Nothing says a private business has to let you use their forum to say what you like.
MikeD is correct. Someone who runs an online spot which allows comments has the right to monitor comments and deny access to people who cannot behave themselves. When was the last time anyone saw any of the DRG posting here?

How about improper use of the people’s resources? To me, this sounded like Spodofora’s personal vendetta to use these resources to go after Galloway.
When they use police for search and rescue and then find out it was all a lie, the people that were spinning the yarn are charged.
According to the new SV law, he can parade around all day claiming to be whatever he wants to be, as long as he gains no tangible benefit from it. Hell, it seemed so unimportant to the citizenry that he was elected after he was outed. The problem is that he decided to use his official resources as mayor to intimidate his detractor.

John Spodofora, in case your attorneys and those for the city and possibly the state if they were involved, by you, in this, have not told you the legalese of this, here goes. It is what we call using the “color of your office” for dishonest, immoral or illegal reasons. Along with all those who were complicit with you in this. I foresee a big, big, really big, go away settlement being offered to Mr. Galloway.
He should move to Chicago. He’d feel right at home.
