Rochester’s Mark Kelly sentenced

You might remember this Mark Kelly fellow who was arrested in November for pretending to be a Navy officer, for being in possession of false military credentials and for lying to investigators up in Rochester, New York. According to WHEC, he was sentenced yesterday;

Mark Kelly was sentenced to three months in prison and 36 months of supervised released. He will also have to perform 300 hours of community service at the Veterans Outreach Center and purchase 500 flags to place at veterans’ grave sites.

Prosecutors say Kelly repeatedly lied about being a Navy officer and would regularly wear a Naval uniform around town. He also lied about being active duty when he rented an apartment in Rochester for which he received a discount on his rent and other benefits.

One of the times that he was wearing the phony uniform, Kelly participated in a funeral of a local Marine who was killed in combat last August. The judge instructed him to write a letter of apology to the family.

I know the punishment seems light to us, but in light of how rarely these cases are prosecuted, I’ll take it.

Dipshit deserved to be jailed, especially when he showed up at the memorial for the fallen Marine. But, at least the DA and the judge saw to punishing this clown for his antics.

One of our lawyer commenters can correct me if I’m wrong – but if he’s on 36 months supervised release, I’m pretty sure that means it was a felony conviction for at least one of the charges.

That’s a “good thing”, even if he isn’t doing it all behind bars.

NCIS was involved per the original TAH story:
“During the investigation, Kelly was interviewed by Naval Criminal Investigative Service Agents and allegedly made several false material statements. Investigators also recovered several false military ID cards in various stages of production from the defendant’s place of employment. Each charge is punishable by up to five years in prison and a $250,000 fine.”

I hope that the judge qualified the volunteer work with “if they’ll have him” because the Veterans Outreach Center, according to its website, conducts criminal background checks on applicants and, of course, does not have to take this guy on as a volunteer. Besides, given how this story broke (with a bounced rent check) and his criminal convictions for manufacturing fake IDs, I don’t know who would want him around. And although the article says he’s going to prison for thee months, he’s not. Oh, he might end up with a few weeks in the local jail before they kick him out wearing an ankle bracelet, but that’s about it. Then it’s probation for three years which, if he’s a good boy, will see him off that in a year or two, or his case made nonactive–meaning no effective supervision. So, yeah, he was convicted, though not convicted of stealing valor.

I hope somebody clears that letter BEFORE it goes to that Marine’s family. The last thing they need is some sob story, or this slimy sob trying to worm into their affections, the way some fakers did with the Luttrell family.

There were hangers-on with both the Luttrell and Kyle family. Predators and con artists all, playing on the painful emotions and the stress both families suffered.
