Keith Chandler elects to go to trial for forgery

You may remember when we wrote about Keith Chandler and his Purple Heart license plates last July. Everyone figured that it would be a slam dunk and that he’d plead guilty, but apparently not. WFMJ reports that he wants a trial instead;

34-year-old Chandler decided to go on trial on seven counts of tampering with records and one count of forgery.

Authorities say Chandler misled the Bureau of Motor Vehicles in order to obtain Purple Heart license plates.

In October, his lawyer insisted that he had been injured in combat and that, somehow he was not awarded the Purple Heart;

Chandler’s lawyer Gary Rich plans to file an application with the court seeking intervention in lieu of conviction.

“Based on the injuries Keith sustained as a result of his combat fighting in Iraq, I believe he is entitled to it,” said Rich.

I read an article the other day about a Bataan Death March survivor, Jerry Baltazar, who was just awarded a Purple Heart. He’s 94-years-old and somehow he survived all this time without his Purple Heart medal. He didn’t think he earned one and didn’t forge his DD214. So, Chandler can go pound sand along with his lawyer.

Said his lawyer, “I believe he is entitled to it [the Purple Heart].” Oh. That changes everything. I had no idea that this lawyer made the determination that his client is entitled to the Purple Heart. Let him walk. That’s good enough for me.

I also see that Chandler is contemplating “intervention in lieu of conviction.” Under Ohio law, that means that he will seek to sidestep an actual trial by saying that demon rum, drugs, or mental disability explains the bad and illegal act. If he’s eligible for it, it will be up to the judge whether to grant the motion. If it’s granted, the proceedings are put on hold and Chandler will have to stay clean for a year and be supervised by the probation department. If he screws up, it’s back to square one for him. Who’s buying?

On another note, was it a lower leg above the knee injury? Was the DD214 altered in Edwardian Script font?

Many people do very stupid things when drunk, drugged, or when suffering some mental disability. The thing is, this isn’t the sort of crime that is explained away by any of those stupid-inducing things; however, Ohio law doesn’t carve out exceptions for the intervention alternative. He’ll likely be eligible if he has no felony history and can establish that he’s a drunk, druggie, or nut. Then it will be the judge’s call on whether to give him an out.

In addition to providing a 214 one must (at least here in Ohio) sign an affidavit that the information is true. Swearing to a false affidavit is a felony.

Nope, two different lawyers. But maybe Chandler’s mouthpiece can get together with Ladner’s shyster and put in a request to see if Chandler’s PH citation is in the same drawer of that personnel clerk’s desk down at Fort Benning. Or even better maybe the paperwork for both of them is stapled together in the file cabinet down at the hospital in Panama. I’m still waiting on word as to how that great mouse hunt is coming along.

I don’t know who’s dumber, Chandler or his attorney. Just goes to show an ambulance chaser will take any case he can make a buck on and believe me he’s going to bend Chandler over big time for the up till now representation and now a court trial. He’ll be laughing all the way to the bank as the jury declares a unanimous “Guilty, on all counts”. To which he will turn to Chandler and say “Hey I did the best I could. If it just hadn’t been for the forged documents, an FOIA that said you’re a liar and 7 counts of tampering with records, we could have won this one easy. Thanks Mr. Chandler, sorry the Judge didn’t go for the intervention thingie. Don’t worry about all you’ve heard and the movies you’ve seen about time in jail…they’re all true. Just keep your ass hole covered. Good luck and you and your family will be getting my bill soon.”

I’m not sure Chandler’s attorney is dumb. Hopefully he demanded a healthy retainer from Chandler and the attorney gets paid whether Chandler beats the rap or not.

Now, if the lawyer DIDN’T demand a retainer then I would agree: He’s dumb. ‘Cause Chandler’s pretty likely to be convicted and even if he escapes jail time I doubt he’s got a pot to piss in.

And lawyers charge a substantially higher hourly rate when a case goes to trial because trials can take up so much of their time. I have a suspicion this is one of those lawyers without a large clientele so that going to trial is a money-maker for him. With lawyers, you must always follow the money.

WHo was that lawer who used to “practice” at the Under The Hood Coffee Shop (home of hippies trying to get soldiers to desert because of the war and all). I keep looking for his name to pop up in cases like this. If I remember correctly, he had quite a record for having his clients go to jail instead of go free.

Flag Waver, ditto here. I broke an ankle when I got pitched off the strut of a Huey about fifteen feet in the air over a hot LZ we were assaulting. I hit a boulder with a glancing blow that knocked me unconscious and broke the right ankle. Even though I was later told I should claim a Purple Heart, I never pursued it.

Nor have I ever sought any government care or benefit for that ankle which never healed properly and plagues me to this day almost fifty years later.

The BCD might actually help this guy prove he is eligible for the intervention program, if it was for drugs or ‘rage’ issues a lot of civilians believe the military turns you into a smoldering time bomb waiting to ignite and go full psycho.

The lawyer might be a lot sharper than some of us think, he might have all the BCD information in hand and have determined based on that information intervention is a great option that completely avoids trial or that he’s certain at least one juror can be convinced this poor man has “issues” because of his military service.

Should be interesting to watch as it winds its way through the injustice system.

I actually served with this Marine… He was hard as nails. It breaks my heart to see fellow service members verbally attack one of our own. I watched this Marine leap from the turret of his AAV, disregard his own safety to shield another wounded Marine. I also know for a FACT that he did not receive a BCD or dishonorable. I think it’s kinda funny to hear the idol threats of the Facebook Mafia and the telephone tough guys. Sgt Chandler was a Martial arts instructor. I personally watched him destroy Marines Twice his size. His heart and determination made me a better Marine. I also saw him snap his nose back into place after a devastating rocket attack that made him bleed like a high school cheerleader on the rag. Sgt Chandler deserved many awards he never asked for including his Purple Heart. Instead of throwing stones maybe we should reach out. Our system is broken and I’ve seen so many be shorted of what they deserve…. Let’s be men and help this guy.

“Sgt Chandler deserved many awards he never asked for including his Purple Heart.” He didn’t have to ask for it. It appears he awarded it to himself. Check that. Wasn’t it two Purple Hearts? In any event, he also submitted some paperwork to the DMV attesting to the Purple Heart or two that he never asked for. As a result, he was issued a Purple Heart plate that, I suppose, he really didn’t ask for either. Now, if you want to testify to SGT Rock’s heroics and battle wounds I suggest that you contact his attorney so that you can do so under oath. I’m sure that he will be happy to hear from you.
