HM1 Omar Pescador-Montanez convicted
Back in March, we discussed HM1 Omar Pescador-Montanez who was a corpsman for a SEAL team in Afghanistan. According to the Navy, he detonated a grenade in their infirmary in order to avoid his job. NHSparky sends us a link to the Navy Times which reports the results of his court martial;
At a special court-martial in Norfolk, HM1 Omar Pescador-Montanez was tried for false official statement, damaging nonmilitary property, malingering, self-injury without intent to avoid service, reckless endangerment, and discharging a firearm under such circumstances as to endanger human life. On May 15, a judge returned a verdict of not guilty to false official statement, damaging nonmilitary property and malingering, but guilty to reckless endangerment, self-injury without intent to avoid service, and negligent discharge. The judge sentenced him to reduction in rank to E-5, confinement for 25 days, and 90 days hard labor without confinement.
So tossing a grenade into an infirmary is a negligent discharge, huh?

As I said to Jonn, this guy got off light, all things considered. His career is screwed, and this is going to be nailed to every job application he fills out, but I was surprised he wasn’t doing his hard labor in Kansas.
From the article at least – no BCD or DD – probably get an Other than which wont impact him

His name translates from Spanish to English roughly as “mountainous fisherman”. I spent a few minutes trying to think of a pun on his name that would relate to the story, but finally gave up.

I guess that his days with the Teams are over. This guy will be emptying bed pans or doing short arm inspections for the rest of his service.

He got off pretty damn light, and is still able to serve. There were some interesting cases in that article. I’ve heard of fraudulent enlistment, but what the hell is Fraudulent Separation? That cat got a bad conduct discharge, reduction in rank to paygrade E-1, a fine of $10,000, and confinement for 120 days. Hell of a lot harsher sentence than Mr grenade pin puller.
He might be able to finish his enlistment, but I’m not sure if he’s allowed to reup with a court martial conviction. Certainly his command won’t recommend him.
Nope, most def not. Should have said served out the rest of his enlistment. Wonder if he’ll get an Honorable discharge. Any admin types out there? Can he receive on OTH for having a CM conviction, or will it be honorable if he stays out of trouble for the rest of his enblistment?
IIRC my GMT correctly, he’ll probably get a General-OTH because of the CM conviction. No way he can get an honorable, and General-Honorable would be for NJP type of stuff, unless it was several of them.
