Stop Hasan’s pay

Brian sends us a link to an article on NBC about some people finally getting around to do something about Nidal Hasan and his pay.

“It’s outrageous to think this guy has a bank account that’s being paid for with our tax dollars,” Florida Rep. Tom Rooney said.

Rooney, a former prosecutor at Fort Hood, joined efforts with Rep. Tim Griffin and Rep. Frank Wolf to introduce the Stop Pay for Violent Offenders Act, which would allow the military to suspend pay for Hasan and other members of the military arrested in connection with serious crimes. The money would be set aside pending the outcome of the trial. If a soldier is convicted, the money would be paid to the victims.

“I do believe this is good policy, and we know that the government believes that, too, because other agencies utilize it,” Rooney said.

Yeah, I’m pretty sure that it’s too late to do anything about Hasan, and let’s hope that we don’t need the law going forward. But Congress excels at closing the barn door after the horses are out.

You said it best in your last statement. Too late for action on Hasan I think. The horse is long gone and the barn doors have been closed since he was incarcerated.

On a legal basis, I understand they can’t pull his O4 pay until he is convicted and sentenced to a reduced rank. But as medical officer I certainly hope he’s not still getting professional pay or payouts from bonuses. That pay is associated with performing specific duties. If he’s not performing said duties, he shouldn’t be entitled to that pay.

Maybe you guys are unconsciously putting “ass” in his surname (and that’s funny), but his name is spelled “Hasan.”

No, I think that if it’s worded carefully, they can get him from the day the Act is signed into law. They just won’t be able to retro it to apply to the money he has received thus far. The trick is to target the pay and not have the trigger be the arrest or crime date.

@3 – his professional pay was pulled almost immediately, after his medical privileges were terminated. So now, he’s receiving O-4 base pay only.

what pisses me off, if you commit a crime off post and go into civilian confinement, you loose your pay. why not the same for military confinement? also, you think these same politicians could instead press the White House on changing the classification of his attack from “work place violence” to what it really was? terrorism.

Maybe the new proposed law can’t go after Hasan’s pay retroactively (ex post facto), but if worded carefully, it can not only stop current pay, but also collect back pay (from date of violent act) upon conviction and sentencing.

Once this d-bag finally gets his trial and sentencing, the jury should have the option to tack on fines to whatever else they come up with. Hopefully, the prosecution will ask for fines of an amount of at least the money he’s received while incarcerated. Whether this money will make it to the victims’ families is another question.

Definitely they need to stop his pay. They also need to stop his breathing.

At this point, I’m more interested in the latter than the former.

I just hope it’s frozen in a bank account, and can be taken back after he’s convicted in the form of a fine or other action. Civil suits?

I actually am a Bill, and when the Mr. Bill character was on SNL I’d occasionally get teased about it. Years later when I was choosing an online pseudonym I chose this one (I use it in several places). It reminds me not to take myself too seriously.

As far as his pay, there’s no way they can stop it, since technically until he is found guilty he is serving as an O4.
The one angle I can see is that since he has links to terrorisism they can freeze and seize his accounts as they might be used to finance terrorist activity.

Maybe… just maybe…. these things shouldn’t be allowed to drag on for years and years.

You’ve got multiple eye-witnesses, the suspect admits he did it… Have the damn trial and a execution 6 months later.

legally it will be hard to stop his pay. After his conviction, he will forfeit all pay and allowances. And I’m pretty sure he can be fined. That fine should be every last cent he’s been paid since he went all “Jihad Johnny”. with a little extra tacked on just for S&G
