Judge dismisses Donald Trump classified documents case
The judge in the classified documents case against Donald Trump determined that Jack Smith was unlawfully appointed. Smith’s appointment violated the Appointments Clause of the U.S. Constitution. Trump faced 37 felony counts resulting from Smith’s investigation. He pleaded not guilty to the charges. The unlawful appointment led to the judge to dismiss the classified documents case.

“Former President Trump’s Motion to Dismiss Indictment Based on the Unlawful Appointment and Funding of Special Counsel Jack Smith is GRANTED in accordance with this Order,” U.S. District Judge Aileen Cannon wrote in a Monday ruling. “The Superseding Indictment is DISMISSED because Special Counsel Smith’s appointment violates the Appointments Clause of the United States Constitution.”
Trump, following the ruling, told Fox News’ Bret Baier — the anchor and executive editor of ‘Special Report with Bret Baier’ — that he was “thrilled that a judge had the courage and wisdom to do this. This has big, big implications, not just for this case but for other cases.
“The special counsel worked with everyone to try to take me down,” Trump added from Milwaukee, the site of this week’s Republican National Convention. “This is a big, big deal. It only makes this convention more positive. This will be an amazing week.”
The Appointments Clause says, “Ambassadors, other public Ministers and Consuls, Judges of the Supreme Court, and all other Officers of the United States be appointed by the President subject to the advice and consent of the Senate, although Congress may vest the appointment of inferior officers in the President alone, in the Courts of Law, or in the Heads of Departments.” Smith, however, was never confirmed by the Senate.
“Upon careful study of the foundational challenges raised in the Motion, the Court is convinced that Special Counsel’s Smith’s prosecution of this action breaches two structural cornerstones of our constitutional scheme — the role of Congress in the appointment of constitutional officers, and the role of Congress in authorizing expenditures by law,” Cannon wrote.

Biden should be fully prosecuted by law for when he was VP and during the time after he was VP. He held classified documents, which isn’t a privilege extended to VP’s. I doubt the VP enjoys executive immunity the way the POTUS does.

I’ve read some medical opinions that FJB is in the mid-stages (which lasts on average 2 – 4 years) of dementia because he exhibits all the traits associated with it, and he has clearly shown it is progressing and getting worse.
I doubt FJB will make it until 2028. I predict by mid-2025 or early 2026 we’ll learn he’s in the late stages and need full-time assistance in a nursing home. Life expectancy is greatly reduced by this point and is the shortest stage – on average 1-2 years.

It wasn’t dismissed with prejudice, so if as you say, there is legitimate evidence of a crime, a legitimate prosecutor could refile charges, and move the case forward.
I could be wrong, but it seems like your posts above are suggesting that the ends justify the means, ie: If President Trump did something illegal, it’s ok that Garland ignores the law in appointing a prosecutor.

My own understanding is second-hand, but from what I gather, numerous challenges to past Special Prosecutors have been made, none successful.
For example, the DC Circuit Court upheld Mueller’s appointment because it was done by a head of a department – the acting AG. In 2006, Scooter Libby’s challenge that Special Counsel Fitzgerald was not valid was also dismissed.
I know some well-respected legal minds have argued it’s invalid, but they seem to be in the vast minority. When experienced professionals on both sides say this is legal, I tend to believe them.

You might want to stop reading, since your reading comprehension and ability to analyze legal concepts is weak or nonexistent. Morrison was based on a statute that expired in 1999. You might know that had you bothered to read it and Judge Cannon’s decision, instead of reading propaganda and hearsay.
That’s just it, I’m no legal scholar, but the basis for her ruling is that the appointment was unconstitutional. Now if that should get overturned by SCOTUS, I’ll change my opinion on the subject. If I’m not mistaken (and I could be), those other cases never made it that far, so there wouldn’t be a true precedent prior to this case.
Right or wrong, the President is the ultimate declassification authority. An investigation and trial would be the right process if the rule of law was actually followed. It goes straight out the window when its applied selectively. You cannot grant Hillary and Joe a pass while prosecuting Trump. No reasonable human being can see that’s right.
