Judge dismisses Donald Trump classified documents case

| July 15, 2024

The judge in the classified documents case against Donald Trump determined that Jack Smith was unlawfully appointed. Smith’s appointment violated the Appointments Clause of the U.S. Constitution. Trump faced 37 felony counts resulting from Smith’s investigation. He pleaded not guilty to the charges. The unlawful appointment led to the judge to dismiss the classified documents case.

From Fox News:

“Former President Trump’s Motion to Dismiss Indictment Based on the Unlawful Appointment and Funding of Special Counsel Jack Smith is GRANTED in accordance with this Order,” U.S. District Judge Aileen Cannon wrote in a Monday ruling. “The Superseding Indictment is DISMISSED because Special Counsel Smith’s appointment violates the Appointments Clause of the United States Constitution.”

Trump, following the ruling, told Fox News’ Bret Baier — the anchor and executive editor of ‘Special Report with Bret Baier’ — that he was “thrilled that a judge had the courage and wisdom to do this. This has big, big implications, not just for this case but for other cases.

“The special counsel worked with everyone to try to take me down,” Trump added from Milwaukee, the site of this week’s Republican National Convention. “This is a big, big deal. It only makes this convention more positive. This will be an amazing week.”

The Appointments Clause says, “Ambassadors, other public Ministers and Consuls, Judges of the Supreme Court, and all other Officers of the United States be appointed by the President subject to the advice and consent of the Senate, although Congress may vest the appointment of inferior officers in the President alone, in the Courts of Law, or in the Heads of Departments.” Smith, however, was never confirmed by the Senate.

“Upon careful study of the foundational challenges raised in the Motion, the Court is convinced that Special Counsel’s Smith’s prosecution of this action breaches two structural cornerstones of our constitutional scheme — the role of Congress in the appointment of constitutional officers, and the role of Congress in authorizing expenditures by law,” Cannon wrote.

Thanks to HT3 for the news.

I wonder what country Joe Biden’s sycophants and controllers will flee to after the election?

Canader? I hear they don’t know jack up there.

Wherever they go, they better flee to a country that doesn’t have an extradition agreement with the U.S.:

Afghanistan, Algeria, Andorra, Angola, Armenia, Bahrain, Bangladesh, Belarus, Bosnia and Herzegovina, Brunei, Burkina Faso, Burma, Burundi, Cambodia, Cameroon, Cape Verde, the Central African Republic, Chad, Mainland China, Comoros, Congo (Kinshasa), Congo (Brazzaville), Djibouti, Equatorial Guinea, Eritrea, Ethiopia, Gabon, Guinea, Guinea-Bissau, Indonesia, Ivory Coast, Kazakhstan, Kosovo, Kuwait, Laos, Lebanon, Libya, Macedonia, Madagascar, Maldives, Mali, Marshall Islands, Mauritania, Micronesia, Moldova, Mongolia, Montenegro, Morocco, Mozambique, Namibia, Nepal, Niger, Oman, Qatar, Russia, Rwanda, Samoa, São Tomé & Príncipe, Saudi Arabia, Senegal, Serbia, Somalia, Sudan, Syria, Togo, Tunisia, Uganda, Ukraine, United Arab Emirates, Uzbekistan, Vanuatu, Vatican, Vietnam and Yemen.

I hear Chad is nice this time of year.

President Elect Toxic Deplorable Racist SAH Neande

Only if you gots some danglin’.

5JC

That is not the best list. I guess if I had to pick one, it would be either Vietnam or Tunisia.

The only reason I would go to Tunisia is because I have a high ranking friend in the government there. That will probably be essential when you’re on the lam.

Vietnam is pretty nice, but eventually China will take them over during the big war.

Forest Bondurant

I checked for you.

The cost of living in Vietnam is about 58% lower than the U.S.

Tunisia is about 59% lower than the U.S.

5JC

So I guess it comes down to whoever has the bigger elephants and tigers.

USMC Steve

China tried that stuff once before and they got their asses kicked by the Vietnamese version of the National Guard and Reserve.

How many of the listed countries have our dear leaders not crapped on. That would require more research but less typing of the results.

MIRanger

I see them fleeing to the Emirates (UAE) or possibly Bahrain (since they allow alcohol)!
They have a very high standard of living they want to maintain, but want to ensure no one will bother them in a private kind of way, while maintaining their freaky lifestyle!

No way they would compromise their principles and move to an oil Emirate. That would be blasphemy.

Prior Service (Ret)

So which urge will be stronger after the next election: a) get the case right first, then hammer Joe; b) we don’t do former presidents’ classified docs cases; c) he’s too old and feeble, no court would convict him; or d) we will get to it, but only after all the other felony charges are finished.

5JC

Who cares about his classified docs? All that money they extorted from foreign countries and never paid taxes on? Looks like big boy prison to me.

Forest Bondurant

Biden should be fully prosecuted by law for when he was VP and during the time after he was VP. He held classified documents, which isn’t a privilege extended to VP’s.  I doubt the VP enjoys executive immunity the way the POTUS does.

And remember – while FJB was former VP, he bragged about his role while serving as VP in getting Ukrainian Prosecutor General Viktor Shokin fired after threatening then Ukrainian President Poroshenko, telling him the Obama administration would rescind $1B unless Shokin was fired for investigating Hunter’s company.

Biden described it himself while giving an interview at the Council on Foreign Relations in 2018:

“I said, ‘Nah, I’m not going to – or, we’re not going to give you the billion dollars.’” “They said ‘You have no authority. You’re not the president’”. Biden said “Call him. I’m telling you, you’re not getting the billion dollars’” “I’m going to be leaving here in, I think it was about six hours.” I looked at them and said, “I’m leaving in six hours. If the prosecutor is not fired, you’re not getting the money.” Well, son of a bitch. He got fired. And they put in place someone who was solid at the time.”

That’s just for starters.

Forest Bondurant

I’ve read some medical opinions that FJB is in the mid-stages (which lasts on average 2 – 4 years) of dementia because he exhibits all the traits associated with it, and he has clearly shown it is progressing and getting worse.

I doubt FJB will make it until 2028. I predict by mid-2025 or early 2026 we’ll learn he’s in the late stages and need full-time assistance in a nursing home. Life expectancy is greatly reduced by this point and is the shortest stage – on average 1-2 years.

One article I read says some severe symptoms include an inability to communicate, such as only being able to speak in their childhood language; an altered perception of time; needing full-time assistance with daily tasks (eating, dressing, bathing, etc.); inability to recognize faces of friends & family, or even themselves in a mirror; loss of physical abilities (walking, sitting, swallowing, holding one’s head up), incontinence, and so on.

OAM

Nope. He will have a stroke or something else, you know, from the stress of watching all he tried to achieve being dismantled. They will never, ever admit dementia, unless they can thoroughly blame the “cover up” on Jill and Joe.

LC

That’s a shame for those of us who believe in the rule of law.

I imagine there’s a better-than-decent chance it’s reversed on appeal, given how prior Special Counsel appointments have been unsuccessfully challenged, but I can’t see anything happening if Trump wins in November.

Gonna be interesting to see the VP pick shortly. I think if it’s Haley, it becomes his race to lose rather than the toss up it is now, as that would shore up independents and those who dislike Trump but vote conservative. If it’s Vance, I don’t think it moves the needle in any measurable way.

SFC D

We believe in the rule of law. Our current administration, not so much.

LC

That’s fair; I didn’t mean to imply those who don’t agree with this don’t believe in the rule of law. I just feel that there’s legitimate evidence that he willingly took classified material, refused to give it back, and the ‘I declassified things in my mind’ excuse would be utterly laughed at if the roles were reversed.

This is the kind of thing where an investigation and trial is the right process, is it not?

Hack Stone

Vroom, vroom.

5JC

That might be the funniest thing I’ve read all week.

A Proud Infidel®️™️

What, no weekly Prostate checks?

Fyrfighter

Wouldn’t the special prosecutor being lawfully appointed per the Constitution be kinda important RE: the rule of law?? Since that IS the basis for the dismissal?
It wasn’t dismissed with prejudice, so if as you say, there is legitimate evidence of a crime, a legitimate prosecutor could refile charges, and move the case forward.
I could be wrong, but it seems like your posts above are suggesting that the ends justify the means, ie: If President Trump did something illegal, it’s ok that Garland ignores the law in appointing a prosecutor.

If that’s not accurate, please elaborate.

LC

My own understanding is second-hand, but from what I gather, numerous challenges to past Special Prosecutors have been made, none successful.

For example, the DC Circuit Court upheld Mueller’s appointment because it was done by a head of a department – the acting AG. In 2006, Scooter Libby’s challenge that Special Counsel Fitzgerald was not valid was also dismissed.

I know some well-respected legal minds have argued it’s invalid, but they seem to be in the vast minority. When experienced professionals on both sides say this is legal, I tend to believe them.

What part of it do you think is illegal, and is that a blanket ruling that should apply to all special counsels? If not, why this one?

5JC

Bullshit. Mueller was approved by the senate..

LC

Is that necessary? From what I’ve read so far of Canon’s ruling, it was about the finances.

And Morrison v Olson in ’88 (the ruling used in the Scooter Libby case) was a Supreme Court case, ruled 6-1, where the Special Counsel was considered an ‘inferior officer’, and thus not subject to Senate approval.

https://constitutioncenter.org/the-constitution/supreme-court-case-library/morrison-v-olson

5JC

Since we’re talking about two completely different laws than the answer is yes It does matter. The independent council Act expired in 1999, which The Libby case fell under.

We now have title 28 CFR, That covers all of this. You may have stayed in a Holiday inn Express last night but you don’t know what you’re talking about.

I suggest turning off MSNBC, CNN or whoever else is giving you legal advice.

Forest Bondurant

Read the actual legal opinion. The legal basis is explained plain and simple.

SFC D

The unlawfully appointed special prosecutor was not authorized to spend the money on the prosecution because he was an unlawfully appointed prosecutor. That’s where the money comes in.

rgr769

You might want to stop reading, since your reading comprehension and ability to analyze legal concepts is weak or nonexistent. Morrison was based on a statute that expired in 1999. You might know that had you bothered to read it and Judge Cannon’s decision, instead of reading propaganda and hearsay.

Fyrfighter

That’s just it, I’m no legal scholar, but the basis for her ruling is that the appointment was unconstitutional. Now if that should get overturned by SCOTUS, I’ll change my opinion on the subject. If I’m not mistaken (and I could be), those other cases never made it that far, so there wouldn’t be a true precedent prior to this case.

SFC D

Right or wrong, the President is the ultimate declassification authority. An investigation and trial would be the right process if the rule of law was actually followed. It goes straight out the window when its applied selectively. You cannot grant Hillary and Joe a pass while prosecuting Trump. No reasonable human being can see that’s right. Appointing a prosecutor in the manner Garland did trashes “rule of law” even further.

Last edited 1 month ago by SFC D
LC

So, hypothetically, if Trump wins in November, and there’s evidence that Joe Biden committed crimes, are you against an investigation and trial, since it wasn’t applied equally to Trump now?

This is the problem I have with the notion that it’s all-or-nothing. If we can’t charge one criminal because another escaped justice, that’s no justice, vs some justice.

I’d rather we go after people who do crimes, period. I have more faith in juries than politicians.

SFC D

I’m not against an investigation, indictment, and trial against anyone, provided the rule of law is followed and applied equally. It really should be all or nothing. Hillary got a pass because DOJ said “no reasonable prosecutor would pursue it”. Why not? We’ve jailed people for lesser security transgressions. Joe got a pass because he’s a senile old man. Those excuses now become a legitimate defense strategy.

“This is the problem I have with the notion that it’s all-or-nothing. If we can’t charge one criminal because another escaped justice, that’s no justice, vs some justice.’

‘I’d rather we go after people who do crimes, period. I have more faith in juries than politicians.”

That’s kind of a circular logic, self-cancelling loop, isn’t it?

LC

So if it has to be ‘all-or-nothing’… how do you start? Because inevitably, if you go after one criminal from one party, while another party is left untouched, you aren’t doing ‘all-or-nothing’.

And to clarify, I’m all for charging ‘all’ people for whom evidence suggests there were crimes. That’s what the courts are for. I’m not fine with it needing to all political sides before we do anything.

SFC D

“if you go after one criminal from one party, while another party is left untouched, you aren’t doing ‘all-or-nothing’.”

That’s kinda the point. We, or I should say “they”, are selectively prosecuting crimes based on political affiliation. It’s wrong, no matter which party does it.

HT3

Biden’s document case occurred when he was VP, so no Presidential immunity and a VP cannot declassify. That’s beating a dead horse in my opinion. The 10% for the Big Guy and selling influence is something I would pursue. Not just to get Biden, but because that practice IS RAMPANT in the DC Swamp. The destruction of evidence by the J6 Committee is MUCH more relevant.

Odie

Bring the charges, see were the evidence leads, let Joe, and others charged, hire their lawyers ( with their own money), and see if they can withstand to constant scrutiny 24/7.

HT3

Its Vance. Just announced. It doesn’t make much difference. Did he win in 2016 because of Pence?

LC

No, but I think Trump and Vance hit all the same folks – whereas Haley would’ve drawn people skeptical of Trump, but also firmly against Biden. Pence didn’t have that kind of draw, in my opinion.

5JC

What Trump is saying, is you might get me in a rush, but you’re still going to have me.

5JC

Vance is 42 years younger than Biden and nearly 40 years younger than Trump. Hell,.he is 20 years younger than Harris. If you think those guys have the same drawing power you haven’t been paying attention.

Skippy

In this election it will probably make a difference

SFC D

I don’t think anybody really knew much about Pence in 2016.

timactual

“That’s a shame for those of us who believe in the rule of law.”

That’s pretty funny. The rule of law said the Executive branch has to follow the law (Constitution) in giving someone the power of a special prosecutor.

Odie

JD Vance picked as VP running mate.

rgr769

Let me guess, you did not read the 93 page opinion. You know nothing about the law. You are as ignorant of it as your commie cuttlefish buddy. You might want to peruse the Appointments clause of the Constitution. And whether those other Special Counsel were already confirmed US Attorneys. For me, my top reason for supporting Trump is he didn’t get us into any new, endless war(s). I would think that would be a huge plus to those who served, peacetime or not, serving now, or have kids or grandkids serving now.

Does anybody remember when politicians threatened to shut down the government, got their wish and then planned on leaving the country while the government was shut down? Trump waited till they boarded the government owned plane and then grounded it? Come home,, fix the shut down, and then go on vacation. Lots of butt hurt there. Good times.
