Woman shot a man allegedly trying to force his way into her Hollywood Hills home

BY SALVADOR HERNANDEZ
A woman shot a man after he allegedly tried to force his way into her Hollywood Hills home Sunday night, claiming he’d been hurt and needed help, police said.

The man, in his 30s, was reportedly trying to push open the back door of a home in the 2800 block of Hollyridge Drive at about 9:30 p.m.

The woman, in her 50s, was trying to hold the door shut as the man claimed he was in fear of his life, said Los Angeles Police Department Officer Norma Eisenman.

“He told her that someone hurt him and to let him in,” Eisenman said.

45 Colt links to a TAH page..
Just sayin’.
I know it’s oh-dark-too-damn-early pre-caffeine.
Take yer time.
Thx.

Here ya go, Tox. Not sure if this was the linky that our Beloved AW1Ed had in mind, but a Foo of The Goggle had a semi same picture, so I snagged it. We must forgive our very own Kid Squid for his posting error, after all, his is an unpaid position (like everyone else @ HQ TAH and, as we all know, you get what you pay for), he also has a day gig, AND a trophy wife. Bless his heart.

I just love these FAFO stories…’specially when the score includes a DRT.

There may and/or may not be a copy of a .45 (Long) Colt SAA in 7.5″ Barrel earmarked for “Castle Doctrine Defense” for Firebase Magnolia. I admit nothing…call my lawer. Damn a leaky boat.

Such a handsome revolver. I could probably make do with a Ruger similarity. Maybe when I eventually get my Texas CCP. Paperwork and administration thwart so many happy ambitions.

Odds are pretty good though, I had a Massachusetts CCW when I moved back to America.

In fear for his life, he said.
Someone hurt him, he said.
Well, he got that part right, eventually.
I’m guessing he was looking for love in all the wrong places. And he found it. The wrong places, that is. Still no love, though.

Tima and again we hear stories of bad things happening when someone enters someone else’s home. Castle Doctrine exists for good reason. Most of us don’t want any uninvited guests inside our residence. Hell, even what’s left of our justice system has rules forbidding authorities from going into a house without a warrant or in extreme cases. In many cases, the intruder gets their comeuppance. In other cases, the role is reversed, as we saw with Amber Guyer a few years back. Sleep-deprived officer looking forward to a fling enters “her” apartment on the wrong floor, sees someone in it, and shoots. Now she’s a convicted murderer.

In the second story, yeah, it makes sense that someone who’s hurt is going to try to force his way into a stranger’s home. I can see being panicked and in fear for your life, but there are some things you just don’t do. Asking for help or for someone to call 911 is reasonable. If they let you inside, cool, that’s on them. Demanding to be let in is suspect as hell. Given that this occurred in L.A., I wouldn’t trust anyone. I’ve never been there, so my ideal of L.A. is what I’ve seen on Adam-12, Emergency!, and The Rockford Files. I don’t think those ’60s-’70s depictions of The City of Angels really represent the city circa 2023.

Keep a gun or five near, stay trained and proficient, and make no compromise for the safety of you or your family, especially inside your own home.

Much as I despise Alex B for his politics, I gotta ask, how many times is the court system going to go after him for this (yes, I’ll say it) homicide? (it wasn’t deliberate and premeditated, but it was careless, and not an “accident”).
Aren’t there rules and laws for NOT trying a person twice for the same crime? Or has that gone out the 10 story window in this day & age? Or am I missing something that allows retrial after retrial?

As it says in the story. The Charges were dismissed. This does not preclude him from being charged in the future. He was not found innocent of the charge.

The double jeopardy rule only applies where the defendant has already been tried once for the same crime. Baldwin has never been tried for the subject shooting. He could be convicted of a negligent homicide offense.

Ahhhh. Thx for making that clear as mud now.

Caselookup – Name Search (nmcourts.gov), type in Baldwin Alexander. For more, type in Gutierrez-Reed (the on-set armorer).

If he hasn’t been tried, he hasn’t been found Guilty or Not Guilty and is thus not protected by double jeopardy laws. Even if someone has been tried and found “Not Guilty” of a charge, they can be charged with an additional crime, or even at the federal level. We saw that with Derek Chauvin and others, who get multiple charges at the state and federal level for the same crime. Then we have to look at nolle prosequi (decline to prosecute), and dismissals without prejudice, where charges can be refiled, and a defendant indicted.

I think that a lot of confusion comes from the fact that there are multiple defendants, with Alec Baldwin being by far the most well-known. Every time anything Rust is brought up, the media will flock to their keyboards for the latest update on “Alec Baldwin’s criminal case”. BREAKING NEWS: Alec Baldwin will be going to court next week (he got a traffic ticket in LA and has to pay it). Make sure to subscribe for all of the Alec Baldwin legal updates!

Don’t know about other places, but in Indiana. If you try to force your way into someone’s home, the home owner can use deadly force to prevent ” unwanted entry.” They don’t even have to make it inside, just the attempt is enough under state law.

The moment I saw the Kokomo shooting, I thought that maybe the homeowner was in a crap game and screamed Little Joe from Kokomo when a pair of 2’s came up on each die when the perp came in.
