Judge holds his own at Stanford

Fifth Circuit Judge Kyle Duncan was invited by Stanford’s Federalist Society to speak Thursday. However, hundreds of protesters instead shouted him down, apparently with the blessings of the school administration.

Judge Kyle Duncan, who was appointed by former President Donald Trump, was invited to speak at Stanford University Thursday by the school’s Federalist Society chapter. However, he was heckled by hundreds of students, who made it impossible for him to deliver his speech.

“If enough of these kids get into the legal profession, the rule of law will descend into barbarism,” Duncan told the Washington Free Beacon.

Video footage widely shared on social media shows that the school’s associate dean of diversity, equity and inclusion (DEI), Tirien Steinbach, did nothing to quell the disruption as protesters hurled verbal abuse at the judge, which appeared to violate Stanford’s free speech policies.

Instead, Steinbach gave a minutes-long and emotional speech at the event, accusing Duncan of causing “harm” through his work on the U.S. Court of Appeals for the Fifth Circuit. The students were particularly angry at Duncan for a 2020 opinion in which he refused to use a transgender sex offender’s preferred pronouns. In comments to the Free Beacon, the judge described the incident as a “bizarre therapy session from hell.”

Steinbach repeatedly said she was “uncomfortable” by the anger caused by Duncan’s presence, though she sided with the students, telling Duncan while she “wholeheartedly” welcomed him because she believes in free speech, his speech was “abhorrent” and “harmful” and “literally denies the humanity of people.”

She went on to question whether the University’s stated commitment to free speech was worth “the pain that this causes and the division that this causes.”

Yeah, it is, whether you agree or not. That’s supposed to be what it’s about, isn’t it? The good Judge, however, held his own:

  “Don’t feel sorry for me,” he told the outlet. “I’m a life-tenured federal judge. What outrages me is that these kids are being treated like dogs**t by fellow students and administrators.”

And all because he didn’t use the right pronouns three years ago. Have to wonder what torments they would visit on him if he used some of OUR chosen pronouns… Witch? Masshole? Something similar.

Look, I’ve got no problem trying to use someone’s preferred pronouns. It’s a small thing that takes almost no effort and conveys some respect. But if you’re making the argument that ‘how dare the judge disrespect someone’ … by disrespecting a judge and screaming at him, well, dare I say that might be ‘abhorrent’, ‘harmful’, and ‘denying the humanity’ of someone?

It’s a court of law and he wanted to be addressed legally as a female. But:

We understand Varner’s motion as seeking, at a minimum, to require the district court and the government to refer to Varner with female instead of male pronouns.1 Varner cites no legal authority supporting this request. Instead, Varner’s motion simply states that “I am a woman” and argues that failure to refer to him with female pronouns “leads me to feel that I am being discriminated against based on my gender identity.” Varner’s reply brief elaborates that “referring to me simply as a male and with male pronouns based solely on my biological body makes me feel very uneasy and disrespected.”

AND

no authority supports the proposition that we may require litigants, judges, court personnel, or anyone else to refer to gender-dysphoric2 litigants with pronouns matching their subjective gender identity.

AND
courts that have followed this “convention,” have done so purely as a courtesy to parties.

So

We decline to enlist the federal judiciary in this quixotic undertaking.

Which is how it should be. We don’t need activist judges.

First time I ever saw that was when I was in grad school in late 1993. It was on a notice pinned to a bulletin board, and was from a female student who’s major was in Human Relations (more like “Liberal Activism Training”). The phrase that got me was; “…we have the right to not be offended!”
I mentioned this to my Bohemian/Hippy friends later, and ALL of them agreed with me when I said; “since WHEN?”
