April shooting death ruled justifiable homicide
By Tommie Lee
A shooting death at Donald and Webster Streets in South Bend in April has been ruled a justifiable homicide. The St. Joseph County Prosecutor’s Office says the death of David Austin was justified, as several witnesses said Austin approached the shooter, a 72 year-old man, in an aggressive manner and had punched the man.
State law dictates that self-defense has to be disproven, and it could not in this case. The shooter himself called 9-1-1 after the incident.

To prohibit a citizen from wearing or carrying a war arm . . . is an unwarranted restriction upon the constitutional right to keep and bear arms. If cowardly and dishonorable men sometimes shoot unarmed men with army pistols or guns, the evil must be prevented by the penitentiary and gallows, and not by a general deprivation of constitutional privilege. There may be several Taco Bells in South Bend. People get strange in those places.
The Taco Bell incident was not in South Bend, SB has better taquerias, just saying.
If anyone ever sees me in a Taco Bell, no matter the time of day or night, please shoot me.
Beware the old man just shuffling along. He was once more badass than you punks could ever hope to be…and probably still is.
Interesting article on the Tanfoglio 10mm. Was not familiar with that Breed. Wonder if you can actually still buy one for $450? AND find 10mm cartridges?
Rural King has offered some Tanfoglio models. I don’t think they have a presence in your AO but Florida is well supplied with stores.
Back in the 80’s the first automatic pistol I ever bought was a Tanfoglio TA-90 (sold under the name “Excam.”)
Decent gun, basically an Italian copy of the famous CZ-75, except with a slide mounted (hammer-drop) safety (the CZ had a frame mounted non-hammer dropping safety and could thus be used in either SA or DA mode.)
Italian cars and motorcycles can be problematic but if there’s one thing Italians know how to make it’s firearms.
“….if there’s one thing Italians know how to make it’s firearms.”
Hence Beretta being around for 500 years.
Beretta is the oldest exi9sting company since the 1500’s.
Zildjian, a cymbal company of world renown is the second oldest with their incorporation as a business concern was in 1623.
They are still the largest and best manufacturer of cymbals on Earth.
It’s all I’ve ever owned and I have owned lots of them over the few dozen trips I have made around our very own Star we call the Sun.
Even my Grandmother asked if I was buying Zildjian Cymbals when she bought me a set of drums while stationed at Ft Wainwright.
(She knew about them because I told her just how dedicated I was to them) !!!!!
Sure, $450… just like all the other 2011 prices that stayed the same.
IIRC reading an article about the early 10mm ammunition, Norma (only source available at the time) made the ammo using a powder that gave a quicker “burn”, which made for more recoil and “snap”, which accounts for the caliber not becoming popular at that time.
Only recently (define “recently”) has the ammunition been re-looked at for new/different powders for different shooting characteristics. Which is now leading to a resurgence of the 10mm ammunition. Hopefully the 10mm can make a comeback from its less-than-stellar beginnings.
Ummm…didn’t they already try that with the .40 S&W round, AKA “an answer to a question nobody asked?”
I think almost all the LE agencies who switched to .40 in the 1990’s with great fanfare have now quietly switched BACK to 9mm.
I never shot a 10mm but I found the .40 to have a very unpleasant recoil, even worse than a .45ACP. So I sold it and went back to 9mm which is easier to find ammo for.
Kimber…..
