Prosecutor: Homeowner not facing charges after shooting Middletown man attempting to rob him
By Lauren Pack

A Middletown man is dead, and his brother and another man are charged with murder following an alleged burglary attempt Wednesday night.

Middletown police were called at 12:02 a.m. Thursday to Atrium Medical Center on a report of a man suffering from a gunshot wound. The man, 25-year-old Joshua Oatneal, died at the hospital, Sgt. Earl Nelson said.

Police say three people — Joshua Oatneal, his brother Jonathon Oatneal Jr., 23, and Andrew Roberts, 22 — went to a residence in the 2600 block of Aspen Drive to commit a burglary.

During the burglary the homeowner shot Joshua Oatneal. The other two men took him to the hospital and left. They were spotted a short time later in the city, and both are charged with two counts of murder and two counts of aggravated burglary.

Upshur County grand jury declines to indict veteran in June shooting death

An Upshur County grand jury has declined to indict a veteran in a June 18 incident that left a man dead, determining the shooting was self defense.

Matthew Gregory Harris, 36, had been charged with murder in the death of Michael Clint Moses, 45, in western Upshur County.

“While any death is a tragedy, the absolute right of self-defense including deadly force was justified in this case,” Upshur County District Attorney Billy Byrd said in a written statement.

According to Byrd, deputies responded June 18 to a 911 call from Harris.

“He told 911 operators he shot (Moses) and would be in route to his home and be waiting on deputies to arrive,” Byrd said. “This phone call clearly demonstrated how distraught Matthew was.”

“As civil rulers, not having their duty to the people before them, may attempt to tyrannize, and as the military forces which must be occasionally raised to defend our country, might pervert their power to the injury of their fellow citizens, the people are confirmed by the article in their right to keep and bear their private arms.” — Tench Coxe

Flyboy,
Too much blood in your caffeine stream this morning?
That first story stat should read “1/2/0”. Swap that zero from the front end to the back end.
Other then that, good reporting. It’s nice to read that the law enforcement and Grand Jury have their heads and priorities screwed on straight, no charges against those defending themselves.
And that picture of “Miss Thang” against a wall of rifles, makes up for a multitude of sins and puts you in the plus column.
I don’t know which I’d like to handle first. One of those rifles, or Miss Thang? Best be a rifle. If my wife were to catch me even THINKING about a “close encounter” with Miss Thang, well, you wouldn’t be hearing from me for awhile (hospital), or possibly never (cemetery). I guess I’ll have to leave Miss Thang to Gun Bunny.

Aww, c’mon Tox, where’s your spirit of adventure? No need to worry about what the Mrs. would do to you, a close encounter with that Miss Thang would either kill you or hurt you real bad BEFORE your wife could. Miss Thang seems to have about as much plastic in her as that Ruger does. Only reason I’d hit it is to save IDC SARC from hurting himself on it.

‘Ed’s tiny typo is nothing compared to the no writing, no counting, no proofreading of the article writer. Maybe I missed something, somewhere, but I’m still trying to find the 2 murders and 2 robberies. And where in the Sam Hill Quaker Oats does a name like Oatneal come from?

“While any death is a tragedy….” Moose Muffins!!! Some SOBs just deserve to die, some more slowly and painfully than others. Others NEED to die, slowly and painfully.

Now that’s a girl-shaped girl. I want to puke when I see women with negative body mass indexes (indices?) characterized nowadays as “hot”. Maybe the meaning of the word has changed.

5.7…a .22 on steroids. May have been lethal at Ft. Hood, but I tend to trust the old “which is gonna stop someone better, a supersonic phonograph needle or a thrown medicine ball?” side of things.

The Ruger 5.7 is 1/2 the price of the FN 5.7 and same capacity – 20 in the mag and 1 in the chamber.👀

I just changed my Christmas wish list to Santa.
