A couple of brief things. Kudos to MSNBC for linking to us. With the exception of the guy who is getting the credit for starting this (Rickey) no one else has really linked to us. I thanked Rickey last night, because none of this was his fault. But for some reason the AP gave him credit for breaking a story that he very carefully stated in his post that he got from us. Well, today we get more interesting news, that sort of ties in there. People are starting to go a bit weak in the knees. Well, I say onto you, “Buck up campers!” The day this broke I became a lawyer, which means I am smart enough to know 2 things: 1) if this shit went south, everyone not crediting us with breaking the story would point fingers at us and say “that guy did it.” And then I would get to meet the fine folks at the bar association again, and while they were quite congenial, I don’t think my first week should be marked with ethics problems. 2) I have WAY WAY WAY more info than apparently anyone else does on this story. Seriously, I have proof coming out my 4th point of contact. Don’t confuse my not publishing it with not having it. Some of it is like ill-begotten mob earnings, I have to launder it so that others don’t get outted.

Notice in particular his MOSs. Anyone else see Infantry in there? No? How many people caught the Bronze Star? No? Well, what about the Purple Heart? Wait, you didn’t see that either? Jeesh people, look harder.
That document alone proves that his email to Defenders of Freedom is a lie. Need I remind you about the Stolen Valor Act?
Whoever falsely represents himself or herself, verbally or in writing, to have been awarded any decoration or medal authorized by Congress for the armed forces of the United States, or any of the service medals or badges awarded to the members of such forces, or the ribbon, button, or rosette of any such badge, decoration or medal, or any colorable imitation thereof shall be fined under this title or imprisoned not more than six months, or both.
Nonetheless, moving on…..How about that medical document that proves he was hit with an RPG….
Yeah, see, that thing says no such thing. What it states if you can’t make it out, is that he is being seperated on a disability that results from combat or an instrumentality of war. That part right there occurs on EVERY SINGLE Physical Evaluation Board (PEB) or Medical Evaluation Board (MEB) that is determined to have been the result of a service related injury. Taking the story that others have been telling that he injured his back from falling off a vehicle, that is entirely consistent with what the PEB/MEB would show.
IN OTHER WORDS, the language used there is what we call boilerplate. It’s like the things you find on lawyer type documents, usually in small print. It is the military’s way of saying, “yeah, the injury, illness etc occured on our watch.” It does NOT mean that he was injured in combat, ergo the “Instrumentality of War.”
Not to beat that portion into the sand, but see for example the legal definition of “instrumentality of war” for purposes of CRSC (combat related special compensation):
INSTRUMENTALITY OF WAR (IN) – Incurrence during an actual period of war is not required. However, there must be a direct causal relationship between the instrumentality of war and the disability. The disability must be incurred incident to a hazard or risk of the service. An instrumentality of war is a vehicle, vessel, or device designed primarily for Military Service and intended for use in such Service at the time of the occurrence or injury. It may also include such instrumentalities not designed primarily for Military Service if use of, or occurrence involving, such instrumentality subjects the individual to a hazard peculiar to Military Service. Such use or occurrence differs from the use or occurrence under similar circumstances in civilian pursuits. A determination that a disability is the result of an instrumentality of war may be made if the disability was incurred in any period of service as a result of such diverse causes as wounds caused by a military weapon, accidents involving a military combat vehicle, injury or sickness caused by fumes, gases, or explosion of military ordnance, vehicles, or material. For example, if a member is on a field exercise and is engaged in sporting activity and falls and strikes an armored vehicle, the injury will not be considered to result from the instrumentality of war (armored vehicle) because it was the sporting activity that was the cause of the injury, not the vehicle. On the other hand, if the individual was engaged in the same sporting activity and the armored vehicle struck the member, the injury would be considered the result of an instrumentality of war.
So what does this mean? Essentially he snowballed this TV program. If they want, I can give them the name of a PEB/MEB specialist right there at Brooke Army Medical Center that can look at these files and explain what they mean.
OK, so some of you are likely asking how much information I truly have. Um. Boatloads. How bad was his injury? Was it so bad dude could barely move and such? Well, it was bad, no doubt about it, but see…..I have a counseling report from 12/28/2010 wherein Poe states
He would like to go through a 20 month training in FL to become a flight instructor and is currently looking into this option.
That didn’t work out well for him…
He is eligible to submit a packet although his unit wants to send up a 4187 to recommend it be denied.

Its the fact that the currently available documentation doesn’t support his “story” so much that it stinks. He should be proud of what he did accomplish and any embelishment or false claim only cheapens the sacrafices of others.
If after all is said and done, Tim’s story proves to be true, then I’m pretty sure TSO would probabaly be first in line to say sorry guy but your stuff was so jacked up we couldn’t tell the good guys from the bad. On the other hand based on the available record this guy’s story isn’t passing the smell test. While I’m not Army even I know that you can’t get a CIB unless you have an Infantry MOS. Also having seen examples of an RPG hit, the fact that Tim’s up walking around with all body parts attached and in the right locations is beyond amazing, its down right miracle level. Not saying it can’t happen just the odds aren’t in favor.

@90 Any TIC anywhere gets briefed daily by HQDA, the PP slides are in the system. I’m currently out of the SIPR loop but I’m sure individuals with access are watching. With people starting to point fingers at big Army for dropping the ball I suspect this is going to escalate from the MN guard to HQDA.
Wow,really. TSO has every right to question anyone’s service just as I do or anyone else for that matter. I do not question TSOs character unlike Tim Poe. I also have more of a right to question Tim as I served with him on the deployment in question. If it wasn’t for hose monkeys like Tim Poe, we wouldn’t have to question or doubt other veterans but our trust is stolen.
I have worked for the DoD for almost 30 years now (12 more days for that!!). I have typed board results and those are so canned, that we had them as a separate document and could just cut and paste because they were in EVERY ONE. You have done an excellent job.

Average NCO makes a very good point-the “S” in a “SOAP” note stands for “subjective” and is what the patient tells you. That’s usually a good place to start figuring out what is the matter, but it is not definitive.
If Poe can bring us the medical record generated in theater at the first treatment facility where he was treated or sworn statements from those who were with him when the supposed incident occurred, that would be one thing, but anything else looks to be part of his con at this point, given the lies he has told that we already know about.
Average NCOs comment deserves about 20 readings. He is exactly right.
@85: Doug, my father-in-law received his PH from Korea in 1999. Due to their unit being on the run from a Chinese offensive, his original paperwork wasn’t processed, however, about 20 guys from his unit, including a retired O-8, sent in paperwork and a chunk of the actual shrapnel from the original attack the warranted his receiving the award. So, it does happen. That said; I have, as others have noted, not seen anyone from Poe’s unit come to bat for him and in fact have come forward to do the exact opposite.
Good on your father Trooper. Yes, it does happen. USUALLY however (though it may not have been so in your father’s case) there is some paperwork somewhere to verify the wound that later results in a late PH. This is exactly why I keep pushing DoD for a complete database.

How come the DD214 (what you can see of it) looks different than all of mine?
In mine, block 15A asks if I contributed to a post Vietnam ere educational program. Poe’s has 15A asking if he was commissioned at a service academy or ROTC.
Also, unless the MOS’s listed in the top block are concurrent, he would have over 20 years of service (2+10+8).
Dave…many MOS’s or NEC’s are concurrent. I held as many as four at one point.
The other thing that gets me about this is that his squad leader is saying its false. Now one thing he should know as he was an NCO is about accountability. Which means if he volunteers for some super soldier mission his squad leader would probably know where he was going. Even if it was a last minute oh shit thing I’m sure he would have at least sent a runner or stopped in at his company TOC so that way they could have accountability of soldiers going outside the wire. And then to say that his unit wasn’t informed of his injuries is also ridiculous. At the very least his CO and 1sg would be informed and I am sure they would understand the need to disseminate that information to his PL and PSG, who would probably tell his squad leader so he would wonder why he was missing a sergeant all of a sudden. Poe acknowledges that one of his main detractors was indeed his squad leader but yet expects those of us who have served to believe his squad leader was completely incompetent and allowed his soldiers to run all over a-stan with no idea where they are and when they get medevaced out of theater to not be able to differentiate between an ear infection and massive trauma from catching an rpg with his asshole.

Additionally, as a Nurse Corps officer, I can tell you that a direct hit with an RPG would result in devastating injuries. They are almost always either fatal, or damn near. When I was at WRAMC ( Back when it was an ARMY hospital!!) the RPG injuries I saw tended to result in traumatic amputations, with multiple secondary injury sites from shrapnel, and most of them also aquired rip roaring acinetobacter infections to boot. Strictly from a medical perspective, his claims look fishy.

Well I’m no doctor and I am just going to speculate…but my guess is that his asshole was so stretched out from letting all his buddies at dicks leather palace run a train on him before he left the states that it sucked the rpg up like a black hole…however the aforementioned train had weakened his spine so much that when jumping on top of another man….a position that he was not used to…it simply snapped…..or he could just be a lying d-bag…either one of those stories makes sense…lol

Your story isn’t true or worth while unless it ends in this one crucial statement, “…and then I shit myself. ” This true tidbit of knowledge was passed down from a good friend of mine, who is a Ret. MSGT. After recalling my own stories and listening to all my friends, and Veterans who I represent, the statement holds true. I really don’t recall Timmy boy saying this at all.

About his PH. I got mine from General Campbell of the 101st lying in my hospital bed in BAF. A dude gets hit with an RPG, one of the forst things the Red Bull units do is write up a PH award. When we were in Trashcanistan in ’10-’11 every person that got wounded got a PH somewhere in transition to Germany, except if they were in a coma. I can’t imagine this guys unit not writing up a PH award after getting hit with an RPG.

My husband is in the National Guard (and will be retiring in a few months after 20 years). And unlike this piece of shit, Timothy Poe, my husband actually has a CIB (’03), Purple Heart (’05) and countless other awards. He served in Desert Storm, Iraq (twice) and Afghanistan. I have to watch as my husband struggles with the result of his injuries and his PTSD. … And you had better believe he’s got EVERY DAMNED PIECE of documentation for his awards, service and injuries. So for Poe to say he doesn’t have it? I call BUUUULLLLSHEET.
For my husband, these are REAL injuries. Not imagined ones. He is sometimes too proud to ask for help and is an honest and amazing man. Doesn’t brag and hardly speaks of his experiences. And his injuries don’t just affect him but impacts our whole family.
…And then there’s Timothy Poe, a piece of shit who can only think of himself and what he can get out of people by lying.
Now he says he’s sorry for it all and then makes up more lies in the end to justify it? What a piece of shit. He’s a conman and has stolen help and services from those veterans and their families who are truly in need as well as taken advantage of the good nature bestowed by wonderful people willing to help and support our vets. He’s only sorry he got caught. That’s the simple truth.
He has essentially spit on the service and sacrifice that other veterans and their families have made…. all so he can gain 15 minutes of fame.
There isn’t a hot enough place in hell for Poe. I hope Satan puts his foot so far up Poe’s ass it gives him a real stutter in the afterlife.
I still want to know why a guy would do something like this on national TV when you have to know you are going to get caught. There is no way he could claim a CIB and not think someone was going to check up on that. Tragic and just weird.
