These laws are there for a reason. This is like stalking, domestic violence, and the other behaviors that indicate obsessive tendencies or poor impulse control.
Most of the time these threats are nothing. In a significant number of cases, however, they are followed by action. In some of the deaths I’ve investigated, the action doesn’t even have to be overt attempts at homicide, but instead actions taken simply to harm that go awry.
Take if from someone who investigates the bad outcomes from this kind of thing. Call the cops. Bring charges. Don’t wait for it to escalate into activities that cause serious physical, emotional, or financial harm.

There is no such thing as the Georgia State Police in these parts, and the Georgia State Patrol would have minimal, if any, interest in this. The county sheriffs do tend to pay attention to such matters, but if he is in Lawrenceville, that is Gwinnett County, which is infested with a serious and growing problem with some of the more active and violent hispanic gangs. I doubt they will pay much attention, either.

I just had a long conversation with one of the other parties involved.
Here is the basic story. This guy has been rocking the lie for a long time. He lied to family and stole from them when they were trying to help him.
His ex girlfriend caught on to his lies and dumped him. He has tried to convince everyone that all of this was made up to hurt him.
No one believes him so tonight he lost his shit and started threatening everyone he could think of.
His family has confirmed that he got set back in basic then let go for failure to conform. That works out to the time frame of 21 Days just about right.
No one knows where he is. He has been kicked out of every place he has lived and all anyone really thinks is the truth is that he works for a trucking company.

The hitch is that under Georgia law wherever the threat is received is where the crime occurred. I. E. West Virginia. It is very difficult in the cell phone age to determine the exact location where a call originated from. It’s lots easier to determine where it was received.
Either way, I think people around here should be aware of this wing nut. It’ll be next week, but I will look into it.
Actually, Planet Ord: if you have the time of the call and the originating number, the cell company involved can tell LE what cell tower was used to originate a call. Unless that tower serves multiple states, determining the state in which the call originated then becomes quite easy.
Determining the county of origin may or may not be possible, depending on whether the tower’s coverage area includes multiple counties. But for violations of state law that shouldn’t be much of a consideration.
Hey Hondo, I’ve done my fair share of cell call origination investigations. The information the cell companies give on a cell site request usually goes something like this: ‘The call originated within 1200 feet from tower X.’ Then they will provide locations for the tower in another document. I’ve had cell site requests get as close as 500 feet, but that’s rare. 1000 feet is a good average. Drawing a circle that big around a tower can yield many residences and apartment complexes. It will also usually include several jurisdictions. Every now and then it will ping off of two or three towers and you can use the areas where the circle overlap to narrow things down, but that doesn’t happen often. You can only get that information with a duces tecum, subpoena, or court order. It’s all moot really, as the crime occurred in West Virginia. No ADA will sign off on any document in Georgia, because no crime occurred within their jurisdiction. Without that document, the cell companies will tell you to piss up a rope. This guy seems like he’s just a blowhard. He’s probably more entertaining than he is dangerous. Jonn’s got him pegged. His rhetoric is disturbing and is a felony, though. It’s worth a cursory look out of an abundance of caution IMO. BTW, I’ve had exactly one success story resulting from cell site data. One. That was a long shot that panned out, amazingly. Most of the time it is a waste of time. BTW, determining the county of origin is easy. That’s not to say that determining jurisdiction is simple. violations of state law are handled by local jurisdictions, not any state agency. The only time the GBI would get involved is if the local jurisdiction asks them for assistance. In many of the metro Atlanta counties the county PD can only work in unincorporated areas of the county. The cities are policed by their own city police forces. Yeah, there is the fact that GA law is rather . . . odd when it comes to who investigates and prosecutes violations of state law. But I’ve seen other states that were similar with respect to forcing counties/cities to prosecute state crimes vice having an effective state LE force.
The fact that GA law deems crimes to have occurred at other than their actual location is IMO more troubling. This appears analogous to saying that if someone stood on one side of a county line, they could escape prosecution for a shot killed someone across the street 25′ away – but in another county – if that other county refused to prosecute (or was not interested in doing so) irrespective of the fact that state law against murder had been violated. That’s the kind of legal technicality that gives the legal system a bad name.
In this particular case (telephone harassment originating in Georgia), what this implies to me is that GA is willing to ignore felony crimes of this nature that originate in-state using a cell phone but which cross state lines. (It also implies that GA could become at least a partial safe haven for those perpetrating such unlawful harassment.) Sounds to me like GA is simply more interested in palming off the trouble of enforcement in such cases to others (e.g., other states, Federal authorities) than in actually enforcing the law.
IMO that GA law needs to be changed to allow the crime to be prosecuted in either jurisdiction of call origin OR jurisdiction of call receipt. A second legal change allowing violations of state law to be prosecuted by the state authorities independently of local authorities in cases such as this (e.g., crimes committed in a mobile environment for which the general location can be determined to be within the state, but for which precise location cannot be determined) is IMO also needed. YMMV.

If you’ve never read it, find the book “Murder in Coweta County” and see how a man almost got away with murder, and was only prosecuted because the crime took place in a county other than the one he lived in. (It helped that there was a corrupt sheriff in his home county and a very non-corrupt one in the other.)

“Law” and “justice” are NOT synonyms. They should be – but because laws are written (and enforced) by fallible humans, they most decidedly are not.

It is also irrelevant to the matter at hand. The matter at hand involves crossing state lines through electronic media. In this case the ‘victim’ lives in West Virginia and the perp in Georgia. I’ve given it some thought and truly believe it’s a federal crime. Good luck getting that investigated.
It is an interesting argument, though. Knowing the prosecutors in Cobb like I do, I imagine they would consider prosecuting it. The state law is designed only for issues within the state. It is designed to establish local jurisdiction. It really makes sense when a guy calls a few block over and does that crap, but a few blocks over is another jurisdiction. The location of the victim determines the location of the crime.
I’m not aware of any state that doesn’t allow local jurisdictions to enforce state law. It’s not as screwed up an idea as you think it is. Many, if not all, states have state agencies with clearly defined missions. Georgia does too. But the locals always enforce the bulk of state laws.
I can also assure you that Georgia isn’t willing to ignore serious crimes. I’ve put people in prison for phone calls like that.
The question is if anyone has officially called the local jurisdiction to report the crime? As soon as you can answer which jurisdiction should be called you can see why the law is written that way. Much easier to do it where the call was received.
