AG’s office reports man acted in self-defense in Hampton accidental death

HAMPTON, N.H. — A man acted in self-defense and won’t face charges in the accidental death of a man who attacked him, the New Hampshire attorney general’s office said in a report released Thursday.

An autopsy showed that Astacio’s blood-alcohol level was .183, more than twice the legal limit of .08 in New Hampshire. The report said he attacked Gregory O’Brien, who had entered the apartment with his ex-wife looking for Astacio’s girlfriend. They didn’t know Astacio was there.

The attorney general’s office said it was possible that Astacio, who had met O’Brien before, may have thought he was an intruder, given his high level of intoxication.

The two men wrestled and O’Brien used his hands to hit O’Brien a few times and used a headlock and held him down, the report said. It said Astacio’s death was an accident.

‘This order means that John DeRossett is innocent,’ attorney says

VIERA, Fla. – Citing the Stand Your Ground law, the Fifth District Court of Appeals dismissed the longstanding charges against a Port St. John man accused of shooting a Brevard County Sheriff’s deputy during a botched arrest in front of his home in 2015.

The decision, issued Wednesday, ends the prosecution of John DeRossett, 60, on the attempted premeditated first-degree murder of a law enforcement officer while discharging a firearm, News 6 partner Florida Today reported.

DeRossett spent nearly five years at the Brevard County Jail Complex in Sharpes as he awaited a trial. He was allowed to leave on bond in March.

“The appellate decision is better than a jury acquittal. An acquittal only means not guilty. This order means that John is innocent, that his actions were justified, and that he never should have been arrested in the first place. It’s a total vindication,” said Michael Panella, DeRossett’s Orlando-based attorney.

How close is Brevard County to Broward County? Seems as though Teh Stoopid is leaking from Broward into Brevard. Or is it the other way around? And people wonder why there are so many Florida Man and Florida Woman jokes.

Browning DID the original design of the HiPower but died before it was completed. The end product was completed by Dieudonne Saive at FN.

Despite the “a .45 will rip someone’s arm off while the 9 will just make them mad” school of thought, Evan Marshall’s real world data says a .45 hardball and 9mm hardball have similar first round stop capability and eventual stop capability (average rounds before the opposer stops resisting). Greg Ellifritz did further study, and of the 600 some cases of .45 and 9mm cited, first round stops of the .45 came in at 44% versus 39% for the 9, and average rounds to incapacitation of between 2 and 3 rounds each. Balance 14 rounds for one and 8 rounds for the other, and you can see why Browning went with the 9. After all, this is the man who invented the .380!
