Ashli Babbitt’s estate reportedly to receive nearly $5M settlement from DOJ

The Department of Justice (DOJ) and Ashli Babbitt’s estate have reportedly agreed, in principle, to a settlement. Babbit’s estate initially filed a $30 million federal lawsuit in response to the former’s being shot and killed by a Capitol police officer. The officer who shot Babbit was cleared of wrongdoing on the account that he “acted in self-defense” as well as “in defense of Congress”. The final settlement is not official yet as details are still being addressed and finalized.

Settlement terms haven’t been disclosed in public court filings. On May 2, lawyers for Babbitt’s estate and the Justice Department told a federal judge that they had reached a settlement in principle but were still working out the details before a final agreement could be signed.

Justice Department spokespeople and two attorneys for the Babbitt family didn’t immediately respond to messages seeking comment.

Babbitt, a 35-year-old Air Force veteran from San Diego, was unarmed when she was shot by the officer. The lawsuit alleges that the plainclothes officer failed to de-escalate the situation and did not give her any warnings or commands before opening fire.

The suit also accused the Capitol Police of negligence, claiming the department should have known that the officer was “prone to behave in a dangerous or otherwise incompetent manner.”

“Ashli posed no threat to the safety of anyone,” the lawsuit said.

The officer said in a televised interview that he fired as a “last resort.” He said he didn’t know if the person jumping through the window was armed when he pulled the trigger.

So strange that the left did a 180 on shooting unarmed people not posing any danger to anyone. And then being a-ok with the agency investigation of one of its own, of a senior leader involved in the shooting and then completely clearing itself. There were like zero protests about it too.

No. They would be precluded by the settlement docs from any further litigation. There was no judgment. It is a settlement which will result in a dismissal with prejudice of the lawsuit.

Tanks. I did litigation for almost 38 years. Although, I only handled about 15 cases in federal court. Technically, in federal court that proggy judge will have to approve the dismissal and sign a judgment of dismissal with prejudice. I am wondering whether that judge will go Emmett Sullivan on the settlement and appoint one of her retired pals to take over the defense from the DOJ, block the settlement, and demand a trial. I didn’t think it was possible for any judge to do that, but then Sullivan did it on Gen. Flynn’s criminal case.
