The Real Issue

That’s the harsh lesson 84-year-old Stephen Nichols learned last month when he was overheard criticizing one of Saloio’s employees for leaving his post as a school resource officer to drink coffee at a local convenience store during work hours. Nichols would later explain he couldn’t imagine someone whose job it was to guard kids leaving them defenseless.

Nichols knows a thing or two about fidelity to duty. According to an article in MV Times, he served in the U.S. Army as a Morse Code Specialist during the Korean War era and as a police officer in Tisbury for decades. After his wife died a couple of years ago, Nichols took a job in Tisbury as a crossing guard to stay involved in the community and because, he said, “I love the kids.”

Not only was this an illegal search and seizure with no due process included, it is similar to the attempt by the mayor of Deerfield, IL, last year to confiscate legally-owned guns from homeowners, using the same methods.  She lost her battle because her attempt at seizure was blocked in court. https://reason.com/2018/06/13/deerfield-illinois-gun-confiscation-law/

The court ruled that since Illinois does not prohibit the ownership of “assault weapons,” no local government may do so.

These attempts to thwart the 2nd Amendment rights of US citizens have resulted in such things as the sanctuary counties in Illinois and other states, a movement which is growing.

It is extremely disturbing that these things are happening, that you can’t even make an offhand remark without someone reporting you as a threat when you are not, or that people who get elected to office decide that they can become petty dictators. Someone should inform these control freaks that if they are afraid someone might shoot them, they truly are  not worth the cost of the ammo to do it.

From the article:  Several police and other local law-enforcement organizations have said they would ignore a presidential order from Democratic presidential candidate Beto O’Rourke to send them into private homes to confiscate firearms.

Back in September, O’Rourke responded, “Hell, yes,” to a question at a Democratic Party presidential debate about whether he would, as president, take guns away from Americans, including those who have committed no crime.

Then, last week, O’Rourke told MSNBC that he would order “law enforcement to recover” guns from those who defy his buy-back plan. This promise — that he would be dispatching police officers and sheriffs to confiscate firearms — did not sit well with many of those representing the officers who would be expected to carry out such an order. – article

Do pay attention to these idiots. They are everywhere. What they want to do does not address the real problem, which is violence by one person toward other people. They all need to be taken to task over this and their need to control everything, but they won’t do what does need to be done: address the violence.

      So he violated Nichols’ right to due process, which includes “the right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation….”

      Now that makes Saloio liable and yes, I can see this becoming something for the Supremes to pontificate upon.

      Serioiusly, if you’re going to have a test case for that, this should be it. Saloio IS liable for what he did, especially for not returning Nichols’ license and property to him. So Nichols has grounds for litigation, and I hope that he pursues it all the way to the top, because he should.

      The mayor of Deerfield, IL, nearly put herself in that same position, but was slapped down by the state for what she tried to do. Does not mean she can’t be sued.

        While clearly unConstitutional, note that the real problem lies with the waitress who started this whole mess. She overheard Nichols’ conversation on his coworker leaving his post and potentially endangering the school “someone could come and shoot the school up” and reported NICHOLS as the potential suspect. Everythin after that is on the chief, but wrongly or not, he proceeded based on HER allegations. Any lawsuits should include her in a starring role.

          Or that maybe since he served on the police force for many years that he and the chief have a history?

          I’m not trying to make light of this occurrence, but it may well serve as an example of how petty tiffs can get your constitutional rights taken away in leftist governed communities.

    As a PDRofMA resident with a concealed carry license I’ll point out that MA is a “may issue” state and the local chief of police is the sole firearms license issuing authority. I live in a town of 7,500 with a full time “force” consisting of a chief of police and four full-time patrol officers along with a handful of part-timers. Paying for these “first responders” partly contributes to my high property taxes. Our officers start at a higher annual salary than those in a nearby city of 44,000.

    I decided last year to “vote with my feet” and will be hitting I-95 to parts still unknown in 2020. Don’t care if the grass isn’t greener somewhere else, as long as the sky is blue I’ll be happy. The only reason I haven’t already left is my wife was born and raised in the PDR and is resistant to leaving. I’m trying to bring her into the light of freedom. Amen.

If I had of been in Mr. Nichols place I would have felt and stated the same thing. The officer that left his duty station, was there any punishment for his action?

    Retired officers have every right to talk about
    Politics publicly. They more than earned that right.

    There are some specific limits to what they can say under the UCMJ but not all retired officers are subject to the UCMJ.

    Besides, given the deep threat this administration presents to US interests I think people have a duty to speak out.

    I don’t remember seeing PoeTrooper whining about officers talking politics when Obama was president.

    When all the fact come our most of you who supported him will feel a lot of shame for having done so.

    Some of you will just lie to yourselves and others to give a framework of excuses as to why nothing that comes out about Trump is “real”.

    And some of you have no shame.

    But most Trump supporters will be embarrassed.

    There is literally no good news coming for Trump or his cult. It will be years, and decades of bad revelations. And as things become public the depth of this national disgrace will be written into our history.
