Man Pleads Not Guilty for Assaulting A 13-Year-Old Boy

A rodeo was about to get underway on August 3, 2019, at Superior, Montana. The event started with the playing of the national anthem. But things didn’t go smoothly. A 13-year-old boy was on the ground, bleeding from the ear area and sporting a fractured skull. He had to be airlifted to Spokane, Washington, where he received treatment at a children’s hospital.
Curt James Brockway claimed that he asked the boy to remove his hat out of respect for the national anthem. The boy cursed at him. This resulted in Curt Brockway’s grabbing the kid by the throat, lifting him up, and then throwing him down to the ground.
A police report filed in the aftermath of the incident listed this account. Interviews with other witnesses substantiated most of this account. However, one woman stated that she did not hear Brockway ask for the hat to be removed.
The boy’s mother said that the man just came up behind her son and attacked him. There was no verbal exchange before that. He simply targeted her son. She wasn’t at the scene when this happened, so this is presumably her son’s account.

According to the affidavit, witnesses confirmed most of Brockway’s description of events, but one woman said she did not hear him ask the boy to take off his hat.
The child had blood coming from his ears, a concussion and a fractured skull, the affidavit said.
He was airlifted to Sacred Heart Children’s Hospital in Spokane, Washington, according to the document.
The child’s mother, Megan Keeler, told CNN affiliate KPAX that she received a phone call shortly after dropping off her son at the fairgrounds to tell her that he was being taken to a local hospital.
“Dude come up and grabbed him by his neck, picked him up and threw him to the ground head first,” Keeler told KPAX.
“There was no exchange — nothing! He targeted (her son) and took him down,” she added.
Brockway’s lawyer is trying to pull some cards in defense of his client. One, the claim that his client believes that President Trump “told him to” or “implied” for him to do this. If you listen to the speech that President Trump makes regarding things like this, he does not call for violence. Just repercussions based on what legally could be done.
The other card is the “disabled veteran with no life” card. His lawyer suggests that this is going to result in his client’s listening to someone that he identifies with. Thus, the “blame Trump’s rhetoric” card.
His lawyer points out that Brockway received a traumatic brain injury as a result of a car accident that he was involved with. He used this to suggest that a TBI related symptom makes him susceptible to impulse-driven actions.
Brockway has a previous arrest, charge, and conviction in his past. This involved using a gun against three people. He can no longer own one. He apparently was on probation for that event. The judge reinstated the supervisory element of that probation.

I saw this article, they weren’t very kind to Mr. Brockaway’s past convictions for being a shit bag perviously for threatening to murder people while brandishing a firearm.
Perhaps Mr. Brockaway should not be allowed to roam freely amongst the citizens of this great nation as he seems unable to express his displeasure with the actions of others without resorting to threats of murder or beating children almost to death.
Here’s hoping he finds a comfortable cell to spend the next 20-30 years in and when he does get out he’s so old as to be a very minor threat in the distant future.

Defense lawyers are often highly paid professional liars and BS mongers. Their job is to get their client off.

I have heard it is unethical and a violation of state bar disciplinary rules if a criminal defense lawers don’t try to get their clients off. Of course, telling a bunch of bald faced lies about their client’s motivation for committing the indefensible crime does seem a tad unethical. I’ll admit that I’m not terribly knowledgeable about the total catalog of behavioral effects from TBIs. But I do have a firefighter who suffered one (via helicopter crash in the Navy), and he is not violent. He occasionally needs extra training due to having trouble picking up certain skills and concepts, which is not exactly unusual among the general (uninjured) population, and that’s about it. He’s a good kid. Based on that, I’m thinking the “violent TBI” thing is about as credible as the “violent vet” myth: complete bullshit.
That being said, his lawyer is doing his job. It’s offensive bullshit, but he’s throwing out anything he can to defend his client. There’s a reason why most people couldn’t stomach being a criminal defense attorney.
TOW, I believe it’s related to what part of the brain was injured, impulse control CAN be a symptom / result of a TBI, but that being said, if this guy has that much trouble controlling his behavior, he should NOT be walking among regular folks, and needs a long vacation, preferably in a padded room where he can’t be a danger to himself or others.
I would imagine that things like this example of shitty behavior would also be triggered by excessive consumption of beverage alcohol and other illicit pharmaceutical concoctions, professionally assembled or otherwise…

I’m not a violent type, heck, in school I only got into a couple tussles, one was standing up to a bully and no punches needed throwing and the other was punching an asshole that kept throwing mortar at me in bricklaying class.
