York City Police chief: Fatal shooting could be a case of self-defense

A York City man fatally shot Wednesday inside a west-end York City home allegedly assaulted a woman who lives there — and was released from county prison less than a week ago after posting bail on those charges.Christian Ivan Gutierrez-Rosado, of the 900 block of West Locust Street, was killed about 9 a.m. Wednesday, April 10, inside 702 W. Princess St., according to the York County Coroner’s Office, which has ruled the death a homicide.
York City Police Chief Troy Bankert told The York Dispatch the afternoon of Thursday, April 11, that the investigation is still active and that nothing has been determined for sure.
“At this point the York City Police Department and the York County District Attorney’s Office are evaluating the shooting incident as a possible self-defense (case),” Bankert said.
The shooter has been released, and no charges have been filed against him so far, according to the chief.

Explained: Stand Your Ground vs. Castle Doctrine

SIOUX CITY, Iowa — There are different self-defense laws across the country and generally, they fall into one of two categories.This first is Stand Your Ground which means “an individual who believes there is reasonable risk to themselves may use reasonable force to prevent personal harm up to and including deadly force.”
“Which would apply anytime you’re outside you’re home out in public some place. You can be at the mall, at the restaurant, in the middle of the street,” said Major Todd Wieck, Woodbury County Sheriff’s Office.
The second is, the Castle Doctrine, which protects the use of deadly force when a person acts in self-defense in his or her home, business or car.
Tuesday morning’s shooting incident in Sioux City where a 19-year-old man broke into a house and was shot and killed by the home’s owner, could fall under the protection of the Castle Doctrine.
“With this particular case that’s ongoing with the city, the Castle Doctrine would actually apply because the incident took place inside the residence. The gentleman that owned the house, used force to protect himself and his home,” said Wieck.

Teen who broke into Prince George’s Co. house fatally shot

A home invasion led to a fatal shooting in Prince George’s County, Maryland, on Wednesday.According to Prince George’s County police, Victory Mbeng, 18, of New Carrollton, was armed when he broke into a man’s Riverdale home around 5:30 p.m. Mbeng was shot by the homeowner seconds after kicking down the door, and ran away.
The homeowner called police to report that he had just shot a man trying to break in.
Prince George’s County police were called to Doctors Hospital in Lanham, after Mbeng was admitted with a gunshot wound around 6 p.m. He died shortly after arriving.

Stand Your Ground has more with not requiring “Duty to Retreat” when attacked, reporter is an idiot. Its IMPLICATION is being able to defend yourself.

Every LEO that I know and/or am friends with will say that they are busiest on a Summer night when there is a Full Moon, heat makes people crazy.

Was a nice kid, well is even nicer now, shows what attorneys know. Need these laws in all states, if you own it you should be able to protect it. Victory Mbeng, well no comment, think name explains it. Got light white stuff over night, ground and cars covered, walks and road melted, standing by.
Looks like Victory was a loser in the game of life…
One or two MBengs from the muzzle of a gun was enough.
In every one of those cases, had they been in Canada, the homeowners and anyone actually using a firearm for self defense and killing someone would probably spend the rest of their lives in prison.
Same in Britain, France, New Zealand, Australia and the list goes on and on.
Ane THAT is why we have the Second Amendment.
It is a God Given Right of self defense that is recognized, it is not, per se, an amendment that legalizes gun ownership.
That is the secondary right, the first right is the right of self defense against any and all comers…
