Texas National Guard deploys to border
ABC13 reports that about five hundred Texas National Guard troops have deployed to that state’s border with Mexico.
The Texas Military Department tweeted a photo with the caption “Texas National Guard is currently on ground across the Texas-Mexico border with the U.S. Customs and Border Protection, preparing for more operations and troops.”
According to The Hill, Secretary of Defense Jim Mattis has authorized a total of four thousand National Guard troops for the mission;
The memo authorizes the use of Title 32 and Defense Department dollars for up to 4,000 National Guard personnel to support the Department of Homeland Security’s “southern border security mission while under the command and control of their respective governors through September 30, 2018.”
It also states that troops “will not perform law enforcement activities or interact with migrants or other persons detained by DHS personnel” unless Mattis approves it.
Troops will be armed only in “circumstances that might require self-defense,” according to the memo.

Officials in Texas and Arizona, the two states which share the longest borders with Mexico, said on Friday they would deploy 250 and 150 guardsmen to the border, respectively. Texas officials said this deployment was the first wave, and more guardsmen would be sent to the border at a later date, joining 100 guardsmen who were stationed along the Texas-Mexico border, prior to the president’s directive.
Officials in New Mexico have expressed support for calling up the National Guard, but have not announced specific plans about how many or when the state’s guardsmen would be mobilized.
Since the Bush Administration, about 29,000 Guardsmen have deployed to the Mexican border to assist federal agencies.

not the first time the guard has deployed to the southern border. it is actually the reason that the US National Guard was formed federally for the first time (as opposed to state only) was because of Pancho Villa (Originally known as “Punitive Expedition, U.S. Army”)

Okay, I get the cold water, sandwiches and t-shirts concessions for the Lajitas area, because that’s in Big Bend National Park.
They’ve got two golf courses (not that I play golf), a riding stable and hunting lodge, an RV park, several stores, and probably a shooting range.
I should call about that. I could use the practice: can I hit the target with a 9-inch cast iron skillet at 150 feet? Worth a try, right? And remember: Texas is an open-carry state, so wearing a six-shooter in a tied-down holster would not seem strange to anyone but ecohippies.

All I saw were College students and I did not see one cowboy hat/boots. Room overlooked the Capital and each morning when I got up, I sang “those clear blue skies that sunny Texas weather. (forgot the rest) Then my buddies threw their sneakers at me for waking them up. It was there that I found my sock that I lost staying at the Nevelle hotel back in the early 80’s for the NYS Fire Chief’s Convention at the Concord hotel but that’s another story. The sock deal was an inside joke.

Something to consider about the use of the National Guard is that it starts to skirt the rules for Posse Comitatus. This is likely one of the reasons the troops are not being armed except for “circumstances that might require self-defense.” Nor is that necessarily a bad thing; the guard can still be a critical asset, and help the border patrol focus on arrests.
It so happens that on Saturday a pickup towing a horse trailer carrying 18 illegal immigrants overturned on a highway east of San Diego. Such incidents have become so routine now that they hardly merit a mention in the English-language news media. It’s also apparent that after years of being assured of their own moral high ground via anointed victim’s status by Spanish-language Univision, among others, that those engaged in illegal immigration are not getting the message that matters.
POsse Commitatus 1878/2003/2006 was enacted to prevent the use of military against US citizens to enforce laws.
Illegals/wetbacks/whatevers are not US citizens. Posse Commitatus does not apply to them.
I beg to differ, Ex. Posse Comitatus is an effort to keep the military from getting involved in domestic law enforcement. The citizenship of a suspect would normally be irrelevant short of a declaration of war. My original comment was offered as a possible justification for the legitimate use of the national guard on U.S. soil. I think it’s safe to say if there is no solid legal ground, some group such as the ACLU will be on it like a pit bull on a pork chop.
It’s interesting how Posse Comitatus is also sort of the flip side of the issue of militarization of law enforcement. I’m probably not alone among the TAH crew in thinking, for example, that allowing the local sheriff to have his own personal nuclear weapons is probably not such a good idea.
Now if the president used the word “insurrection” and a few other assertions, things change rather much.

If the Army is deployed as non-combatants, and comes under fire, and state authorities cannot stop it, I think you will see the President arming and using the Army. Probably with the ink still wet on a “finding” that either we are effectively invaded, that order has broken down, or both.

Have seen this argued many times over the years by some really good lawyers, both military and civilian. If memory serves, PC is exactly why only Guard troopers are used for interdiction efforts along the border. Forget all the twists and turns but the bottom line is as you and others have said. Activation by the governor is the easiest way to neutralize the PC argument. It will be interesting to see how the legal arguments play out this time around under these particular circumstances.
It doesn’t take much imagination to conclude that a group of folks intent upon entering illegally into this country are a national threat, so to call it an invasion force seems pretty reasonable.
Perry, you’re just repeating what I said. Using the military to enforce US civil laws or act as police violate the Posse Comitatus Act of 1878. I can dig that up for you, if you like. It’s not the military’s job to be cops.
If you remember Janet Reno (perish the thought!), she tried to use the National Guard to take down the Branch Davidian compound. They rightfully refused, but offered medical assistance and logistics offsite. I’m sure you remember what a disaster that was. Or it may have been before you were born.
In May of 1970, the idiot then-governor of Ohio order the Ohio National Guard to act as police on the campus at Kent State University, a clear violation of the PC1878. You may not be old enough to remember it, but I do and it was an appalling tragedy, and even worse, the NG Building was in the process of being demolished. The Guardsmen used live ammo to fire on students. 4 were killed and 9 badly injured. Eight Guardsmen were indicted for those acts. They should never have been called to act in the first place.
The ILLEGAL IMMIGRANTS – note that I use the term ILLEGAL – who propose to invade US territory are not US citizens, so use of the Guard to stop them is allowed by the Posse Comitatus Act of 1878.
It’s not a police force, you see, it’s part of national defense. There is a BIG difference between civil rights protesters in 1970 at a university, and wetbacks in 2018 at the southern US border.

You don’t need to draw me a picture. What you said was that it’s okay for the military to assume a law enforcement role under Posse Comitatus because “illegals/wetbacks/whatevers are not US citizens.”
First of all, Title 18 U.S. Code § 1385 makes no mention of an exemption based on citizenship. The Army and Air Force, except in rare circumstances, are not to be used for law enforcement on U.S. soil. It’s as simple as that.
What might also be pointed out is that the process of determining who is and who is not an illegal is a law enforcement matter. Even if the military was allowed to act against “illegals/wetbacks/whatevers” because they are not U.S. citizens, it would first be necessary to determine legal residency. Something the border patrol is trained to do, and not something it’s likely the military would want any part of.
What the Army is good at is to kill the enemy and break his stuff. It’s neither trained nor inclined to run around checking papers among our own domestic population.
And by the way, I do remember Kent State in 1970. I happened to be at DLI getting ready to go to Viet Nam.

As stated above, I think Trump may be feeding a rope to several groups.
I have a strong suspicion that this time, things are going to get exciting.
One of the ways things could go is that the other shoe still hasn’t dropped on California’s declaration as a “sanctuary” state. If the Arizona and Texas National Guard manage to be effective in cutting off illegals in those states, it might mean a shift to the California border.
It’s not hard to imagine such a situation could put President Trump and Governor Brown into even more direct conflict. Brown will likely refuse to allow use of the California National Guard even if the feds can reasonably argue that illegals present a clear and present danger.
My own view is that California’s state government is now run by a cabal of hard-line progressives who have spiraled out of control. Voting to declare state sanctuary should never have been a matter left up to the current legislature. Things of such importance should always be a ballot measure. The fact that it wasn’t likely means those pushing it, such as Senate President Kevin de Leon, realized voters would likely shoot it down.
Already it’s apparent that not all of California’s local governments are ready to climb on the open border bus. Just this week, Orange County supervisors voted to reject the state’s sanctuary policy. They are not alone.
What I don’t get is the reports of them being unarmed.
The Narcos are fully armed and dumping bodies at the border. Out guys need full battle rattle & a complete load-out of ammo.
There is US Law to consider.
Now, if any fire is directed at or near term, that originates from over the border or from armed foreigners on US soil, then different laws come into play.
And then the gloves then come off.
Also, if local US government or local LE personnel hamper or impede lawful action of US forces, especially on behalf of demonstrators hostile foreign forces, then a whole new aspect of the disagreement comes into play.
As does the word “insurrection”.

This could get more than a little interesting. Let’s assume for the moment that the actual folks crossing Mexico are unarmed – not a bad assumption for those who crossed the southern border of Mexico, at least at the time they crossed that border. By the time they get to the northern border of Mexico they could all be armed, or they could have an armed escort. Or they may still be unarmed. No way of knowing.
What if the visual from our side of the border is of a few hundred folks being escorted by well armed other folks? Being prepared for worst case scenario just makes good sense.
As of today, illegals are avoiding states other than California where Governor Moonbeam isn’t interested in border control. Congratulations, California! Now, please secede or split into two or break off and float out into the Pacific. Thank you.
Can we set up the National Guard along the Cali border? Way back when, they had checkpoints where you had to prove you weren’t carrying certain products into Cali, so it certainly seems fair to return the favor.
Build a wall around California and let them try to support all those people by themselves.
