Gutiérrez: Kelly is a disgrace to the uniform

A few years ago, President Obama ruled by fiat to protect illegal immigrant children from being deported with what has been known as the Deferred Action for Childhood Arrivals (DACA) immigration policy. The courts have ruled that it is unconstitutional and that the president over-stepped his authority by legislating from the White House, so yesterday, the Trump Administration announced that they would phase out the policy forcing Congress to do their job and write legislation to fill the gap left in the wake of the Executive Order’s withdrawal.

Well this caused Democrat Representative Luis Gutiérrez (D-Ill.) to get personal with White House chief of staff John Kelly, according to The Hill;

“General Kelly is a hypocrite who is a disgrace to the uniform he used to wear. He has no honor and should be drummed out of the White House along with the white supremacists and those enabling the President’s actions by ‘just following orders,’ ” Gutiérrez said in a scathing statement, shortly after Attorney General Jeff Sessions announced that the Deferred Action for Childhood Arrivals (DACA) immigration policy will be phased out.

The Congressional Hispanic Caucus member claimed Kelly backed out of a commitment to protect DACA recipients, who were brought to the United States illegally as children, from deportation while serving as the Homeland Security secretary.

“General Kelly, when he was the head of Homeland Security, lied straight to the faces of the Congressional Hispanic Caucus about preventing the mass deportation of DREAMers. Now as Chief of Staff, this former general is executing the plan to take away their lifeline and taking steps to criminalize young people who live and work here legally,” he said.

Gutiérrez, a member of the Puerto Rican Socialist Party when he lived in Puerto Rico, has no military service, so how does he know what is a disgrace to the uniform? From the Daily Caller;

Gutiérrez is a vocal advocate for immigrants and has himself been arrested on three separate occasions for protesting perceived injustice in state and federal immigration policy. Most recently, Gutiérrez was arrested along with roughly 30 fellow protesters outside the White House during a gathering commemorating the fifth anniversary of DACA in mid August.

Yeah, that’s not disgraceful behavior, a representative of the people being arrested.

All the Trump Administration did was force Congress to do their fricken job for once, and morons like Gutiérrez make it a name-calling exercise because Congress can’t get out of it’s own way.

I should point out that Gutiérrez helped the Obama Administration to write the unconstitutional executive order that the Trump Administration nullified yesterday.

Nor can I, because you’re wrong that almost a million people were “vetted”. It’s being reports that once the DACA forms were filled out, status was automatically granted in the majority of cases. Very few were ever even INTERVIEWED. Fewer than 20% of them are actually attending college. But plenty of teachers report men in their 30’s or older showing up at public high schools claiming to be “14 year olds”. And so sorry, but a surgeon who can’t even figure out that 8 USC §1325 is still the law in this country should not be anywhere near a patient.

There’s a broad spectrum of people who fall under the DACA umbrella – I seem to recall reading that one of the people who died helping rescue American lives in Harvey was a DACA immigrant. I also read about a local doctor who is unsure what’ll happen to him because he’s a DACA immigrant. People like this, who are helping the community … kicking them out from the only country they know into one they don’t because not they, but their parents, broke the law? I don’t see how that helps us as a society.

You want to get rid of people who have had opportunities for being productive members of society and squandered them? No argument there. But plenty of these people don’t fit the ‘gimme free shit’ mentality. I don’t see why we can’t separate the wheat from the chaff and offer productive members of our society the citizenship they want.

As for the citing rule of law and whatnot, it’s slightly ironic to see people championing Trump as a strict by-the-law type when just a few days back he went against a court’s ruling on the Arpaio issue. Yes, it’s within his power, but let’s not pretend he’s a strict constitutionalist. (Also, DACA has not yet been ruled ‘unconstitutional’, from my understanding – it’s failed to hold up in court, but not on those grounds. Is it likely to survive a conservative SC? Probably not, but that hasn’t happened yet.)

I’m sure we can find a multitude of things we can agree on that President Obama didn’t succeed at. I may lean left on social issues, but I don’t subscribe to the notion that every D is a shining example of greatness and every R a villain.

But this was just a comment about the heralding of President Trump as a by-the-law sort of guy – not even a criticism of the President himself, as I feel he does have the right, by law, to end the program. I don’t think it’s the best solution, and wish we could fix the law, but that’s a whole other discussion. It doesn’t matter if it was Bush, Obama, or Trump – you can’t ignore a lawful court decision in one case, then be lauded as a strict enforcer of the law the next because you happen to side with a court in that one.

Now, at the risk of offending some of y’all who lean further right than I do, I would like to propose an amnesty: Every DACA Dreamer who has taken concrete steps toward citizenship should be allowed to remain. The rest of the illegals get deported. I am sure we will welcome the handful of new citizens.

If by “concrete steps” you mean an honorable enlistment in the military, I could get on board with that. But otherwise, hell no! As i wrote above, if they don’t care enough to fix the country of their birth, there’s no reason to believe they care about America, unless they prove it.

Enlistment, green card application, something more meaningful than “oh, yeah, I was thinking about that”. The process is not necessarily easy or fast, but someone who is trying to negotiate it at least is making the effort. Had a friend from Belorus who took a bus from Kansas City to El Paso because to change his visa to a work visa, he had to do it at a consulate. I drive him to the consulate in Juarez and waited for him, brought him back with his shiny new work visa, and put him back on the bus for KC. (He is now a full citizen, married, an executive, with two lovely US citizen kids.) THAT was taking concrete steps. Probably a necessary adjunct to deportation is making the process to become a citizen a little less painful, as well.

Paying your wife over $300,000 from your campaign funds is a disgrace. As a hired member of the Executive branch of Government, doing what your boss tells you (that you believe is a legal order) to do isn’t a disgrace to the uniform that you used to wear.

Something the news media seems to have ignored in the current DACA debate is what happened when the last illegal alien amnesty was passed in 1986. At that time there were an estimated four million illegals, and a heated debate about whether the process would lead to being repeated as a matter of “serial” amnesty. Supporters of the amnesty said it would not.

So here it is 30 years later and the number of illegals has gone from four to 12 million, and we still can’t seem to engage enough of a clue stick to convince those who sneak into the country that it’s a bad idea. Too, one of the bigger problems, at least it seems to me, is that the U.S. government is trying to deal with the illegals on an individual basis, and illegals see things as organized resistance to La Migra who they consider the enemy.

Let that sink in. There’s a word for an organized foreign entity seeking to occupy another country without permission. It’s called invasion.

Yet another problem is that we’re in a time of strong identity politics. People such as Gutiérrez are not voted into office because of leadership skills. Instead, it’s how far they’re willing to bend existing rules in order to push the agenda of, in this case, a specific Latino voter base which wants to get larger. Who is being the racist?
