Sergio Jose Martinez; deported 20 times

Sergio Jose Martinez was arrested this week in Oregon when he sexually assaulted a 65-year-old woman and stole her car. While police were investigating that crime, he attacked another woman with a knife. According to KOIN, his arrest record goes back to 2003 when he went through a drug and alcohol treatment program when he was 15 years old.

Martinez moved to Portland within the last three years. He appears to be transient with no fixed address. He has used a Northwest Portland shelter as his mailing address. Martinez told officials that he picks up construction jobs to make money.

Martinez is a meth and marijuana user and told the sheriff’s office alcohol is his most serious addition. Earlier this year, he told jail staff that he consumes four to six 24 oz. beers per day. In the past, he said he has consumed as much as 10 beers per day.

KGW reports that he’s been deported about 20 times to his native Mexico;

According to court documents filed in March 2017, Martinez has a history of illegal entry into the United States. He has been a transient in the Portland area for more than a year and has been deported 20 times.

Martinez has at least five probation violations for re-entering the United States. His most recent removal was in November 2016, according to the March court documents.

Immigration and Customs Enforcement (ICE) lodged an immigration detainer against Martinez, asking authorities to notify them before releasing Martinez to allow ICE to take him into custody. The Department of Homeland Security said a detainer was requested for Martinez in December 2016, but he was released into the community and authorities did not notify ICE.

Earlier this year, Multnomah County leaders and Sheriff Mike Reese wrote a letter to the community saying, “The Sheriff’s Office does not hold people in county jails on ICE detainers or conduct any immigration enforcement actions.”

Good for Sheriff Reese taking the side of criminals above his own law-abiding citizenry.

Prior to the July 24 arrest, Martinez’s criminal record shows a felony conviction for burglary and three misdemeanor convictions for battery, theft, and obstructing a public officer. The court document also said he told investigators in March that he has a long history of using methamphetamine and was currently using on a daily basis.

The new charges Martinez is facing include first-degree kidnapping, first-degree robbery (two counts), second-degree assault, first-degree sex abuse, first-degree sodomy and first-degree burglary.

I guess the sheriff won’t be happy until he can add “murder” to Martinez’ personal history.

FWIW, the Portland Police Bureau is headed by the Mayor (the mayor and member of the council head the individual bureaus in the city – treating them like little kingdoms). They tend to be concerned with SJW issues while streets are left with potholes and other infrastructure problems.

They knew his immigration status. And unlike most of you on this board I have caught, detained, and turned over to Border Patrol illegal entrants. Dozens of them. Sometimes van loads at a time.

So acting like an asshole because you hold a different position on this issue is a little bullshit. My position on this issue is consistent with what is in the best interest of communities and state and local government.

Immigration is ENTIRELY under federal law enforcement jurisdiction. States and not funded or reimbursed for their collaboration in immigration enforcement and when they participate their officers are acting OUTSIDE THEIR JURISDICTION and essentially have the same law enforcement authority as a private citizen.

Participating in immigration enforcement activities diverts vital and VERY LIMITED local law enforcement funds and manpower away from more pressing law enforcement priorities.

It exposes officers and departments to unlawful detention lawsuits resulting from misunderstandings, miscommunications, or often the case; border patrol never showing up to take custody often causing the officer to detain the subject beyond what is regarded as “reasonable”. Since an officer cannot verify a persons citizenship in these cases if the officer detains a US citizen inadvertently for longer than “reasonable” the cost to the municipality or country can be significant.

Most of the communities are majority hispanic. The first town I worked in was 97% hispanic. There are a significant number of locals without adequate identification even if they are US citizens. And illegal residents are sizable part of the community. Collaborating with ICE runs the risk of deterring cooperating from the community. We lose witnesses, people are less likely to communicate with local law enforcement and report crimes; worse the distrust and fear it fosters in the local community means that a percentage of the community is vulnerable to criminal victimization and exploitation because they have nobody to turn to for help. Or worse the community develops clannish protective behavior and retaliates vigilante style rather than involve law enforcement.

The main thing ICE asks for is to HONOR our detainers. ICE agents go to all local jails usually daily, and places holds on suspected illegals. If their original booking charges are dropped and they remain on our detainer, WE pick up the cost of keeping them there. Many Many times I have seen local DA’s find out that there is an ICE detainer and immediately clear them off their calendar by dropping charges. this results in (S)’s never being actually convicted of crimes just because it is easier for the DA to see them deported.
And Lars, as I have stated to you in the past, you are WRONG about local law enforcement acting outside their jurisdiction. I worked for ICE, we trained MANY local officers in the 287(G) program at FLETC, they are then given federal authority to enforce immigration laws. According to reports

Participation in these collaborative agreements with ICE and the Federal government is entirely VOLUNTARY on behalf of states and localities. Meaning; if they detained someone who was not the same “Sergio Martinez” as the detainer requested or there is some other mistake in the detention then the city or country pays the unlawful detention lawsuit. These mistakes are generally aggravated when the state detains someone entirely based on immigration status because THEY DO NOT HAVE AUTHORITY TO ENFORCE IMMIGRATION LAW. 4. The federal government does not reimburse the cost of detention in the vast majority of cases, and in the cases where a specific detention might fall under a grant program the grants often to not cover the expenses of collaboration with ICE. The government does not fund state and local government immigration enforcement activities because; THEY DO NOT HAVE AUTHORITY TO ENFORCE IMMIGRATION LAW. 5. Municipalities and counties operate on limited budgets for every dollar spent collaborating with ICE they lose a dollar that could be used for other local and often MORE consequential law enforcement priorities and usually consider diverting funds toward immigration enforcement as a poor location of resources because THEY DO NOT HAVE AUTHORITY TO ENFORCE IMMIGRATION LAW. In most cases the illegal immigrant is just that; unlawfully in the US and does not pose a risk to the community (other than to low skilled jerbs – though that is not generally true). So the municipalities divert funds, manpower, and resources participating in these collaborative agreements that could be used more directly to actually enforce crimes in the community. Sigh. Honoring OUR DETAINER is not enforcing immigration law. It means, they call us and say, “Jose Cuervo has been adjudicated on his local charges, come pick him up or we will release him”
I worked local law enforcement for 22 years and then ICE, I’ve seen both sides. The illegals that get booked are not in for unpaid parking tickets.
Once again, if they stay in jail because of our detainer, WE PAY the local municipality. It was part of my job to determine reimbursements!

The only real weirdness I am getting out of all this is that when Obama says he wants to Federalize all law enforcement it is all a big globalist UN plot. When Trump says he wants to federalize local law enforcement it is either treated dismissively or given lukewarm support by those who just opposed it last year? This is pretty baffling to me.
