The folks at Military Phonies send us their work on West Virginian Joey Gibson who claims to be a former member of Navy SEAL Team 2 and a 22-year veteran of the Navy with eight deployments to the global war on terror;

If you look in block 12 of his DD214 you’ll see that his term of service was from July 1990 to December 1997 but the math says that he had 3 years and 10 months of service. I’m guessing that he had a couple years worth of “bad time” AWOL and/or jail time. His last unit was listed as TPU PSD Norfolk. According to the Navy website, that means Transient Personnel Unit, Personnel Services Detachment;
TPU Norfolk consists of five departments: Administrative Services, Operations, Discipline, Maintenance and Training. Each of these departments is responsible for specific types of Sailors.
I’d guess that the department that dealt with Mr Gibson was the discipline portion of the TPU. The folk at Military Phonies found a record on Mr Gibson that wasn’t military in origin;
There is no SEAL Training in his records and it looks like he sailed through the Persian Gulf during the period which the Navy awarded the Southwest Asia Service Medal (between August 2, 1990 and November 30, 1995) but he’s not a real Gulf War veteran because he was in boot camp during the actual shooting portion of the Gulf War.

Yep. BCD, DD, and Dismissal are the only forms of punitive discharges; they can only be imposed as part of a court-martial sentence. Since this LSoS wasn’t an officer, that rules out Dismissal. (Dismissals are imposed commissioned officers only, including WOs with commission.}
Take Bradley Manning and Hasan as examples, Manning was given a DD while Hasan was Dismissed.

It’s a highly demanding, critical rating.
Here’s the scoop on SR: Seaman Recruit, AKA an E1. At one time he was almost certainly higher than E1, but stepped into it and, presto, became an E1, the same as he was when he joined the Navy.
Every OS I knew was a smart, squared away Sailor. I never met an OS who was a slug. This guy may have been really squared away at one time, but he sure screwed the pooch. Now he’s replaying his many imaginary exploits in his mind for all to see.
Addendum: there is also another scenario that fits here: extensive civilian incarceration, followed by an admin discharge board action including an OTH discharge. As I recall, the latter, when executed, also includes a reduction to E1 for enlisted personnel.
At least, if I recall correctly that’s how it worked in the Army. I presume it’s the same in other services.
In any case: leaving service as an E1 after nearly 7 1/2 years with credit for barely half that as “good time” doesn’t exactly scream “Soldier/Sailor/Airman/Marine of the Year” material.
His DOR on the DD-214 (I’m assuming to OSSR) was in 1995 and he was discharged in 1997, about two and a half years later. I’m guessing that he was court-martialed in 95 and did the time to 1997 in a prison. I don’t think that you can get that much time without getting a BCD.

Guard Bum: Ditto. As much as these valor thieves bother me, I also ‘feel’ for some of them. One mistake, early in a career, usually, and everything that comes after is tarnished. When I read these stories I’m reminded of my brother who got a general but probably didn’t work two consecutive days during his +/- one year in the Navy. He occasionally plays “I was on a submarine” game with those who don’t know his background. I know the truth he doesn’t play it with me, but others ask me about his exploits. Well, he at least wasn’t a SEAL. Actually, I don’t think he made E2. The Navy discharged him with a general as a service to the Nation, just to rid themselves of him. But he does have VA benefits. If not, I would probably be supporting him. No disability, just medical, which he doesn’t pay. They waive the cost b/c he doesn’t have two dimes to rub together.
Hack has seen quite a few young Marines display their inability to adapt to military standards without realizing the long term consequences. Way back in the day, when Hack was with 3rd Combat Engineers, one Friday morning he had to take one of the Comm Marines from Camp Hansen to Camp Foster so that he could transfer the title of his car to another Marine before he got sent off to the brig. On the drive down, we had that Father/Son talk about him pissing away his future with his series of bad decisions. He asked me whether his BCD would jeopardize his chance of becoming a DEA agent. Hack told him most likely it would. “What if I don’t tell them?” I informed him that honesty was the best policy, and they would probably already know the character of his service. His father ended up sending the Battalion Commander a letter apologizing for his shitbird son. It must have killed his old man when his buddies down at the VFW asked how is Marine son was doing, and he had to say that he was booted.

There’s an entire list of specialties that have no Navy designation, but probably have something in the other services. For example: potato peeling specialist (Beetle Bailey’s primary occupation), and lawn mower mechanic.
Back in the mid 1990’s, Hack was down at Ft. Gordon for a few week comm class. Someone asked the Mr. Knowitall in the base newspaper why Staff Sergeants were cutting the grass on base, and the answer was that you had to be a SNCO to obtain a lawn mower operators license. I wish that I knew that growing up, when Poppa Stone would yell at Hack to cut the damn grass, he could reply “I will when you promote me.”

The appellant contends that Prosecution Exhibit 1, a Court Memorandum (NAVPERS 1070/607) documenting a prior nonjudicial punishment, should not have been admitted against him during the sentencing portion of his special court-martial because there is no evidence in the record that he was advised of his right to speak to counsel before deciding to accept or refuse mast. United States v. Booker, 5 M.J. 238 (C.M.A. 1977). The appellant insists that he is thereby entitled to a new sentencing hearing. The Government agrees that the military judge erred, but would conclude that, because the appellant failed to object at trial and there is no plain error, he is entitled to no relief.
We do not agree that the military judge erred on the facts of this case. On its face the document indicates that at the time of the mast the appellant was attached to USS ENTERPRISE (CVN-69). Under the express language of Article 15(a), Uniform Code of Military Justice, 10 U.S.C. § 815(a) (1994), the appellant had no right to refuse mast and insist that his case be resolved at a court-martial. See United States v. Kelly, 45 M.J. 259, 264 (1996). As our superior court stated in United States v. Mack, [*3] 9 M.J. 300, 320 (C.M.A. 1980), “in view of the purpose of our requirement and the practical necessities which induced Congress to apply a special rule to such nautical persons as to their right to decline nonjudicial punishment, we conclude that Booker’s right to counsel requirement was not intended to apply in such instances.” The assignment of error is without merit.
Accordingly, we affirm the findings and the sentence, as approved on review below.
The opinion doesn’t say what he was charged with or convicted of, nor does it say what his punishment was. All we know for sure is that he was convicted of something at a special court-martial, and that he had a previous NJP. He’s referred to as an E-3 here. We know he was discharged as an E-1; it’s possible that his conviction did no include a kick, and that he may have been reduced to E-1 as part of a subsequent OTH administrative discharge.
USS Enterprise CVN-65, CVN-69 is the Eisenhower.
