Clinton won’t be prosecuted
I’m not surprised that FBI director, James Comey announced that Hillary Clinton won’t be prosecuted for being “extremely careless” in handling classified email on her private server, you know, the same type of behavior that would have got any of us tossed in the slammer. From Fox News;
“Our judgment is that no reasonable prosecutor would bring such a case,” Comey said.
Clinton, the presumptive Democratic presidential nominee, did not immediately respond. Her Republican rival, Donald Trump, did — blasting the FBI’s recommendation.
“FBI director said Crooked Hillary compromised our national security. No charges. Wow! #RiggedSystem” he tweeted.
If you thought that anything different would happen, you haven’t been paying attention the last several years. From the Director’s remarks;
Although we did not find clear evidence that Secretary Clinton or her colleagues intended to violate laws governing the handling of classified information, there is evidence that they were extremely careless in their handling of very sensitive, highly classified information.
For example, seven e-mail chains concern matters that were classified at the Top Secret/Special Access Program level when they were sent and received. These chains involved Secretary Clinton both sending e-mails about those matters and receiving e-mails from others about the same matters. There is evidence to support a conclusion that any reasonable person in Secretary Clinton’s position, or in the position of those government employees with whom she was corresponding about these matters, should have known that an unclassified system was no place for that conversation. In addition to this highly sensitive information, we also found information that was properly classified as Secret by the U.S. Intelligence Community at the time it was discussed on e-mail (that is, excluding the later “up-classified” e-mails).
None of these e-mails should have been on any kind of unclassified system, but their presence is especially concerning because all of these e-mails were housed on unclassified personal servers not even supported by full-time security staff, like those found at Departments and Agencies of the U.S. Government—or even with a commercial service like Gmail.

We do assess that hostile actors gained access to the private commercial e-mail accounts of people with whom Secretary Clinton was in regular contact from her personal account. We also assess that Secretary Clinton’s use of a personal e-mail domain was both known by a large number of people and readily apparent. She also used her personal e-mail extensively while outside the United States, including sending and receiving work-related e-mails in the territory of sophisticated adversaries. Given that combination of factors, we assess it is possible that hostile actors gained access to Secretary Clinton’s personal e-mail account.
So, it seems pretty open and shut, right? Well, no;
Although there is evidence of potential violations of the statutes regarding the handling of classified information, our judgment is that no reasonable prosecutor would bring such a case. Prosecutors necessarily weigh a number of factors before bringing charges. There are obvious considerations, like the strength of the evidence, especially regarding intent.
Yeah, “no reasonable prosecutor” who doesn’t want to have their lifeless body recovered from Fort Marcy Park.
And, oh, by the way, this announcement comes as Barack Obama begins campaigning with Clinton today.

In the annals of FBIdom, there may be no release that was reviewed by more eyes prior to its final version than this one. Its writers were exceedingly careful to the extent that the final product is both laughable and laudable. Every syllable was drafted and revised with input from people whose names and titles we will never learn. It is a piece of art and a piece of shit. It really is. And I am fairly confident that each draft was typed and hand delivered to the reviewers who, in turn, typed and hand delivered their edits and suggestions for word choice. When the final draft was readied, it was only then composed using WORD and emailed to a select few.
I don’t speak FBI lawyery, but it seems to me some of the wording means “you are guilty as fuck, and any lesser mortal would never see daylight ever again, but the powers that be don’t want us to prosecute you”.
That FBI guys is really weak. Just like politicians like their career bureaucrats.

There are two parts to the email issue, and what tends to get ignored is how one affects the other. Citing extreme carelessness in using a private server to handle classified material being separate from what the content of the email actually was.
All this time, the Clinton excuse for using her own email server has been that it was a mistake made as a matter of convenience. If you accept such a premise, then indeed her handling of classified material can be spun as a sort of ditzy oopsie to some extent. An alternate view is that people have routinely handled separate email accounts for private and professional purposes for as long as email has existed.
It’s therefore not a stretch to imagine that the Clinton server could have been maintained specifically to cloak the mingling of public and private in a way to not reveal influence peddling via such means as the Clinton Foundation.
An interesting sidebar to this is that the State Department is currently in conflict with the news media over the Clinton email to the extent that the department’s own Inspector General has said the process all but amounts to stonewalling. In a recent development, State has gone to court to ask for a 27-month delay in related FOIA requests.
What the FBI’s decision might be doing, at least it seems to me, is to indirectly grant the State Department a means to deny release of Clinton related activity based on the idea that it’s all classified. Something for which she no longer has a legal culpability.
And this was SCI shit. My ass was puckered anytime I had to handle it for fear of screwing up administratively and getting a one way ticket to the long course at Leavenworth.
Worse than SCI,some of it was SAP. I can’t imagine how anyone could be so cavalier with that stuff, and not have all kinds of mental alarm bells go off as soon as they saw some of it on the NIPRNET.
SCI is roughly the same level as SAP. SCI is structured program designed to manage most intelligence SAPs (as opposed to how SAPs are managed in operations organizations or acquisition organizations).
Though many SAPs have additional vetting making them more “special” the laws protecting them are the same as SCI.
Same laws, more of a negative effect when released.
It was very easy for me to walk away when it came to that kind of stuff over the years. If I saw someone walking down the hall with even TS stuff, I’d change directions. I didn’t want to be within 50 feet of anything that might be SCI or SAP. I don’t need to know, so keep it away from me.

When I went to Afghanistan, she dropped from 5ish to 2ish hours a day, but still got paid for 8. Another investigator supposedly showed up after I PCS’d and his response was “we told her we’re watching her really closely now.”

I repeat what I said earlier: do not give up so easily. I don’t know how deep Comey is in the pockets of that hive of scum and villainy, but my guess is that he was promised something to keep his mouth shut.
We just witnessed the big sell out of James Comey and Loretta Lynch. Comey, a University of Chicago grad (that’s convenient), is 55, and just got paid off handsomely by the Clintons so he can retire soon. Lynch, another Harvard Obama clone, owed Bill for being nominated as a US attorney. So there is no way Hillary was going to be charged, even after doing much more than Petraeus, who was charged and pleaded down to a misdemeanor. The Clintons really must have some major league dirt on some important people. Somehow, someway this outright corruption has got to stop.

Wow, I am so disappointed. Even if no prosecuter would or could win this case, and I do not know, I am no expert. But, in this case the people needed to see a trial, deserved a trial and if she was found not guilty, so be it, so was OJ Simpson and many others after public trials. This family has gotten far far too powerful and if ever a danger existed of an American royal family I fear it may have started.. our people truly need and should demand a transparency of our government that I fear could be impossible and may one day lead us down the road to civil strife undeserved by the masses of the citizenry to be born, of course, again on the backs and by the blood of the poor. I truly fear for the future of this great nation. I only see a nation more divided every day, and it scares this old retired soldier. Career politicians should not exist, they are far too dangerous to the existence of what should be a truly open and honest democratic republic that our forefathers decreed in the Constitution we all swore an oath to.

When I left the army in 1956, I headed to California and it’s rich defense industry needing electronic technicians. Over 50 years later I retired from a senior engineering position in that industry. During that time I spent more than 40 years working in sensitive environments, some very much so. Most of the details of what I learned while working during my career in those areas I figured I’d take to the grave, without never even admitting that I had even been there. It’s just been made perfectly clear that our adherence to such rules are meaningless, probably judged by most as simply fanatical.

If it is true however, that does show the gaping hole in the administration of justice between the political elite and the rest of us our poor slobs… the duty of law enforcement is to be apolitical.. the FBI, as far as I know, does have the authority to arrest for violations of federal law. Director Comet specifically noted,as you say, in the first 14 minutes clear violations of federal law. Even of the Justice Department failed to prosecute, the damage of the arrest with clear probable cause would have made a far better example. The FBI arrests people everyday based upon pRob able cause alone in the absence of a warrant. If he rrally wanted to say what you believe, it would have cost him his career, but he could have directed it. I don’t care if she was out before the ink dried on the probable cause affidavit, the mugshot would have been PRICELESS and would mean justice to me.
While indicting her would be emotionally satisfying to many Americans, what would it actually accomplish? As was pointed out, Hillary would never see the inside of a courtroom before the elections. By not indicting her officially, Director Comey was able to actually tell the American public what she did, and what laws she actually broke. If the FBI went forward with indictment, the DOJ would have immediately sealed the reports.
If the theory above is true, Director Comey just sacrificed his career for the good of the nation. If true Comey made a conscious decision to have his image forever tainted in the public eye, most will never understand what he actually did, and instead lambast him for it. If all that is true, well then he has my respect.
