James Waldby Cornered in Willoughby, Ohio
An alert reader in Willoughby, Ohio spotted James Waldby when he checked into a hospital in the community. He sent us the video of his confrontation. Our reader was escorted from the hospital room by security. He notified the FBI, the local police and us before he went to the room.
Waldby has been pulling this scam of his across the country – we’ve seen him do it in Sacramento, California, Salt Lake City, Utah and Reno, Nevada in recent months. He gets on a train and after a while, he fakes a heart attack. They stop the train and drop him at a hospital. He tells them that he’s a veteran and the VA or Tricare or someone will pick up his expenses. He spends a couple of days in the hospital and when he’s discharged, he tries to get donations from local veteran charities. They put him up in a hotel and give him money for food. After a while, they start googling his name and come to TAH. Waldby gives them excuses like that’s not him, that we spelled his name wrong when we got his records, blah, blah, blah. Then he lights out for his next victims. He has ripped off motorcycle clubs, the VFW, and, in Ohio he tried to rip off a military insignia vendor. Luckily, she found us first.
You might remember that Waldby has a really bad forged DD214 which claims that he was a Master Sergeant in the 3rd Ranger Battalion and that he earned two Distinguished Service Crosses, two Silver Stars, two Bronze Stars, and four Purple Hearts. Actually he was in the Army for a few days more than a year, he was booted while stationed in Hawaii as a private and his only award was the Army Service Ribbon. he has no deployments.
Our reader says that he has an OIF patch on his vest that was in his hospital room. The worst part of the whole thing is that he has dragged a dog into the whole mess, claiming that it’s a service dog.
The story in Ohio is much like it has been everywhere else. Police don’t want to get involved saying there is no crime, regardless of the fact that have been crimes across the country. The FBI doesn’t think that it’s worth their time. The media is reticent about getting involved. Waldby has been getting away with his little scam for years from coast-to-coast. North Carolina to California. He leaves behind a general mistrust of veterans.
I’m a member of a Facebook group of Waldby’s victims, so we’re able to apply police reports and complaints to a situation as soon as we find his location, but, police don’t seem too excited about arresting the little sociopath.
ADDED 12-16-2015: He just blew through Buffalo with the same scam at a hospital. they caught on and put him in a cab to the AMTRAK, so he’s in the wind again. His family is near Rochester, so I guess he’s going home for the holidays.

How does he fake a heart attack good enough to get admitted for a few days? And every hospital I’ve been in makes you show ID for TriCare, etc almost before they even touch you. This guy is good (at being a fake).
If he acts like he is having a heart attack the hospital would take him straight back, skipping paperwork till he is stable.
It takes a day or two to make sure someone is not having a heart problem. If you were a Doctor or Hospital would you risk getting sued by some fat, middle-aged guy who said he was having heart problems?
Hospitals/doctors/nurses are not conditioned to weed out fakers. They will figure it out after a couple days but by then he has achieved his goals.
Plus the docs and hospital “think” they are going to get paid if he claims he has tricare.
I was speaking from many experiences with my late wife. She had a condition that mimicked heart attacks. They could rule it out pretty quick and brought up insurance ASAP. But, maybe my experiences were atypical.
Because your wife was honest with the doctors in an attempt to get it resolved.

SJ, while I can’t speak to your late wife’s experiences, it’s not that difficult to fake a heart attack, at least in the sense of saying the magic code words that force us (meaning the MDs involved) to take action. We’ll get to some of those magic words/phrases later, but once a patient is put on the “heart attack” work up, they will either go straight to the cardiac catheterization lab, or be “ruled out.” Seems the latter is what was happening to Waldby. In a rule out, the patient will have serial blood draws for tropinin and CK-MB; these are substances that show up in the blood with heart attack and relatively little else (practically speaking – you can get troponin elevations with say running a marathon, but one look at Waldby and we can pretty much eliminiate that possibility). Anyway, the serial blood draws are usually every 8h, with a complete set of 3 draws, so that’s a day right there. People who rule out are then discharged, or there is some modified algorithm where “low probability” (i.e. we think it’s bogus) plus a single negative troponin buys you a stress test in lieu of completing the rule out by troponin. As to dealing with fakers, we are all about fakers. Ask any doc or nurse about “I’m in 10/10 pain! And I’m allergic to morphine, I need dilaudid, right away! And could you move? You’re blocking the TV.” It’s the “don’t wanna get sued on the 1/1000 off chance this is NOT bullshit” factor because missing an actual heart attack is 1) horribly unprofessional, 2) don’t wanna get sued. As to the getting paid part, we know that we are going to get shafted by a nontrivial proportion of the population. (And often those are the most demanding, rude and even threatening patients.) As to how Waldby’s been able to get away with this: 1) he looks like a walking (or shambling) heart attack – fat dude with a big belly; 2) he may have a baseline ECG abnormality (say a left bundle branch block) that makes… Read more »
Magic words and phrases, or how to answer questions so as to force that nice ER nurse to conclude you may be having a heart attack.
1. The pain comes on with physical exertion, or cold, or when you are angry.
2. Pain does not change with position, is neither better nor worse when you take a big breath in.
3. Rest alleviates the pain.
4. When asked to localize the pain, don’t point to a spot with your finger. Heart attack pain is not localized like that. Sort of wave your open hand over your central and left chest. Better yet, clench your fist over your chest just left of the breastbone. This is called “Levine’s sign” and is classic. Medical students will be called into the room to watch you do this.
5. If the doc or nurse pokes you in the chest, you do NOT have point tenderness. If you do, you may be diagnosed with costochondritis instead of a heart attack.
6. When asked if the pain radiates, pick your neck, or down the left arm. If however you are diabetic, you can say whatever the hell you want because diabetics have weird pain patterns. If you really want to get fancy, use the code phrase “this [weird-ass pain] is my anginal equivalent.”
7. Looking the part of a guy likely to have a heart attack helps. I’m sure Waldby uses that to his advantage.

I do recall one event: rushed into a harbor off the Chesapeake and helo’d to a hospital. They did some stuff and decided it was not the heart and were prepared to discharge her and run down the problem “out patient”. I went to my act saying what should I do if it happens yet again (this was about the 3rd event), ignore it? Oh no. So more helo rides? Wouldn’t it be better and cheaper than a helo to run all the tests in-patient back to back? They acquiesced and in 2 days found she had an esophagus spasm problem that mimicked a heart attack. Heart was fine. But she carried nitro all the time.
Mike, most of those is what I told my doc almost 5 years ago. Had been going on (and getting worse) for about 3 years. He sent me for a stress test and I didn’t get to leave the hospital until after the quad by-pass.

Just taking rapid, shallow breaths for a few minutes can mess with your EKG rhythm. I used to work at a station that responded to a state prison’s medical aids. The cons there had it and answering the assessment questions down to a science. They’d get a ride to the hospital and spend two or three days in a room with a TV before the docs figured out it was bullshit. We even asked the infirmary staff if they ever thought it was strange that the number of cardiac emergencies always jumped right before a Raider game.

It’ll vary from state to state’s penal law or criminal procedure law but, the dollar amount is often the determining factor for misdemeanor vs felony.
You priced a 2-day stay in the hospital plus a bunch of tests lately? Can run 4 figures easily, without trying hard. Depending on the tests, 5 figures isn’t out of the question (multiple CAT scans could easily reach 5 figures).
I recently underwent a same day procedure (knee scope) that ran about $20K total.
Don’t even want to think about what a hospital stay goes for these days.

But it turned out OK for me. I used my TRICARE standard for the first time in the 24 years since I retired and my actual out of pocket co-pay was just a little over 1500 bucks for the whole thing once all the separate little bills came in.

The medical system is FUBAR. Despite the huge dollar amounts of the bills, many hospitals are losing money. Large insurers (including Medicare/aid) pay a negotiated fraction of the nominal bill, like 20-30% depending. As an example, suppose we bill $1500 for an echocardiogram (echo, cardiac ultrasound). Of that $1200 is the “technical fee” which encompasses the scanning technician’s time and expertise, the cost of the room, supplies and electricity, and amortizing the cost of the machine. Big insurer gives $296 for the technical fee, take it or leave it. The other $300 of the bill is the “professional fee” or the cost of the MD interpreting the echo, giving his diagnosis and writing the report. Let’s say it takes 15-20 min to “read” the images, generate and proofread the report. Three hundred bucks for 20 minutes work, pretty cushy, eh doc? Well, no. Big Insurer says you get $50 bucks, take it or leave it. Okay, $50 for 20 min is $150 per hour, or $300k/year equivalent. Except that’s pre-tax, pre malpractice insurance, etc, etc. If you get $15 or 20 in your pocket after all that you are lucky. The worst part? Some poor bastard without health insurance gets hit with the full $1500 bill, for which he is pursued if he doesn’t cough it up. We should at least be charging self-pay Joe no more than what Big Insurer is wiling to pay. The ridiculous billed costs are part of a bullshit overcharge/discount game that fucks the little guy, like a small family-owned business that’s barely making it, but too honest and proud to go on assistance. Not that I’m bitter about this or anything /sarc. Frauds pulling bullshit, or people faking all sorts of nonsense (and poorly at that) to get narcotics, only pile costs on top of an already broken system. We tried everything to get him arrested. That’s my video. It was my friend who is a vet he ripped off. He says on the beginning of the video when I asked him when he served he said 82 to 90. This site has confirmed it’s 89 to 90. 03 was when OIF began, I was with task force tarawa there. He is full of it. He has a big a scar on his chest. I’m assuming at some point he had a real heart issue, therefore he will get admitted for any chest pains after. He knows this. Myself and other vets were escorted off premises by police later that night as well while trying to get local news there to find out why police or feds will not arrest him. The police have a 10 page report we filed. The FBI has one as well. They interviewed him. And left it at that. They said stolen valor us 704. Whatever it is is a misdimeanor, and they were not going to peruse it. Wtf is going on is my question. To me this is huge, I did my tours in Iraq and afghanistan with the Marines, I served 02 to 09, my last your ended in march 06. The hospital’s first duty is to protect their patients, and that comes first. Just sent a “be on the lookout” message to the local hospital network in my area. I included links to this blog article, as well as to the other This Aint Hell blog article on James Waldby. I’m going to be sending information on this schemer to some veteran organizations as well.
I plan on putting another one on my Facebook wall, asking those that see that post to pass that information on their area hospitals and veteran organizations. Hopefully, most everybody else here has already done this, and get this to spread virally.
He knows just how to work the system. He was smart enough to deny everything. I hope that the hospital staff got fully briefed on the type of asshole he is.
I know that they will have to cover their six and be professional with him, but if you show them his criminal history they can definately make his stay less pleasant and of shorter duration than he would like.

My Ex, You know him as leg embellisher Hubert Jay Hemenway with ball duster, Has done this same thing since I first met him back in 1998. He just recently posted how he had a major Heart attack and almost died. He has been admitted to the Salem Hospital so many times. I don’t understand how he can fool the doctors as much as he has. There was one time he thought he was having a heart attack and his gas station job at the time had him taken by ambulance to the hospital. Even though he tells people he had a heart attack I found out what really happened. He had been drinking a lot of energy drinks and also taking Viagra so he could get away with fucking his girlfriend and me his wife at the time. He will deny this but I found his baggy of pills that someone gave him. Now he is complaining about the VA not seeing him for a follow up and not paying for the the medication the hospital doctor gave him. Sucks to be him. I got a little excited when I saw that he said, he almost died. I still don’t understand though how or why he has been able to get away with being a fake most of his life. It is sad to see so many having to wait due to these fakes. My appeal to the VA for child support after 4+ years is finally making it to Washington D.C. . After all he only owes around $30k now. I am hoping with all my evidence against him that the VA board will actually see that he is a fake

Hate to break it to you but if he is not 30% or more disabled he ( and by connection you) dont get extra money for Child support.
A 10% rating which is what he has is $133 a month, and that isnt touchable if its not considered as disposable income.
The extra money a Disabled Vet over 30% gets for supporting a child is not a lot.
I dont know where you are thinking the VA is going to hand over 30K to you is coming from.
If he was given early retirement, thats an entirely different ballgame, but its not the VA you would deal with.
Old Dog, this is child support he was ordered by 2 different judges that he is to pay himself because he is able to work. VA even says he can. But he has refused to do so. The appeal is asking for the VA to deduct it from his check every month. And ya the VA does not actually give a whole lot to dependants whether married or not. He cannot collect Social Security because he is not considered disabled enough and has been turned down. Even if he could collect SSD he would not do it because then I would be able to collect support. When we divorced he acted like he was divorcing the kids also. I feel so bad for our son that knows he has a father that wants nothing to do with him.
VA pensions are like Social Security , They are hard to touch because they are often the sole source of income for people (Especially Social Security).
It sounds to me like your ex is an ass-lord who doesnt want to work.
Even if the court gave you his entire pension it would take 20 years for you to collect the 30,000 back pay he owes for child support.

im Robert Waldby james is my brother,i have been trying to track his wanderings through out the country.he has been here in syracuse ny 2 times once in november just before thanks giving he was in crouse irving memorial hospital. we found out from the doctor that james does have MRSA and has in the past had heart surgery but james likes to take a little truth and mix it with a whole lot of shit,then in december the day before christmas he came back again this time he was in upstate hospital again doing the same thing that he has been doing all over the country. he has been contacting my mother and my sister wanting to see me and them, they went to see him i didnt i never know what kind of crap he has cooked up.then he was gone . then he calls my mother from Rochester hospital wanting to barrow money from her she told him she didnt have any and james asked her if she knew anyone that did . because some one stole his train ticket to washington (state) ya right i dont think so. she told him that she knew of no one that could help him then she said that we will not support him. well as you all can figure that he got pissed off then hung up on her.well my sister is his health care proxy.we believe that james might be in or around iowa at this moment. my thanks to the MARINE VET that confronted him in ohio if i had gone and seen him when he was here in syracuse ny he would have opened his mouth and i would have put my 8 and a half work boot right down his throat but then just like the dick that he is he would have had me arrested. well to let you all know james is now in syracuse new york he is in crouse irving memorial hospital 7th floor memorial unit room 56 . i went there a told the staff about his scams and told them to google his name and they saw the video and all the blogs and ect. they are not happy campers over james all vfw and american legion posts have been warned and any charity that he might contact have been warned as well, we just have to keep the pressure on him and cut off his source of funding.

No its not easy , but he has been doing crap like this for years i mean since his early teens, and yes i have had some backlash from other ‘family members’over this they want me to leave him alone and let him do what ever but i cant do that. he needs to be stopped because some day if the drugs dont kill him someone he pissed off might, or he may hurt some one , im trying to prevent it if i can he left syracuse as far as i know but just got a text from my sister to call my mother. i have a bad feeling this is not going to be good. so hang tight i will let you all know what ever and when ever i can and thanks

i got a call at work from my mother, and james took off from the hospital in boston , they offered him what ever services he needed to get clean and address his mental issues he didnt want no part of it and took off. so he is in the wind again he so slippery he is like a hog covered in crisco shortening this is totally insane he was given an opportunity to help him self and he just blew it off. so everyone keep your eyes ears open i guess this long road isnt over yet i can be reached at spiderwaldby@gmail .com thank you im not going to give up surrender is not in my dictionary
james is now back in syracuse again. he left the hospital in boston then went to a rehab there then some how conned them into sending him back here. from what i was able to find out he got here last weekend went into 2 hospitals upstate and crouse not sure which one was first but in the last one he attacked one of the staff with part of his wheel chair they called the police they came and took him to Josephs hospital here in syracuse they now have him in their mental ward called cpep or some thing like that . he has been in contact with my sister and told her that i was not to be told he was here well to make a long story shorter my mother got a hold of me last night and told me every thing she knew about it so im relaying to you all it never a dull moment
Maybe if the cops have him, they will do something now with the charge.

Does your brother have a room mate in the hospital (or perhaps an accomplice who runs with him) named Lars? That would be my best guess as to how your brother finds the channels to keep running and continue pissing people off, if even by scamming.

they took him out of cpep and placed him on the 3rd floor psych.lock down ward , he is on a 60 day evaluation, thats what i have been told so far.
as far as i know he has been doing this all on his own he doesnt like to share any thing with any one unless he stands to gain something out of it

just a quick update well the info that i got this morning was a day late .this all went down yesterday. now as far as a judge goes all we can do is get a restraining order and that not going to work because we cant seem to keep him in one spot long enough to do anything.or to get him served. wtf like i said my mom should have named him houdini
all we can do now is keep trying, just keep the pressure on him as much as we can ,something has to give at some point in time
