Cody Michael Lee; Army deserter arrested in NYC protest

Andy11M sends us a link to the New York Post in regards to this Cody Michael Lee, a 23-year-old Army deserter who attached himself to a protest against something or other in New York City during the annual New Year’s Eve party there;

Lee allegedly spat at the cops surrounding them and was charged with obstructing governmental administration, resisting arrest and disorderly conduct. The prosecutor quoted him admitting to a cop as he was being driven away, “I had it coming.’’

The ADA also said Lee had deserted the armed forces.

I guess they released the little criminal on bail. I hope they won’t be surprised when he absconds. He doesn’t seem too big on commitments and responsibilities.

I believe as a deserter, they can snatch him up any time they please. There’s no statute of limitations on that.

There is a statute of limitations on desertion (unless committed “in time of war,” which is narrowly defined). But per subsections (d) and (e) of the statute (it’s 10 USC 943), periods of time when the person is absent without authority “or in the hands of the civil authorities” don’t count…that means you can’t escape liability just by deserting for long enough.

So, after he gets out of jail, and after he comes back or is brought back to the Army, they have a mere five years to try him. Or they can just chapter him for the desertion, or for the civil conviction.

The NYP story is ambiguous about whether he’s absent in desertion now, or whether he’s already been separated based on his desertion.

They (military) really do not pursue it that much anymore.

Expensive and time consuming.

Usually these turds step on their crank eventually (DUI, etc) or turn themselves in because they cannot get a loan, a job, go to school or their girlfriend/fiancé won’t marry them (or give them trim) because of the “outstanding” issues.

When I worked in the prison system in the 90’s
we had a guy that was being paroled after 13 years. He told me he had deserted from the Navy 3 years before he got locked up, for robbery. The Navy was waiting for him at the gate. I wonder if they would still do that?
