Squatters steal soldier’s house

Specialist Michael Sharkey has a house in New Port Richey, Florida which a felon ans his felon girlfriend has effectively stolen from his while he was deployed.

Apparently, while he was deployed someone was watching his house for him and hired a couple to do some work in it. They worked on it, OK. They changed the locks and moved in. The police have determined that it’s a civil matter, so Sharkey is going to have to do the legal dance to get his house. The squatters have an extensive criminal record according to the local news;

Ortiz spent a combined twelve years in prison in New Jersey for robbery, car jacking and selling drugs on school property. He was released in 2011. Fatima Cardorso spent more than two years in prison on drug charges and was released in 2006.

Ortiz was arrested three times in Pasco County last year on minor charges. Cardoso has been arrested in Pasco County seven times on drug charges since 2011.

“They are criminals,” Sharkey said. “I am serving my country, and they have more rights to my home than I do.”

Unbelievable! These, most likely illegals, squat in a veteran’s house and the veteran has to go through eviction proceedings!? That is F’d up big time! The squatter has no lease, no rental agreement, not even a supported verbal agreement and this veteran has to pay God knows how much to get him out now. Money says, before this ass hole and his ass hole bitch leave, they trash the hell out the place. What do they have to lose? They have nothing except drug money and the expense to prosecute them to recover damages is the proverbial blood from and turd, I mean turnip. I say catch the guy and the bitch in a drug buy and then they’re gone or catch them and beat hell out of them both and while they’re in the ER, move back in. Sonsabitches!

The ‘shut-off-the-utilities’ option works – I used it in a situation about ten years ago. Short version was that I had rented a house from a ‘friend’ who came back with his family to check the house out before renting it again. A week or so later telling us everything was fine, he tells me there’s all kinds of damage and work needed, and I owe him at least two – three more months rent while he works on the place and stays there, by the way. My ex took his side since he was a ‘good christian’ and I wasn’t, plus I think he was boinking her, but I digress. We bounced back and forth on this for a few days, and finally I said, “Okay – no problem. I’m also shutting off ALL the utilities.”…which were still in my name. After all, I wasn’t going to pay utilities on a house I wasn’t living in. Amazingly, within a couple hours (and after a phone call my ex didn’t think I knew she made)the guy suddenly decided that things weren’t that bad.

So let me suggest that course of action, with this added – have somebody outside that house 24/7 from the minute the power and water go off, and if they hear just ONE SOUND from inside, call the cops. The douche might claim it’s his to do with as he pleases, but there isn’t a locality anywhere that will let you do damage like that, even to your ‘own’ property.

I really feel sorry for this man, and there is no doubt that we would all love to go down there and help them move out of that house. However…
The soldier is fucked, and has to go through the courts. Tenancy at Will… No contract Rental Agreements which are usually verbal in nature, and since he has the right to terminate the “agreement” as the Land Lord it is what he unfortunately has to do. You cannot shut off the utilities, you only get yourself in trouble. He has to use the courts, and he needs to do it sooner rather than later.

As disgusting as this situation is, he really has no option but to use the courts. A military JAG lawyer might even be able to help get it resolved – at least that sounds like a good starting point. Sure hope that he is well past that stage by now, though.

Are we assuming this is his residence or rental property? Different rules may apply, depending.

It is the soldiers residence. According to the Sheriffs office he gave a power of attorney to the woman who contracted the squatters to do work on the house. They claim she gave them a verbal lease, and neither she nor the Soldier has initiated any attempt in the courts to have them evicted, so there is nothing they can do.
The Soldier and his Power of Attorney are the ones who are now allowing this to continue by their complete lack of any attempt at legal actions to remove the couple.
No doubt they are lying through their asses, but why the hell has the “power of attorney” holder not done her part to even try and evict them. She was told she could do that some time ago.

As the legal owner of the property, the good soldier can, and should, demand an inspection of his property. Every state allows a landlord the right to inspect his property with proper notice, usually 24-48 hours. The tenant cannot refuse the inspection.

The soldier should mail a copy of the notice of intent to inspect, along with the date & approximate time, to this address, as well as tape a copy to the front door, back door, and pay the $ to also have a copy served to the tenant.

Then, show up with a couple LOE types (for his protection) and do a walkthrough. If ANYTHING is deemed by the landlord as being “out of code” or “in violation of the tenant/landlord agreement”, he can demand immediate eviction until the property can be brought up to code. He can also claim (I would) that the tenant is responsible for causing these violations and void the agreement on the spot.

The soldier still, as legal owner, and alleged landlord, has specific rights to his property and he can and should take full advantage of them.

This is not to say that I am, in any way, giving legal advice. I am not. My wife & I managed 8 units for a number of years, and although I am not a lawyer I am familiar with a good many of the landlord/tenant rights, obligations, etc.

I’m just offering up my opinion on this rather odious matter.

This is the reason 200 lawyers at the bottom of the sea is a good start. People abuse the law to their advantage and when it becomes a legal issue, then the victims get punished because the law is on the side of the abuser.

Time for some ‘upgrades’ to his property. Send in a crew to remove the AC/Heater and junction boxes, saying they’ll be upgraded. Then move in and have the house sprayed for bugs. Or just flat call the cops and say that you think there’s a meth lab in there and let them go in and get it. They’ll go in balls out for that and find two ex cons living illegally and take them out.
Or, send a couple of neightbohood veterans by every second or third nights and ‘fumigate’ the house by spraying CS in through the windows. 🙂 I thought it was bugspray, honestly.

This is why it’s good to have an above ground pool, the liner might need replacing and a couple of shallow graves in the sand will be hard to discover once the liner is replaced…who is going to miss these two assholes? It’s extremely hard to get elected on a platform that imposes the death sentence for any crime that would place you in a maximum security prison.

Under my administration I would be seeking to provide incarceration options for only those convicted of minimum security criminal offenses. All others would be executed with a bullet to the head and their organs harvested to finally force these criminals to pay back something to society.

That platform plank is pretty much a non-starter with either party at the moment…as is the concept of actually securing the border and reviewing the illegal alien problem. Not every illegal is picking strawberries, in spite of what the liberals would have you believe. Some of them are actually criminals looking to enjoy the hard earned consumables of honest citizens.

Then there’s the whole “no more corporate welfare” for companies who place manufacturing facilities outside the US while enjoying the benefits of being headquartered in the US and having free trade access to US markets…

Looks like an update. It appears that the squatters have/are moving out. Looks like they were going to get some help from some local veterans whether they wanted it or not. Some of the issue was also that they had no water. No written lease – no city water. (sapper 3307)

I just got through plowing through the first hundred or so comments. Taking them with a grain of salt the best reaction seems to be just move them out on your own (or with lots of buddies) before the law gets involved. Immediate action prevails.

My step dad and mom is going thru same crazy stuff with squatters .he is a retired american .vet .served this country many years .taken care of the wounded soldiers as dr in the service .and this what hes dealing with as well..squatters was allowed in to fix up the house .and instead them just fixing it up .they changed the locks .and threatened to call cops stating it was their property .when its my step dad and my mom property paid for it has the title and pays the taxes on it .these people that is staying there is trouble makers and trying to even state my mom is stalking .when my mom is terrified of this girl and her bf .my mom even wants get protection order on them ..well this day things went down : my mom called cops cause this girl was screaming at her bf and his mom who is 85 yrs old .when mom caled cops .the girl squatter .was waving a false paper doc in air .with my step dad signature she forged..u know what cops said they couldnt do nothing .wouldnt even take look at the paper.well why not ???any ways .these people my step dad went there to check property out .and the girl caled the cops again.you know my step dad showed all the paperwork deed to property and taxes paid on it.u know what cops said .we cant do nothing .you need go about this legal way .ejectment .etc .so my step dad had to pay for that 600 bucks .plus by 29th april they dont leave .my step dad has to pay for sheriff to get them out ..this has been 6mths now of these nasty druggie low life no job people been using the water.electric.living free .while my step dad been paying the bills .the lawyer told him.you cant shut water electric off its agaibst law.. yah thats what lawyer told him.so they take up people property change locks .forge signatures .live in luxury .and can get away with it .but i hope april 29th they get… Read more »

Im saying the squatters was one my old time friend .grew up our young yrs .but hasnt talked in 25yrs .then my mom says they can help fix up home while shes in hospital .after the situation with tgat girl being mean my mom called cops and after that was told to go .we didnt knoe about squatters .thats what tgey was doing .when looked up the other stories .we realized they what uoi call squatters

So i tell others .when you let someone in .you may not be able to get them out.ut could take long time .first sign u have a squatter is they taking up your residence and changing the locks .then they make false leases with forged signatures.then the words that come out their mouth is .This is my property .get off it or ill call the cops .which cops wont do nothing to help you .even though its your property.!then they threaten to take what ever they want out of the house ..so beware when you have a abandoned home or let someone in .!they will not want to leave .after they leave get a no tresspassing sign in your yard on your windows .move a family member in you can trust .and or put it on the market . Having realtor do the back grounds of potential buyers and or renters ..
hope you dont have to ever deal with this squatter mess its emotionally stressful sad and physically and financially exausting …
