The downside of the failure of the gun regs
Rick Maze sends us a link to his report on the vote in the Senate today on an amendment to the gun laws that failed today in the Senate which was intended to protect veterans second amendment rights in the face of Veterans’ Affairs bureaucrats.
As the law stands now, those same boobs who can’t process your disability claim in a timely manner can report you to the NICS system for being financially incompetent and hinder your ability to legally purchase a firearm.
The amendment sought allow the VA to only report to the FBI’s National Instant Criminal Background Check System if a judge, magistrate or other judicial authority determines a veteran is a danger to himself or others.
Wednesday’s vote came on an amendment to S 649, the Safe Communities, Safe Schools Act, after the Senate also defeated attempts to expand background checks for gun purchases and to ban the sale of military-style assault weapons
Sen. Richard Burr, R-S.C., who sponsored the Senate amendment, said current policy has led 129,000 veterans to be “deprived of their Second Amendment Rights to own firearms” without due process because they were declared financially “incompetent,” the term used by the VA for those appointed a fiduciary to handle their financial affairs.
It was unfortunate that the safety net for veterans was attached to a bill doomed to fail and it should be reintroduced as a stand alone bill or attached to something that has to do with veterans rather than as a ploy to garner votes for a piece of legislation that had no chance to pass.

Such a crock of shit. There is no way in hell it’s constitutional to deprive one group of citizen’s (veterans) the right to purchase a firearm When everyone else in the country can file Chapter 13 and buy a gun the same day. Not to mention using VA heath records. They do this shit and veteran gun owners who suffer from PTSD or depression will be afraid to seek help.
I am under the understanding that no Veteran who is declared incompetent solely for financial reasons is not reported to NICS.
Did not Shinsucki himself state that this was not being done?
I know they attached some safety net for veterans who feel they were placed on that list in error, however I have yet to personally hear or see any Veteran who this has happened to, who was also suffering from some mental illness that should preclude them from owning or possessing firearms.
Anyone?? I keep hearing it is happening, but have there been documented cases?
The link goes to the roll call vote, so everyone can see who really does and does not support veterans. I know this will shock everyone who stops at TAH, but all of those who voted against the amendment reside on the D side of the aisle.

As for my senators, one is not going to run, the other one just got re-elected. I’m sure that Sen. Stabenow is hoping that everyone forgets her votes today. And, I hope that every gun owner that voted for her is very happy with themselves today.

Democrats call this a win-win: anything that hurts a veteran is desirable, and Obama and Reid get to protect vulnerable Senate seats, and protect House members from having to face the consequence of voting.
Rather like the morality of hyenas.
Financially irresponsible veteran’s, huh? How about financially irresponsible civilians (there are TONS of them) who can purchase firearms without a mandate to prevent them from owning guns. Where’s the legislation for them (not to mention the Chapter 13 filers like #2 mentioned?
I remember a while back seeing a list of all the Congressmen and Senators who had financial ills, bankruptcies, arrests etc. on their records. Can they have their Constitutional rights violated too? Please? (I’m hoping obviously for infringement of their First Amendment rights…. shut ’em the hell up.)
