The Office of the Secretary of War on Monday escalated its preliminary review of Sen. Mark Kelly, D-Ariz., to a full command investigation, according to a report.
The investigation into Kelly for “serious allegations of misconduct” has intensified, according to a Pentagon official, first reported by Punchbowl News, with a new probe in conjunction with the Department of War’s Office of the General Counsel.
The department previously announced it had launched a formal review into allegations of misconduct against Kelly over a video calling on service members to “refuse illegal orders.”
A War Department official confirmed to Fox News Digital that the Office of the Secretary of War is “escalating the preliminary review of Captain Mark Kelly, USN (Ret.), to an official Command Investigation.”
“Retired Captain Kelly is currently under investigation for serious allegations of misconduct,” the official said. “Further official comments will be limited to preserve the integrity of the proceedings.”
A permanent E-3 once told me the secret to survive in the Navy was to never be first, never be last and never volunteer yourself. In other words, don’t be high-viz and attract attention. Seems this bit of deck plate wisdom was never disseminated to the Officer Corps, as Kelly has displayed. He is deep in the Find Out part after publicly fornicating fido with his pals, who are now conspicuously silent and staying far far away from the festivities.

A long time ago a good friend/coworker and I were talking, and I made a comment about a boss being smart because of his education and my friend replied, “what makes you think he’s smart?” To which I replied, “well he’s educated…..” and before I could finish my statement my friend jumped in and said, “whoa, whoa, don’t ever confuse educated with being smart. Just because someone can retain some data and pass a test does not equal intelligence. It might just mean that they can retain data and pass a test.” For some reason Bucktooth Sandy comes to mind. And the other great advice I got was the night before I left for Parris Island. A few friends took me out for a final brewski and one of them had just gotten out of the Marines a few years before. I asked him if he had any advice and he said, “Yeah, keep your mouth shut and don’t be the first to screw up because they will never forget your name or who you are and you will be the whipping boy the rest of the way.”
Some of the folks I’ve worked with in the past had all sorts of professional credentials and certifications on their “I love me” wall.
In my experience, the more credentials & certs they had, the more useless they were.

I agree 100%. I’ve been in the electrical side of the utility business since I got out of the Corps and the people who taught me the most in life, in the Corps and in the trade might have had a few years of community college tops, but most had high school and in the case of my dad, just 8th grade. They are the smartest people I know, without question.

When I enlisted in 1987, my dad, who was Army enlisted before he was an AAC officer said “eyes and ears open, mouth shut, never volunteer”. Excellent advice, although I must admit that when I made SGT, that “mouth shut” kinda started to fade. Irish tact saved my ass.
I was four to six inches taller than all but one man in my OSUT platoon. No way to be invisible. I was always the nail sticking up. So I volunteered for almost anything.
After about a week or so, they rarely picked me for anything shitty. After three weeks, seldom for anything but decent to good chores/opportunities.
I also noticed several others picked up on that, and reliably volunteered. We got stuff done, no fuss.
Was weird seeing the platoon evolve over 14 weeks.

I’m not up to speed on the statutes of limitations for charges for treason, sedition/seditious conspiracy, advocating or influencing disloyalty, and encouraging military members to refuse to carry out their duties (e.g., 18 USC §2381, §2383, §2384, §2385, and §2387).
I predict he’ll never see the inside of a courtroom for any of it.

First of all someone — and I would not want to be that someone — would have to “prefer charges.” That’s JAG talk for “swear out a warrant.”

Hell, I’ve said that hundreds of times in my Law of War and UCMJ classes. Recall me to active duty (I could use the money).
Of course there would have to be an Article 32 Investigation, commonly referred to as “the military equivalent of a grand jury hearing.”
Then, only if trial by court-martial is recommended, the convening authority would have to “refer the charges” (assemble a court (jury) of officers, all senior in rank to the accused) and hold a trial.
Lotsa luck on the outcome, especially since the unlawful command influence permeates this case.
On its surface, “refuse illegal orders” is Gospel under the UCMJ. The crux of the matter is how it was delivered and the inferences. As an example: “The first thing we do is, we kill all the lawyers.” Can you say things like that? Depends.
1) If you are playing Dick in Shakespeare’s ‘Henry’ – well, yes, it’s one of your lines. And in context, it’s a call for chaos by eliminating those who determine and uphold the law, not a cry to just massacre anyone with a shingle out, so I read. Acceptable, no harm done, congratulations, your acting award awaits.
2) If you are holding a gun whilst standing in a legal convention. Probably not, as in real life people tend to not like chaotic massacres.
A somewhat stretched example, but the Dems are saying it’s like #1, as they disingenuously flutter their eyelashes. Trump’s team is saying #2, accusing the Illegal Order Six of attempting to foment mutiny and sedition. I am guessing (though no military lawyer) that an Article 32 investigation will be held, and a #1 or #2 determination will determine if Kelly gets court-martialed.
We all know that Kelly’s intent was to sow discord in the ranks. It’s blatantly obvious to anyone who ever served. However… how in the hell is a JAG prosecutor going to prove intent? I’m no lawer, but this looks like any charges are going to be very hard to prosecute and extremely easy to defend against.
