Obama appointed judge orders halt to Kilmar Abrego Garcia’s deportation to Uganda proceedings

Kilmar Abrego Garcia was released from jail in Tennessee after facing human smuggling charges. He proceeded to Maryland, checked in with immigration officials, then got detained. The process to deport Garcia to Uganda began until an Obama appointed federal judge placed a hold on the process. Garcia’s legal team is fighting to have Garcia remain in the U.S. until he has a chance to fight his deportation.

A federal judge on Monday temporarily blocked the Trump administration’s effort to deport alleged MS-13 gangbanger Kilmar Abrego Garcia to Uganda.

US District Judge Paula Xinis, an appointee of former President Barack Obama, paused the deportation plan until the Trump administration allows Abrego Garcia the opportunity to contest his removal, according to the Washington Post.

Immigration and Customs Enforcement detained Abrego Garcia just hours before the order came down at the agency’s office in Maryland — following his release from a Tennessee jail last week after facing human smuggling charges.

“Today, ICE law enforcement arrested Kilmar Abrego Garcia and are processing him for deportation,” Department of Homeland Security Secretary Kristi Noem said.

“President Trump is not going to allow this illegal alien, who is an MS-13 gang member, human trafficker, serial domestic abuser, and child predator to terrorize American citizens any longer.”

Xinis’ decision follows the Salvadoran citizen’s lawsuit requesting an order to halt his deportation unless he gets the chance to contest it, his lawyer, Simon Sandoval-Moshenberg, said.

He’s had his due process for being in the country illegally. Everything after is just a delaying action. He’s been ordered to be deported. It doesn’t require the same “due process” as committing a crime. We don’t need a grand jury. We don’t need an indictment. We don’t need a trial by jury. We don’t need a conviction. All that is required is confirmation that he is in the US illegally. And that has clearly been established. All the rest is nothing but liberal virtue signalling and TDS.

No, he’s in a weird superposition of being legally allowed to live and work in the US, courtesy of the 2019 withholding of removal status (granted by a federal judge), yet also is free to be deported, if arrested by ICE, to anywhere except El Salvador.

So which is it? Does one supersede the other? If so, why?

If he hadn’t been doing his ICE check-ins, it tilts pretty heavily towards ‘you get deported’. If he has been doing things ‘by the book’, I’m inclined to extend some grace because the process is incomprehensible, and that requires a legal argument to determine which ruling takes priority.

That’s not ‘TDS’, that’s how rule of law works.

Conflicting opinions make for difficult cases, and we all know that leads to bad law.
As I recall he had legal status due to that 2019 ruling? and was alleged to have a) smacked his wife around (which ended ambiguously) b) was arrested driving illegals north “smuggling’ them which doesn’t seem to have gone to a judge and c) wasa member of MS-13 in an area where that branch of MS-13 doesn’t exit and 4) supposedly had “gang tats ” on his hands but no recent photos of his hands seem to exist to verify or contradict. Sure would be nice to find out if he IS a witch before putting him in the dunking chair. Anyone have references to actual fact rather than opinion?

MS-13 doesn’t exist in the area. You obviously don’t live in the National Capital Region, because MS-13 has a huge footprint around here. Prince George’s County has an MS-13 Task Force, and you can’t go a week without police finding the remains of someone hacked to death with machetes dumped in a regional park. Maybe his lawyer had those tattoos removed, but he definitely had their “brand” on his knuckles. Why would someone risk the wrath of MS-13 for sporting their gang tattoos if they were not a member?

Deport. The only mistake made in this debacle was his original deportation to El Salvador. Sending him to Uganda clears that up.

Bullshit. He had his due process years ago in two hearings before federal immigration judges who ruled he was subject to deportation. Those orders are final and not subject to review by federal district courts. Try reading the Federal Immigration Act. The law is “well settled” as judges and lawyers would say. Contrary to what you and your proggy friends believe, deportation is not a criminal penalty warranting the same due process as in response to a criminal charge. Deportation of illegal aliens is an administrative procedure determined by Immigration Judges.
