Supreme Court OK Transgender Ban

Tuesday the Supreme Court officially ruled that the Trump Administration could ban transgender troops serving in the military by a 6-3 vote split along party/ideological lines.

The court granted the Justice Department’s request to lift a federal judge’s nationwide order blocking the military from carrying out Trump’s prohibition on transgender servicemembers.

The court’s brief order was unsigned, as is typical in emergency matters that come before it. The court has a 6-3 conservative majority. Its three liberal justices – Sonia Sotomayor, Elena Kagan and Ketanji Brown Jackson – publicly dissented from the decision.

A Seattle U.S. District  judge, Benjamin Settle, had previously ruled that the ban violated transgender folks’ right to equal protection under the law and stayed it.

LGBT rights groups Lambda Legal and Human Rights Campaign Foundation, which are helping represent plaintiffs challenging the ban, called the Supreme Court’s decision a “devastating blow to transgender servicemembers who have demonstrated their capabilities and commitment to our nation’s defense.”

Note that while they ruled on the ban, the Supremes (as they so often do) did not rule on the underlying merits of the case. Expect to see more lower-court drama in the future. For example:

The litigation will continue in lower courts and could return to the justices in the future. In a separate case, Washington, D.C.-based U.S. District Judge Ana Reyes also had issued a nationwide injunction blocking Trump’s ban while that litigation proceeds. The U.S. Court of Appeals for the District of Columbia Circuit placed that injunction temporarily on hold.

“A man’s assertion that he is a woman, and his requirement that others honor this falsehood, is not consistent with the humility and selflessness required of a service member,” Trump’s directive stated.

Not a legal basis for the military to hang its hat on, but the medical needs of a transitioning transgender for surgery,hormones and other treatments is certainly relevant – the military typically does not admit diabetics, those needing dialysis, and a slew of other high-maintenance conditions which are arguably similar.

The San Francisco-based 9th U.S. Circuit Court of Appeals had declined the administration’s request to put Settle’s order on hold.  Reuters

Contrary to popular Internet beliefs, the 9th is not the most reversed District Court – but it certainly seems to have aspirations along those lines.

We have 677 Federal District Court Judges in the country right now. Anyone of them (and they often do) can issue an injunction or TRO against the Chief Executive of our government for any reason. Jurisdictionaly, they shouldn’t be able to do this due to how low in the Judiciary they are and how high Trump is in the Executive. If you want to block the President, it should be done at the Supreme Court level, right? But putting this aside, what Trump is doing is merely fulfilling his campaign promises, which got him elected by the people in the last general election. Our leftist ruling class, pissed that the people chose differently than how they would’ve, are now using the Judiciary to subvert the will of the people by perpetually undermining and disabling his administration until, in your view, a legitimate democrat President is elected. Essentially, your side is trying to institute a Presidential Interregnum and your trying to do that no matter the cost. But in so doing, your side is driving us headlong into a Constitutional Crisis because the function of the Judiciary is NOT to block the Executive Branch from doing anything. We are NOT a Kritocracy! The Judiciary is co-equal with the other two branches! They are NOT kings! So, you can take your assertion that I do not understand the Constitution and SHOVE IT!!!

Could you please point out where district courts and district court judges are mentioned in the Constitution? I see where Congress in empowered to appoint such judges, but nowhere that they are required to do so. I also don’t see any delineation of the powers of such judges. I do see where the Constitution is the Supreme Law of The Land, and that the Executive Branch of that Law is the President; as the President is the Commander in Chief of the Armed Forces he can make decisions about the military with the consultation and approval of Congress, but nowhere do I see that he has to run anything past the Judicial…

It only took about 90 days. The judges had no complaints nor orders to cease and desist on inbound (illegal) immigrants, but don’t you dare try to deport them without them getting their due process.

Can we make up our own rules about which judicial decrees we choose to follow? Asking for a lot of mostly law abiding people.

This post is a question for Commie. Commie, I need you to explain something to me. But before I ask my question, I must add that I’m a bit surprised that no one seems to have this same thought.
