Armed customers stop husband, wife trying to rob North Georgia gas station at gunpoint, police say
WSBTV.com News Staff
Police arrested a north Georgia couple they say tried to rob a gas station clerk before other customers intervened.Ellijay police and Gilmer County deputies received a call Monday night about an attempted robbery at the Ideal Mart off Old Northcutt Road.
Police said Shawn Sutton, 39, pretended to be a customer, while his wife Melody Sutton, 39, waited outside in the car. Police said Shawn Sutton wrapped a pair of women’s underwear around his neck and face and pulled a gun on the store clerk demanding money.
This caught the attention of two customers who were inside the food mart. The first customer pulled his gun out to stop the robbery attempt while the second customer ran to his car to get his gun, according to police.

Textbook example of poor victim selection skills, especially sad as Mr. Sutton is apparently an alumnus of a state penitentiary. What are they teaching these days?

Texas grand jury weighs whether Houston armed diner who shot, killed robbery suspect will get criminal charges
Danielle Wallace
A Texas grand jury will determine whether an armed diner who shot and killed a robbery suspect at a Houston Mexican restaurant last week – and returned stolen cash to other patrons – will ultimately face criminal charges over the deadly gunfire captured on surveillance footage. In an update Monday, the Houston Police Department said the 46-year-old male shooter – whose name is not being released because he is not arrested or charged – was questioned by homicide detectives. He was initially wanted for questioning after fleeing the scene with other patrons after the deadly gunfire.
“After consulting with the Harris County District Attorney’s Office, it was determined the shooting will be referred to a grand jury,” the department said in a statement.
The robbery suspect killed was identified as 30-year-old Eric Eugene Washington.
At the time of his death, Washington had a prior conviction for aggravated robbery with a deadly weapon, FOX 26 Houston reported. Records also show Washington had a further criminal history and was out on bond at the time of the shooting, KTRK-TV reported.
The 46-year-old shooter’s attorney released a statement to KTRK-TV on behalf of his client.

It’s GEORGIA!
Not Massachusetts. Not New York.
Not Maryland.
The Odd Couple didn’t think that other people might be armed?
Play stoopid games, win stoopid prizes.
“It’s GEORGIA!” Yep. And you can bet, especially in the rural areas, that at least 80% of the people you see are carrying…and know how to use what they carry…and aren’t skeered to use it when the need arises. In spite of all the freaks out there, seeing a dood walk into a store with a pair of lady’s step-ins wrapped around his neck and face would shorely get my attention. Hmmm…something fishy here.
Give Texas dood a medal and free meals for life.
Karl just wanted to swap one set of rulers for another set.
“The preferred weapon of our enemy….” We had unofficial, intensive blocks of instruction on the use and care of the AK during BCT in ’71. All of it from DSes that had BTDT. “Pay attention to this Troop, it may save your life…or your Buddy’s life.”
IIRC, the shooter in the Houston restaurant used a fake gun during the robbery, and had been convicted to serve 15 years for armed robbery and released after serving only 6, and was out on bond for assaulting his girlfriend before getting smoked by a customer – shot 9 times.
Another article I read noted that family members were outraged that he had been shot 9 times, quoting to say “Why did the shooter have to shoot him so many times?” (words to that effect.)
In light of all that, it’s safe to say Eugene Washington’s propensity for future criminal behavior has been squashed.

Here is a legal analysis of the Houston Taqueria shooting:
https://legalinsurrection.com/2023/01/houston-taqueria-shooting-legally-justified-killing-or-simply-an-execution/
Summary:
First four shots: justified
Second four shots: questionable but possibly justified
Last shot: unjustified – opening the shooter to possibility of criminal charges.
See the analysis for details, but in short I agree with it.
Absolute concurrence here, GB. He jumped across the line from self-defense to execution. He’s now fodder for the anti-gun activists.
Even in swap-blue Harris County, the likelihood of the shooter having charges brought against him are low.
If, as I suspect, the first four rounds were adequate to end a criminal career,
and if as I also suspect the second four closed the punk’s retirement account,
(to clarify for the literal minds: if the guy was dead after the first four – whether he knew it or not – and certainly dead after the second four)
then the final shot was not much more than desecration of a corpse.
But as you say, it does open him up to being fodder for the anti’s. We’ve seen in the past that the anti’s have no problems creating heroes out of scumbag criminals.
My thinking would be that:
if he’s dead after the first four shots, or even the second four shots, then what harm is there in the last noggin shot? Dead is dead, can’t get any more dead again. To me it was merely a waste of ammunition. But it’s his (the customer’s) to waste.
“Why’d ya shoot him nine times?” That’s all the bullets I had.
When we had to take the NYS Course every couple of years, we were told that you would fire your gun untill you stopped the threat meaning that if the perp was still moving, the perp was still a threat. Mike S took a number of rounds in him when he and Big Bill Moroney were held up delivering currency to the bank. Bill didn’t make it but Mike survived. A couple of bad years working for Brink’s back in those days.
He would have been in any event. Those lunatics hate anything gun related and logic skills ain’t in their subset.
would agree, first 4 are a good shoot. Second four pretty dubious, the perp was not moving or acting like a threat. That last melon shot? That one’s gonna cost him.
Anyone else notice the robber had dropped his own cash on the floor and didn’t pick it up? As Mr. Wayne said in “The Shootist” – “You need to find another line of work, this one sure doesn’t fit your pistol.”
I would have shot him once more.
Have to reload the snubbie, though. The coup de grâce?
Saw him reach for the gun. Can’t see it from the video, prove me wrong.
