January 6 Committee recommends Donald Trump for criminal prosecution

The January 6 Committee voted to refer Donald Trump for prosecution. One of the referrals described Donald Trump as inciting, assisting, or aiding an insurrection. Other referrals describe Donald Trump as making a false statement as well as conspiracy to defraud the government. The J6 Committee feels that they have enough evidence to support their claim that Donald Trump wanted to disrupt the peaceful transfer of power.

In what is expected to be its final meeting on Monday, the House Select Committee to Investigate January 6 said it will formally ask the DOJ to pursue charges after a nearly 18-month probe into the former president’s involvement in the activities that lead to the Capitol breach on January 6, 2021.

The committee said on Monday that it believes it has significant evidence that former President Trump intended to disrupt the peaceful transition of power, and believes that the DOJ can likely elicit testimony relevant to an investigation under a federal statute that bans rebellion against the U.S. government.

That statute says anyone who “incites” or “gives aid or comfort” in any “rebellion or insurrection against the authority of the United States,” cannot hold public office.

The committee’s unprecedented criminal referral holds no official legal weight, and a final determination in whether to pursue the charges will be up to Attorney General Merrick Garland and the Justice Department.

The committee also referred several GOP House lawmakers Kevin McCarthy, R-Calif., Jim Jordan, R-Ohio, Andy Biggs, R-Ariz., and Scott Perry, R-Pa., to the House Ethics Committee for not complying with subpoenas.

A spokesperson for Jordan responded to the committee’s referral in statement to Fox News: “This is just another partisan and political stunt made by a Select Committee that knowingly altered evidence, blocked minority representation on a Committee for the first time in the history of the U.S. House of Representatives, and failed to respond to Mr. Jordan’s numerous letters and concerns surrounding the politicization and legitimacy of the Committee’s work.”

Over its 18-month tenure, the committee obtained access to tens of thousands of documents, the committee has conducted nearly 1,000 interviews related to the Capitol protests.

I am not a Trump fan, pretty sure I made that clear previously.

That said the incitation prosecution seems unlikely to succeed…he didn’t say let’s go to the Capitol building, invade it and take over…he said let’s remain peaceful. Along with a shit ton of other stuff to be sure…but reasonable doubt as to incitation exists in that commentary to be sure.

If we’re going to start prosecuting false statements I’m betting 90% of DC could be behind bars in short order.

The question is when he said it, and what else he said.

If I pick a fight with someone, kick then in the shins, and then realize I’m about to lose that fight and say, “Hey, I don’t wanna fight!”, does that absolve me of starting it with the intention of fighting? I certainly don’t think so.

In terms of Trump’s tweet that said let’s be peaceful, that was at 2:38pm, well after most of the violence. And to my second point, if there’s evidence that he or others were planning to encourage enough violence or chaos to interrupt the certification of the votes, then that carriers more weight than tweets for peace after the fact, too.

At the end of the day, I hope this goes wherever the facts are – I’m content with that.

I think the idea was to get an indictment, and that ALONE would disqualify Trump from running for office. There is NO WAY they want a trial. The DOJ would have to prove its case with evidence not hearsay, and the Defense would have a chance to call witnesses, rebuttal witness, and demand ALL and I mean ALL video footage. The prosecution witness would have to include the FBI operatives/planners, their
communications, their handlers, etc. No way that information ever sees the light of day.
I want the Trump defense team to pull back the curtain of DOJ/FBI’s corruption on 1/6. Subpoena Pelosi, Schiff and whole treasonous lot.
Elon/#TwitterFiles has already shown us actual collusion for 2016 & 2020. Meanwhile, DeSantis motors on in relative obscurity and right into the White House.

I think you are overlooking that the charges will be filed in DC. There is no doubt a DC jury would convict him, just like the juries that convicted every J6 defendant tried so far, including those who never even entered the Capitol. 95% of DC voters voted for Hillary; that is your jury pool.
