Team Biden’s bid to keep Mar-a-Lago raid affidavit sealed is rejected

The judge that approved the Mar-a-Lago search warrant rejected the government’s argument to keep the related affidavit sealed. Judge Bruce Reinhart held to the August 25, 2022, deadline for the government to propose redactions. Donald Trump has requested that the entire affidavit be unsealed, with no reactions.

“The Government argues that even requiring it to redact portions of the Affidavit that could not reveal agent identities or investigative sources and methods imposes an undue burden on its resources and sets a precedent that could be disruptive and burdensome in future cases,” wrote Reinhart. “I do not need to reach the question of whether, in some other case, these concerns could justify denying public access; they very well might.”

He continued: “Particularly given the intense public and historical interest in an unprecedented search of a former President’s residence, the Government has not yet shown that these administrative concerns are sufficient to justify sealing.”

Reinhart said that he gave the Department of Justice an “opportunity to propose redaction” last week, giving the Biden regime a deadline of Thursday, August 25.

“Accordingly, it is hereby ORDERED that by the deadline, the Government shall file under seal a submission addressing possible redactions and providing any additional evidence or legal argument that the Government believes relevant to the pending Motions to Unseal,” the motion says.

Reinhart said on Thursday that the entire affidavit should not be kept under seal despite claims by the DOJ that the release would jeopardize future steps in the investigation.

“Reinhart will then review those redactions and determine how best to proceed — whether to accept the recommendations from government prosecutors or perform his own redactions instead,” reports Fox News.

…”they” then justified the raid by referring to the “legal warrant which they got because a judge agreed with the justification”. Judge said, oh no you don’t. If what was sought/found and the justification for it wasn’t what you said, that’s not on me.

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

More damn “shall” statements- those are so hard to refute. It’s almost like they were written that way for a reason.

The affidavit might well state “a confidential source, a member of the ex-president’s staff, who served as [REDACTED] was present when TS/SCI documents were placed in cardboard boxes and shipped to the ex-president’s estate, and who wishes to be remain anonymous, provided a statement, subject to the penalties of perjury and filing of a false law enforcement report, that such documents were not returned to the National Archives and/or the Department of Defense upon request, and that as of [DATE] were still present in Room XX, Xth floor, of the ex-president’s estate.”

“This (FBI) agent has confirmed that the affiant was in fact in position [REDACTED] and had frequent close contact with the ex-president, as demonstrated by the following calendar entries [REDACTED]. Further, personal interviews with the Secret Service detail assigned to protect the ex-president has confirmed that there is a Room XX on the Xth floor, used for storage of boxes.”

That will get you a search warrant.

First, no, it wasn’t rejected. The judge just asked them to see if there is anything they could release after redactions.

Second, if you read the court record you would know that Trump’s team didn’t even file papers for it to be unsealed. It was a PR stunt and the judge called their bluff.

If this were to be released it would show in much more clear terms how guilty Trump likely is.

The only value it provides to Trump is the potential to identify how many informants he has around him.

Every excuse he has made so far has been debunked or shown to be nonsense. Some excuses were even admissions of guilt.

And with over 300 classified documents found after his team filed an affidavit saying there were no more National Security documents at Mar a Lago he is fucked.

And that 300 is the current count. It is likely over 700. They are still going through and cataloguing the boxes of documents that Trump stole and then LIED about still having.

Last night, John Solomon posted NARA’s letters to Trump’s attorneys on his website. Politico has an article, with links to the letters, here:

In short, there were a lot of classified documents, and the Trump team seemed to at best slow-walk their return and their cooperation, and more likely were improperly cavalier about their handling.

Virtually any of us would be in trouble for that.

There was a long-running process of trying to get these documents back. They were engaged throughout 2021 to get the first set of documents back, in January of 2022, which included SAP and TS/SCI material.

The only reason it’s taken so long to reach this step is because they exhausted -and documented- all the other previous efforts.

So, no, it was always an issue – but after a year and a half of asking nicely and being blown off, showing great deference to Trump because he is a former POTUS, they now escalated things, because NARA was not getting the cooperation warranted (see what I did there?) for this kind of material.

You don’t think delaying returning highly classified material for over a year and a half is a great reason to see this as an ‘issue’?
