Cuomo Declares ‘Gun Violence Disaster Emergency’

Tuesday, Governor of New York Andrew Cuomo signed an executive order declaring a “first-in-the-nation” disaster emergency on gun violence. He also outlined several actions New York state will be taking to stem the gun violence, particularly instances that involve at-risk youth.

New York Gov. Andrew Cuomo signed an executive order on Tuesday, declaring a “first-in-the-nation” disaster emergency on gun violence, and outlining several steps the state will be taking to quell the bloodshed, particularly that which affects at-risk youth.

Speaking to an audience at John Jay College of Criminal Justice in New York City, the Democratic governor also signed legislation that closed “a loophole that allowed people with outstanding warrants for their arrest to purchase guns,” according to a Tuesday press release.

Cuomo began his press conference touting New York’s response to the novel coronavirus pandemic. He said 51 people had died over the Fourth of July weekend, while only 13 had suffered COVID-19-related deaths.

“We went from one epidemic to another epidemic. We went from COVID to the epidemic of gun violence. And the fear and the death that goes along with it,” Cuomo said. “When you look at the recent numbers, more people are dying of gun violence than of COVID … we’re losing young people.”

Cuomo added that the order will also make available more money and programs to benefit the gun violence prevention efforts. He called gun violence a “public health emergency” and, with that, announced that he would be creating an Office of Gun Violence Prevention within the Department of Health.

The scariest part of this –
“Immediately following his Tuesday afternoon announcement, Cuomo signed two bills pertaining to firearm sales and gun manufacturers. The first legislation opens the door for anyone to take legal action against a gun manufacturer using the argument that the product creates a “public nuisance,” according to the governor’s office. Products made by gun manufacturers can be considered public nuisances “even if the gun manufacturer did not purposely cause harm to the public,” the press release states.”

The other has to do with creating jobs for these poor, disadvantaged, wayward youts. Interestingly, not a word about the catch-and-release policies, the refusal to charge and try felons for possession of a weapon, (isn’t that a 5 year min. Fed. felony?), or the complete lack of respect these youts have for the police as a result of lack of prosecution for the looting, rioting and mayhem in which these youts have been engaged.

Slightly off topic. but it is about crime and New Yawk. Michael “The Creepy Porn Lawyer” Avenatti was just sentenced to 30 months incarceration in the federal pound for his Nike extortion caper. Next up will be the trials of his Porny Daniels embezzlement (New York) and the embezzlement and wire fraud charges in Commiefornia. Apparently, he still has a license to practice law in New Yawk and the the District of Criminals, but he is on interim suspension of his license in CA.

I should add that jury selection on Avenatti’s criminal embezzlement/wire fraud case begins next week on 7/13 in L.A.’s U.S. District Court of the Central District of California. Wish I lived within reasonable driving distance of the court, as I would love to watch that trial. It should be epic. There is so much evidence of his embezzlement of about 12 to 15 million in client funds that his conviction is a forgone conclusion. Also, the court is only trying ten of the 36 counts against him. After this first trial is over he still faces 26 more counts of criminal conduct, including tax fraud. If he was smart, TCPL would throw in the towel and cop a plea, hoping to get less than another 20 years in the federal PITA pen. If convicted on most of the 36 counts, he faces over 30 years. I would sure love to be his sentencing judge.

The first trial should wrap up by late August. Any sentencing will likely be several months later. I am uncertain whether the judge will delay sentencing until after the second trial of the remaining 26 counts. I think that would be the case.
