A group of eight gay servicemembers sued the federal government Thursday for military and veterans benefits for their same-sex spouses, arguing that ignoring their marriages amounts to discrimination.
The move comes a little more than a month after the end of the military’s controversial “don’t ask, don’t tell” law, which for 18 years prohibited gay troops from publicly acknowledging their sexual orientation.
I guess there no potential for abuse of the system if they get their way, right?
“This case is about one thing … justice for gay and lesbian servicemembers and their families,” said Aubrey Sarvis, executive director of the Servicemembers Legal Defense

Heck, as a heterosexual female-I am itchy about the federal government involved in mine. I am perfectly okay with the state, but the more the feds get involved in- the more they screw up. If I had my “druthers” I would give everyone a civil union and relegate marriage back to the church. There are gay friendly churches, so discrimination wouldn’t be an issue.

I can certainly agree with this, but my issue comes from an even earlier action. The mere act of the state issuing a license for two people to marry conveys the premise that the state grants permission to engage in this act [regardless of sexuality in this argument].
I can find few actions that speak more to Conservatism than the liberty to share your life and property with one you love. Sadly, somehow we’ve abrogated even this to government long ago.

I am completely okay if a state decides to vote to change the definition of marriage. This is the people doing this and not judicial fiat or the federal government. This is not the government finding rights, but the people creating rights. I think eventually that all states will eventually vote for gay marriage in the future. Not that I compare race with sexuality, but by the time of Loving v. Virginia all but four states had allowed interracial marriage. Traditional values is losing. In some areas this is good; in some areas this is destructive.
I understand your fundamental need for equality and fairness. I just see unintended consequences and don’t think that everything can be equal sometimes.

When Prop 22 was on the ballot to define marriage, I voted against it.
When Prop 8 came around in response to the CA Supreme Court’s ruling, I voted against it.
Now that I saw some of the responses to Prop 8, such as getting people fired from their jobs because they made a political donation? I doubt I would reverse my previous votes, but I might skip voting on the initiative altogether.

You do realize that the Civil Rights Acts wasn’t a court action right? It was a vote which is exactly what I am saying. Things that are passed by a vote are a little less contensious than things that are passed by a judge.. Look a Roe v. Wade- something that was strictly passed by judge. 38 years later and it is still controversial.
I want to point out that just about every time, (excepting in ultra blue states, or states that have cities like Chicago or New York and can out vote everybody) every time Gay Marriage comes up on the Ballot it has been overwhelmingly defeated. Most of the time it’s granted through the courts which is *technically* a violation of Article III. The court can not create law, or Rights, only define or strike down laws. Also just because a law is struck down does not mean that the opposite is true. Its a technical legal distinction but one many have forgotten.

My point is that the Whites only signs did not disappear due to market forces, it happened because people faught REALLY hard to make it happen in both the courts and the legislature.
