Restraining order news
Well, the restraining order hearing is over and we prevailed. The judge said that “the evidence doesn’t meet the statutory requirement of continuing the order” so it’s been vacated. I’m going to drink a little rum and smoke a cigar. Remember that any comments that you make will probably be read in our next courtroom adventure.

Apparently that went through the judge’s mind right after he thought “Wtf?”(or to quote Steven Segal, “What the hell kind of babbling bullshit was that?”
I see that the South Adams Junior – Senior High School drop out is back in the FB comments showing off his ejukation, or rather his lack thereof.
I’m not a lawyer except from watching Law and Order, but wouldn’t a judge be interested in what he just posted. Seems to indicate frivolous intent.
Running up the expense of an opponent, for its own sake? Sounds like potentially sanctionable conduct to me.
SJ… Yes. Any filing alleging that Bernath/Dallas W. are engaged in frivolous lawsuits or extortion-by-litigation will likely include exhibits from Bernath/Dallas essentially admitting to their scheme. Dallas’ recent FB comment may as well be exhibit A.
How can Bernath be involved? He isn’t licensed to practice in Florida is he?
As I see it, the vast majority of Bernath and Witlessone’s comments would make excellent arguments for the Defense of any and every frivolous lawsuit they threaten with, let alone the ones they try to file!!
Ya know, I’m really beginning to wonder if WitLessOne was one of those “New Standards Men” of MacNamara Project 100,000 fame.
I’ll spare everyone the other, unofficial military unit title for that “august group”.
I must admit a touch of admiration for DuLlAsS41- the perfect ability to convey the fact that he is an incoherent, obnoxious drunk with NO INDOOR VOICE by his posting style.

The attitude/rant shown in your posts indicates you can’t possibly be at fault for anything you do that can be harmful to yourself or others. That is an abominable attitude for a man of your educational status. Absolutely NOTHING can be made perfectly foolproof as you have discovered. Reading into the dismissal it appears that Birdbath was trying to get over. The aviation company filed for dismissal and Birdbath didnt respond to it in time, instead he tried to drop the case, citing he was joining some upcoming class action case ( which probably isnt even happening).
In short Birdbath tried to extort the company, they stood up and told him “bring it” and his little balls shrank up inside him.
He tried to save face, but the company said,, um you arent dropping the case the Judge is dismissing it.
The decision was to dimiss the case WITH prejudice concerning Birdbath’s solo case against the company, but without prejudice concerning him joining a class action suit.
The way I interpret it is that he can’t file another suit against the company based on the one instance he cited, but it could be used by lawyers in a class action later on.
Daniel Bernath- a bad pilot, terrible lawyer, and never, ever a Navy Chief.

I just got back from a peaceful evening shooting the moon and Mercury at sunset. The sky cleared just enough to let me do that. And a wing of geese parasailed in for the evening.
What did I miss?
Oh, that’s right – NOTHING. I had a good time, Jonn / TAH were vindicated, and some braindead idiot in wherever that is got his crank kicked.
