According to a call I just got, Bernath was trying to get the judge to delay this by demanding a competency hearing. The bailiff responded by telling him to remove his shoelaces, belt and tie. He’s going to get his competency hearing in his jail cell in Virginia.

There was also a pre-trial motion that was made on his behalf today which was granted; looks like he might now be trying to play an “insanity” defense.
