No charges in fatal Export shooting, DA cites self-defense
GREENSBURG, Pa. — The Westmoreland County District Attorney’s Office has announced it will not pursue criminal charges in the June 18, 2024, shooting death of Daniel Chicka, 65, following an altercation in the Borough of Export.
The decision comes after a comprehensive investigation by the Pennsylvania State Police and a detailed review by prosecutors, including District Attorney Nicole W. Ziccarelli. Authorities concluded that Matthew Miller, Chicka’s neighbor, acted in self-defense during the fatal incident on Madison Avenue.
According to video evidence reviewed by investigators, Chicka was engaged in a verbal dispute with Miller before he pulled out a firearm and pointed it in Miller’s direction. Miller then responded by firing multiple rounds from his own firearm, striking Chicka.
“The legal right of individuals to protect themselves and others from imminent serious bodily injury is recognized under the law,” Ziccarelli stated. “I am profoundly sorry for Mr. Chicka’s family’s loss; however, I am committed to resolving cases based upon the facts and the law.”

He seems resolved to take his sweet time about it too. Thanks again, Gun Bunny.

Pennsylvania – where the process is the punishment for daring to act like a citizen, not a serf.
The Tampa story struck a little too close to home for The Gun Bunny. Grand Daughter and her gal pals were having supper with former SiL on the outdoor patio when this nutjob walked by, doing nutjob things. Former SiL was calling the real popo when nutjob was approached by the Reserve LEOs and did have the presense of mind to get the girls behind the patio wall when the gunfire started. Grandson was just down the street with his buds waiting to get into the hockey arena and heard the commotion. Since they had all taken an Uber to get there, it took awhile to unass the AO since the PoPo weren’t allowing any vehicles in, only letting people out. I gots to get my children the hell out of that AO. Upon getting the news of all this my daughter turned to me and said “Daddy, I understand more why you keep telling me to avoid crowds and carry concealed…every.where.I.go.”
“…responded by firing multiple rounds from his own firearm, striking Chicka.” Shoot til he thinks he’s dead! Damn shame it took 6 months for the DA to make the right call.
Jackbooted grubermint thugs are everywhere yet the whyte male is the threat to “our democracy”. Prepare
Not sure if my cousins still have Uncle J….’s Nambu Type that he brought back from the Pacific Theater. Probably gone by now since unk’s passing. His kids were prone to do some sketchy sh*t. Got a Compatriot that has his father’s “Jap” rifle and pistol from there. Despite my bud’s monetary situation he refuses to sell the pieces even tho his kids and grands have no interest in them. May show him this article and the going prices…again.
Glad your family was not hit.
A lesson learned that didn’t cost too much, and may keep your Princess & Grands safe in the future.
Having the fertilizer hit the ventilator while one is in the region of distribution can enlighten one and reinforce lessons about proper protection.
Yep. As Ol’ Remus (RIP) (Woodpile Report) was fond of saying, “stay away from crowds”.
And yet I go shopping at Costco…constantly. In my defense, though, I carry…constantly.
And something I vaguely remember reading about the Nambu (especially the later war years ones) was that the way they were designed and built, (something about the sear?) if you even looked at them funny they’d fire. Didn’t have to have your finger on the trigger or even drop them. Best as wall hangers, not shooting pieces. But my memory may be faulty, best to do your own research.
When you come across a gaggle of po-po, don’t threaten to shoot, and then start reaching for a pocket. Unless you’re just begging for “suicide -by-cop”.
Daniel wanted to emulate the latest popcorn craze, “Boom Chicka Pop”. And he got his wish.
The Nambu Type 94 had an exposed mechanism that could very easily discharge when bumped.
The other types were pretty good, if somewhat under-powered compared to 9mm Luger ammo. Pre world war 2 specimens were well made.
