The mainstream media is focused on President Trump’s conversation with Ukraine’s president. The President requested that Ukraine investigate Joe Biden and his son. Prior to this, President Trump had ordered a freeze to military aid.

The Democrats are arguing that this was done as leverage. President Trump argued that he did this on the account that the Europeans weren’t doing their share with aiding Ukraine.

From the Associated Press:

Trump has sought to implicate Biden and his son in the kind of corruption that has long plagued Ukraine. Hunter Biden served on the board of a Ukrainian gas company at the same time his father was leading the Obama administration’s diplomatic dealings with Kyiv. Though the timing raised concerns among anti-corruption advocates, there has been no evidence of wrongdoing by either the former vice president or his son.

Biden said Congress must use its full constitutional authority to investigate Trump’s actions and if the president doesn’t cooperate he’ll leave lawmakers “with no choice but to initiate impeachment.” If that happens, Biden said, it will be a tragedy of Trump’s own making.

The media is in a feeding frenzy over this. However, they don’t seem to be as enthusiastic reporting on then Vice President Biden threatening Ukraine with the withholding of aid money if a prosecutor investigating his son wasn’t fired.

Nancy Pelosi initially was opposed to this. However, growing support among the Democrats, and this new turn of events, made her more favorable to initiating impeachment proceedings.

I will wait to see what the whistleblower and transcript say. It’s one thing to negotiate, it’s another to use the Office of the President to get a foreign nation to investigate a political rival, for political purposes. (Even if you believe there’s something to the allegations against Biden and/or his son, this is something the DOJ takes up, not POTUS, and certainly not eight times in a call while withholding promised military aid.)

Let’s see what tomorrow brings on this one. At the very least, it’s President Trump being naive or foolish, though if there’s ultimately nothing there, Pelosi and the Democrats will look the fool too.

Also, congressional election polls and nationwide polls are not the same thing.

Also, while retirements may provide opportunities for dems, national issues like impeachment can and do influence those opportunities.

A guy like Nadler is secure in a seat he knows a yellow dog could win. He accepts no risk by moving forward on impeachment. He does, however, impose risk on all those in less secure seats.

It is also important to note that the far left of the party is conducting a primary challenge campaign to unseat democrats who are deemed to be insufficiently Stalinist so that the party will lose those seats.

It took long enough. Mueller already had the proof he obstructed justice on at least 5 separate occasions and would have indicted if he had been permitted to indict a sitting president. NSA llkely has all the proof necessary from intercepted communication. It goes to show how pervasive and connected international embezzlement of public funds by politicians around the world and how many politicians do not want that to be the central focus. The two primary mechanisms used to launder money internationally is real estate and media production. So as this played out politicians, several media moguls, and some of the wealthiest people in the world all had a vested interest in making sure money laundering was not the focus of any inquiry. Regardless of wether the impeachment is successful Trump is done. The impeachment proceeding with dismantle his support structure as his henchmen get thrown under the bus and commit perjury/contempt of Congress one by one. There’s a procedure to follow, which is long, boring and thorough, e.g., the Watergate hearings. That was leading up to impeaching Richard Nixon, and he knew it. Rather than face impeachment, he resigned and VP Gerald Ford was sworn in as President. That is the succession line.

If the VP becomes President, he nominates someone to fill the VP seat and Ford nominated Nelson Rockefeller.

President pro tem of the Senate is the US Vice President, and as happened with Nixon’s resignation, Ford nominated a replacement Vice President once he was sworn in.

Pelosi is Speaker of the House unless she is nominated for VP. She does not automatically succeed Pence. Someone else can step into that position, and she is still left out of the mix. She won’t like it, but those are the rules and she has to obey them willy-nilly.

The 25th Amendment gives the succession line: Whenever there is a vacancy in the office of the Vice President, the President shall nominate a Vice President who shall take office upon confirmation by a majority vote of both Houses of Congress.

I’m not sure I’d agree with parts of that, Mail. The trigger for an impeachment investigation can come from a lot of directions, and doesn’t require a formal vote. My guess is that Pelosi is finally signing off on a quasi-investigation by the House Judiciary Committee that, for all practical purposes, has been going on since November 2016. Among other driving forces is likely the fact that committee chair Jerrold Nadler is annoyed because President Trump calls him “Fat Jerry.”

Something that doesn’t seem to make sense to me at this point is why Pelosi would make such an announcement, now, when she doesn’t have the numbers. According to some reports, she has said she has two-thirds of Democratic members of the House who support an impeachment investigation. What’s curious is that while the rules say that a House vote requires only a clear majority to pass impeachment on to the Senate, the two-thirds Democrat support Pelosi has amounts to about 155 which is below the needed 218 or so.

All of which is aside from the fact that a Senate vote would require a two-thirds majority to kick Trump to the curb. Something which is unlikely even in Nadler’s wildest wettest dreams.

Assuming a POTUS indeed did request a foreign government investigate a political rival who had made public statements that a reasonable person might belive constituted admission to a crime under US law, what existing US law would that violate? After all: the Constitution does require that impeachment be for “high crimes and misdemeanors” – which appears to mean that at least a technical violation of some existing law would be required for impeachment.

FWIW: I think we can dispense with any “leverage” claim involving linkage between such an investigation and other aspects of foreign policy as being contrary to US law. Last time I checked, the POTUS had the responsibility to make and conduct US foreign policy, consistent with current US law and treaties (which do require Senate approval prior to becoing effective). Potential foreign military aid not already mandated by existing US law would seem to be in that category – and my understanding is that “quid pro quo” agreements are fairly routine in the conduct of foreign policy.

If I’m wrong in any of the above, I’d appreciate one of our qualified lawyer commenters correcting me.
