Neighbor claims ‘Stand Your Ground’ defense in Pasco fatal shooting, state attorney handling case

PORT RICHEY, Fla. (WFLA) – The man who shot and killed his neighbor Saturday claims it was in self defense.No charges have been filed against 39-year-old Brien Colby of Port Richey.
The state attorney will decide if the “Stand Your Ground” defense applies.
Saturday evening, authorities responded to County Lake Drive around 11:03 p.m. after receiving a call about a shooting.
Part of the incident was seen on the TV show, Live PD.
Investigators said Joshua Ellis, 34, was at his residence arguing with a woman when Colby heard the noise and came out his home to see what was going on.
Authorities said Colby said Ellis was on his property when Ellis approached him and stated he was going to kill him.

Man fatally shoots burglar suspected of taking rims and tires from car, Grand Prairie police say

Grand Prairie police are investigating the shooting death Tuesday morning of a man they say was confronted by another man while trying to steal the rims and tires from that man’s vehicle.The shooting happened around 2 a.m. at an apartment complex in the 1900 block of West Tarrant Road, near Interstate 30 and the Bush Turnpike, police said.
When officers arrived, they found the man in the parking lot with apparent gunshot wounds. He was taken to a hospital, where he died. His name has not been released.
Investigators believe the man was trying to steal rims and tires from a vehicle when its owner heard the sound of “an impact tool” and confronted the thief, police said. The vehicle owner was armed with a gun and shot the man multiple times, police said.

Gun store clerks chase after suspected thieves; hold them at gunpoint until police arrive

MURFREESBORO, Tenn. (WTVF) — Gun store clerks in Murfreesboro took action to stop a group of suspected teenage thieves.The incident happened Tuesday at Bullseye Gun, Gear and Pawn on Shelby Street.
The suspects entered the store, grabbed two weapons and fled from the business. The clerks, all armed, chased after them and got them to surrender.
The clerks held the four suspects at gunpoint until Murfreesboro police officers arrived.
Most of the ordeal was seen on the business’s surveillance video.
The suspects had reportedly stolen from Bullseye earlier this month – and this time the clerks were ready for them.

Either that or he is still searching for the one in the world that is the death of any confirmed bachelor. “At last I have truly found a girl that I adore, she’s deaf, dumb and blind and owns a gun and liquor store.” Don’t see a pistol on this one though.
Now before some of you folks jump on your soap box and start preaching as to mixing guns and alcohol. Having thought this over, I do not advocate excess drinking be mixed with gun use. With this in mind, in the case of having a Gun store one has access to many exotic type of guns and ammo but price and target quality (paper) leave much to be desired. On the other hand, Liquor store, one has large supply of reusable targets, empty beer cans in which case, unless it is Blatz or Balentine, it is ones responsibility to dispose of the contents prior to target practice, moderation is stressed. Since your betrothed also owns farm acreage out in the sticks there are no range restrictions and if beer disposal container becomes full, the third tree on the left is site for draining the container.

On the seagull that keeps showing up on various threads. I just try to consider the source and ignore it. It is just a waste of keyboard typewriter ribbon ink and bandwidth. Yesterdays winnings seem to be a case as to future income as results seem to be quite a distance away. I was watching LivePD and saw the Florida incident and wondered if that was it when I saw the headline here.
They purposefully didn’t show the guy who was shot and IIRC, they stated he was still alive at that point. They did show however the run to the scene, and the officers taking shooter away in cuffs. Sticks wondered aloud if the shooter had been doing CPR on the guy due to the pattern of blood on the man’s hands (visible as they led him by the cameraman).
Didn’t read anything as to CPR but shooter is said to have covered the wound with his hands in a attempt to stem blood loss, either way the shooters hands would be covered with blood. Wonder how one in a situation like this could glance at blood covered hands and tell as to CPR or covering wound to decrease blood loss. As to the four stealing guns, doubt the cops find any previous stolen property as are most likely on streets already. Oh well just 4 more that will eventually reach streets again for future features here.
At least around here, most gun store employees are encouraged to carry. Robbing a gun store is VERY high-risk.
The Florida case sounds like simple self-defense. Not a SYG case.
Thieves seemed to have had good “barracks lawyer” info. Don’t bring a gun with you, just snatch and run. “They can’t legally shoot you for just grabbing the guns… a 2nd degree felony, you’ll be out in no time with just street cred’ to your name”.
Definitely agree the guns were sold for cash within hours.

Reisin O.C., 2 chests full of medals, 2 name tags, lots of claims to fame including CIA (how low can one go).
Posts are screened by Higher, Outcast, especially ones mentioning Stolen Valor. It’s pretty safe to say Dave has had eyes on your comment, and will act accordingly. Thanks for the head’s up.
Long as it gets to those that watch and investigate stories to fuller extent, I wander around but do not wish for investigative qualifications as is better left to those who possess those skills.

RE: Port Richey, FL story.
A state attorney doesn’t get to decide whether “stand your ground” applies.
“Stand your ground” is an affirmative defense which means that if arrested or charged with a crime, the defense can make a motion for a stand your ground hearing.
The state attorney can decide whether the shooting was in self defense, but not “stand your ground.”
The fact that the Sheriff in the article gets what the law is wrong is troubling as well. It just isn’t that difficult.
