Fort Riley Soldier Attempts to Meet 16-Year-Old, Gets Charged

An active duty Soldier exchanged messages with a 16-year-old. Included among the messages was a request for sexually explicit photos. He made plans to meet her, then carried those plans out. However, when he got to the location he was expecting to meet her at, he met a deputy instead.
From Baxter County Sheriff:
A Sheriff’s Deputy set up surveillance at the location. At approximately 12:47 AM, he observed a vehicle drive past the area twice, then pull in and park. After parking, the man sent a text message to the girl stating he was close by. The man then walked from his car along Highway 5 South past the girl’s house, then to the meeting location. The man went behind the building. The deputy then approached and made contact with the man, who was identified as 31 year old ANDREW MITCHELL O’BRIEN of Junction City, Kansas. After a brief exchange, ANDREW O’BRIEN was arrested and taken into custody. His vehicle was then searched. Deputies found handcuffs, vodka, condoms in the vehicle, as well as two cell phones believed to have been used in commission of the crimes. All of these were seized and taken into evidence.
If this guy is infantry, and given his rank, he may have been a squad leader. He’s not junior enlisted. He also may have more than 10 years in the military. Fort Riley’s Military Police has a detainer on him.
He’s going to show up in circuit court on December 20, 2018. If the Judge releases him, it won’t be long before the MP’s talk to him. His future isn’t looking bright. This won’t be a Christmas season that Andrew O’Brien will want to remember.

I do not see that he knew that she was 16. It does say that she sent him sexually explicit photos, though.

Reprehensible conduct on the guy’s part? Yeah. But I’m not sure this case is strong enough to result in a felony conviction.

Sounds like this cockbag should be shot. Due process should be followed, of course, but if the evidence really is the way the article presents it, it’s pretty damning.
Yeah, I’m a bit jaded, given the very negative experience of a dear friend’s son a few years ago who was hammered in spite of clear evidence that his intentions were honorable. (He was a little slow, was trying to help a young girl being abused by a relative, which she confirmed, and there was less than 2 years difference in their ages. The shame of it all led to his suicide at age 19. Sad.)
Fine with me if the book is thrown at him, assuming it’s all true. For instance, did he know she was under age? Looks like he thought he was hooking up with a 16 yr old. If not, then something weird is going on.

Everone mentioning the age of consent in Kansas. This goober traveled to Arkansas to meet the girl. From what I understand the age of consent in Arkansas is also 16, but there’s also lots of dads with shotguns, shovels, tarps, trucks, and access to a national forest.

(1) Class B felony for the first offense; and
(2) Class A felony for a subsequent offense.
(b) Any parent, legal guardian, or person having custody or control of a child who knowingly permits the child to engage in or to assist any other person to engage in sexually explicit conduct for the purpose of producing any visual or print medium depicting the sexually explicit conduct is guilty of a:
(1) Class B felony for the first offense; and
(2) Class A felony for a subsequent offense.

My generation was fortunate, in one sense at least. There was no internet, or cell phones. We didn’t meet women online. We relied on the hooker population that existed just off base, or women we met in person. Had the guys I served with lived in today’s world, I suspect a few would have fallen afoul of the law via internet hookups.
Regardless of any civilian prosecution, this soldier’s career is done like Christmas dinner.
