Anne Arundel Police serving order to remove guns shoot, kill armed man- Updated

A relative of the man fatally shot by Anne Arundel County Police Monday morning says the incident stems from a family dispute Sunday night.

The woman who asked we not identify her says, the family was fighting over the care of an elderly grandparent. It’s during the argument, the relative says, Gary Willis made a comment that prompted another member of their family to seek an emergency risk protective order.

Maryland’s “Red Flag Law” took effect at the beginning of October. Under the new law, someone close to an individual can petition a court commissioner to issue a protective order that allows police to take a person’s firearms should they show signs of being a risk to themselves or someone else.

Within its first month. one-hundred-fourteen ERPOs had been petitioned in Maryland. Mark Pennack the President of the organization Maryland Shall Issue says, “This has disaster written all over it.” One neighbor said, “ I didn’t even know about the new law…He (Willis) probably didn’t.”

And just like that, a man is dead because of a comment and the “Red Flag” law in Maryland. No investigation, no probable cause, just a phone call from an irate relative. The Police showed up at the residence at around 0500, demanding Mr. Willis’ firearm. At first he complied, then he retrieved it and a struggle ensued. His firearm discharged, striking nothing, and then he was shot and died at the scene. This is truly frightening. Thank Governor Hogan for enacting this horrific law- it needs to be challenged immediately before more citizens are shot dead in their own living room.

An Extreme Risk Protective Order is not a protective, or stay-away, order. It’s sole purpose is to authorize gov’t agents (i.e., police) to seize guns and ammo. And one of the stand-alone bases for issuing the order is an allegation that the person at issue abuses alcohol. Another is ‘an alarming statement.’ Holy Shi’ite. Read it yourselves. Here you go:

Another account relates what has to be the police version of events. They knocked on his door. He answered with a gun in his hand. He put it down. Matters got heated and he picked the gun up. A struggle ensued. A round was fired. He was shot. Me, I want to see the body cam video.

About fifteen years ago I entered into an agreement with some friends.
Should you be in danger of losing firearms call us. We will take them and keep them secure until you get due process. Local cops like it that way.
Only had to do it once but that was enough to make it worthwhile.

Real estate is reasonable, a boat load of jobs begging for applicants, a major AFB that is very BRAC Resistant. ATL Airport 45-60 min up the road. Mountains 2 hrs north, ocean beach 2 hrs east. Strong Vet presence and VA Med Centers. Trophy deer hunting and bountiful gardens. Misters Carrier and Trane help alleviate the weather problem of summer. Some cities even require you to own a firearm. Just keep driving south past the big chicken.

Ed, Google “Hot Springs Village.” Sadly, so many military retirees overlook Arkansas. It’s a shame because it’s beautiful over on our western half of the state: mountain ranges with excellent hunting, lakes everywhere with good fishing, and genuinely good people. Housing is unbelievably affordable.

We made a drive here from the New Mexico skiing resort town where we had lived eight years and were absolutely stunned by the natural beauty of this huge gated community, 14 miles across and the largest in the US.

We’ve been here five years and absolutely love it.

First moved to Hot Springs Village in 1988. Had to leave because of my job 4 years later. Stayed in the area and visited occasionally. Moved back 3 years ago and love it. The lifestyle here is fantastic. Quiet, peaceable, and secure. This a gated community of 40 sq. miles. The police here help you. They realize this a retirement community. Very little crime here. People keep there property up.

Population, traffic, real estate prices and taxes are just getting worse. GA is bearable as long as you stay out of the cities. Columbus has really gone libtard yuppie demon rat plantation, and with the tread heads at Benning, there’s more GIs for the locals to fleece. Need to be at least 1 county or 35 miles out from any “metro” area to be away from the riff raff. Don’t even consider anything within 60 miles of ATL. North GA is getting eat up with rich yankees building retirement homes, driving up prices. Surprisingly an area most folks don’t even think about that is a good place to retire is Nebraska and S.Dakota. Winters can be brutal, but there’s a lot of folk that think like we do. Good Luck.

These new “Rules/Laws” need to go before higher courts. This is Guilty until proven innocent. Once they have your guns, forget it, they are gone forever. They will end up either on the street or in some cops gun collection.

We had a State law in Washington that determined long ago, the State alone will establish all laws regarding weapons issues and not local authorities. The purpose was to have one standard Statewide instead of different ones in every county and municipality. It worked.

Then a city on the Left and liberal side made their own ordinance concerning securing weapons in a fashion making them pretty much null and void for home defense and holding owners responsible for their weapons if they were stolen. In fact, it is on a Statewide Initiative today as I-1639. (Hoping it fails as do most all in my part of the State.)

But when the local city law was challenged by the NRA it was overturned, citing the standing State law, giving preeminence to the State over lower governments. Then on appeal, the liberal court upheld it and now it is one hell of a mess.

This is where things are heading. If liberals cannot repeal the 2ND Amendment, they will institute state and local laws such as these.

Any pissed off ex-wife, butthurt neighbor or the mailman or anyone can call and claim fear of their life, not due to actual threats but only their emotional upset at not getting their way.

And when enforcement comes, absent more than hearsay, things can go sideways in a hurry. I agree this man should never have put his hand back on his weapon. It showed intent, but without bodycam footage, we will never know. What I do know, is a family has a dead member over nothing more than an internal family problem, caused by bad and in my mind unconstitutional laws of an anti-American State.

Reading the requirements, it can’t just be a neighbor (relative, roommate/cohabitant, doctor). Contrary to news story there is a lot of paperwork to fill out, so whomever made the complaint knew what they were doing. The complainant needs to appear in court, and within 7 days the “victim” gets to dispute the order in court…guess that won’t happen.

I am not anti cop. I am however anti storm trooper. I do not believe in no knock raids, or searches without warrants. Many people have died or been injured by police who feel the must roll out the SWAT team for calls that do not require such a response. My neighbor’s kid got into a drunken fight with a friend of his and the cops showed up with a 20 man squad. Had they listened to his mother they could of found his passed out ass in his room. Never overlook that old admonition to, “Follow the money.” You can bet your ass that 20 man roll-out will be factored into next year’s budget proposal. More high-personnel roll-outs equal more justifiable increases in the coming year’s budget needs.

A number of states have enacted similar laws to Maryland’s and I admit to knowing nothing about them until today. It all started with Connecticut and, at first blush, it appears to be little used. Of course, “little” is a relative term and if the police came for my guns based upon someone’s say-so and nothing else, it wouldn’t be little to me. I mean to look into this. This is nasty stuff.

It strikes me that there’s a due process element missing here. If I read it correctly, the law suggests a judge or some legal commissioner gets to decide if a person is a threat to him/her self. I always thought that a psychological eval was required to substantiate such a claim.

It goes on to suggest the respondent may or may not get a hearing before a decision is made.

The story doesn’t say how things played out on how quickly the order was issued to the time it was carried out.

Review social media and internet posts for a year? I’m not sure how that’s possible without violating all kinds of rights.

In fairness to Hogan the bill was sent up with veto proof majorities in the Maryland House and Senate (93-46 & 31-13). The population also overwhelmingly supported it as well (over 85%). Going against the bill would have achieved nothing other giving his opponents in the election ammunition.
