Monty Grow sentenced for Tricare fraud
The Gainesville Sun reports that former NFL linebacker, Monty Grow, was sentenced in Miami for defrauding the government’s Tricare program of $20 million.
Grow, 46, indicted in 2016 in a Miami federal court, faced a maximum 36-year sentence for 52 charges.
Grow was sentenced to 262 months of imprisonment, or 21 years and eight months, and ordered to pay $18.8 million in restitution.
According to court documents, Grow solicited and received kickbacks, or negotiated bribes, for Tricare beneficiaries who ordered medications between September 2014 and June 2015.
Some of the charges Grow faced included five counts of money laundering, eight counts of health care fraud, conspiracy to defraud the U.S. and 28 counts of receipts and payments of kickbacks in connection with a federal health care program. He was convicted on 17 counts in February.

Also in February, the court ordered Grow to forfeit property that includes his 2014 Porsche, which was seized in 2016; about $1.7 million from his Bank of America account, and nearly $1 million from his company, MGTEN Marketing Group.
Talk about squandering opportunities, Grow played for the Jacksonville Jaguars and Kansas City Chiefs for two seasons before he decided on a life of crime. I hope it was worth it. Shane Matthews, who played for the NFL for fourteen seasons was sentenced to three months in jail for his role in Grow’s scheme.
Court documents say through MGTEN Marketing Group, Grow received nearly $20 million in kickbacks from Patient Care America, a Broward County compounding pharmacy, in exchange for recruiting and referring patients to the pharmacy who were covered by the Tricare health care insurance program.
In all, Tricare paid about $40 million for the medications for its patients to PCA. PCA, which contracted with Grow, paid him half the reimbursements. Grow kept about $10 million for himself and paid his team of sales representatives the remaining amount, according to court documents.

Thanks Claw, I was trying to be conservative! My phone company retirement isn’t even that much a month and I spent 37 years with them! But at least I can sleep at night. He also has my grandfathers Winchester 30/30 lever action, octagon barrel that he used to carry when he drove a stagecoach from Burns to McCoy in Colorado!

And Monte Hall had no part in this! The case was prosecuted by Assistant United States Attorneys Kevin J. Larsen and Jon Juenger. A jury convicted the dirtball of 18 charges in February and United States District Judge Federico A. Moreno kicked his ass in sentencing him. I likes it! BTW, eight co-conspirators also got nailed. The US AG commended U.S. Army CID for its part in the investigation.

Ah, but the question left unanswered – indeed, the most vital question of all – is this:
Will he have to do The Full Monty?
OK – please don’t misconstrue this question as defending this dude at all – I trust that he was being – at the very least – unethical and obviously criminal. And I confess that these intricate fraud schemes quite often escape me – I guess I am too honest by nature to grasp the concepts. (Or too stupid… I accept that possibility too.)
So can someone explain to me how what he did was criminal? As I understand it, he was recruiting people to bring their pharmacy business to a specific pharmacy, for which the pharmacy was paying him a portion of the money they received from Tricare for their business. Seems to be what pharma reps do for a living – convince medical providers that what they are selling is the best way to cure something, and/or that they can provide something better/cheaper than their competitors, and being reimbursed for their efforts.
Again – not trying to justify or defend. I would honestly like someone with some legal acumen to help me understand.

Kickbacks and bribes are illegal payments. He managed to get $20 million that way.

Here you go. Kickbacks. Money laundering. It’s all there, through the link. He was convicted by a jury of 18 separate charges arising from the scheme. It is never okay to induce people to use a specific pharmacy or to request specific drugs when the inducer is giving or receiving a kickback. There are no finders fees in these transactions.
Thanks 2/17 – you are right. Reading at your link laid it out a lot better for me. He was not just encouraging people to move their pharmacy business to a specific pharmacy (as do pharma reps). This is the money quote that made it clear to me:
Defendant Grow enticed Tricare beneficiaries to order very expensive drugs that they did not need. Tricare, not the patients, paid the bill for these expensive drugs and the pharmacy split fifty percent of the profits with Grow. Evidence at trial established that Grow targeted Tricare beneficiaries and induced them to order expensive drugs they did not need by paying them either directly for their own prescriptions or indirectly for those of their family and friends. As a result of the fraudulent scheme, Grow received nearly $20 million in kickbacks from a Broward County pharmacy.
That goes a bit beyond salesmanship.

But this does illustrate what I always say about criminals – if they worked as hard at coming up with honest ways to make money as they do creating scams like this, they would be successful businesspersons and not convicts. It took some seriously creative out-of-the-box thinking to come up with and engineer this scam. Just think if that thinking was applied to something legitimate!

Racketeering and conspiracy comes to mind, as well as the Tricare charges.
They were using bribes and kickbacks to solicit tricare members to give up their ID’s and using the ID to bill expensive pain and scar creams that were not medically necessary nor ordered by a physician that actually saw the patient. Similar happened with FEHBP program as well. Chasing crap like this is why I’ll always have job security (unfortunately).
