A reminder; Lars Larson Show

| January 29, 2018

Just a reminder that MCPO will be on the Lars Larson national radio show tonight at 7:20 Eastern Time.

Some of you may remember that Lars was a fellow-defendant with us in the 166-page Bernath v. Hyatt, et al. lawsuit a few years back. I’m sure he’ll have something to say about that.

You can listen at the link above.

MCPO NYC USN Ret.

If you call in, keep it pithy and respectful.

Thanks all!

Tallywhagger

You sound like you have had some public relations experience! /sarc It was a good interview, at a good pace, you have a good voice, even up against a radio pro.

It’s satisfying to have someone finally get a word in, edgewise, against a despicable vexatious litigant.

If you have another opportunity to do a segment with Lars, or whoever, it would interesting to hear some data about the costs that Bernath inflicted against adversaries, real or imagined.

I know Don & Diane have spent a bundle but so have Jonn, you, and all other named “defendants” caught up in a delirious lawfare against a LOON!

ps If there was a call in segment, I did not discover it.

The Bernath Phenomenon has the content for a book or even a film.

MCPO NYC USN Ret.

We will be back on, I am sure once investigations are done. I did not want to speculate, although one thing is clear. He was pilot in command of the aircraft. The bush, nails in driveway, Ninjas and unknown screen names … none of those things killed him. As pilot he … as I said on Lars …

Great show! Maybe he can help with my POS brother David “Doc” Shrum? One can only dream can’t he??

Thanks!

Good show, Master Chief. I wish there had been more time to go further into it.

MCPO NYC USN Ret.

Give it time Betty, how is the weather in Iowa?

Ex-PH2

Wait – what? Betty?

You’re chowing down on someone else’s cooking? Someone named Betty? Betty Crocker, huh? Well, she and I are going to have words with each other!

Atkron

Master Chief, are you cheating on our resident photographer/culinary genius?

Graybeard

Uh-oh. Busted!

Ex-PH2

Current weather is 18F and clear, 75% humidity, wind is from the northwest at 4 MPH.

Dan Hyatt

I personally spent over $20,000 out of pocket defending against the 8 Bar Complaints he filed against me. I am actually sleeping much better now that he’s gone. Always worried he would refocus on me, but many thanks to Seavey, the Shipley’s and the TAH gang for incurring his ire, which took the heat off me

MCPO NYC USN Ret.

Sleep well Judge!

Tallywhagger

Judge Hyatt, I’d guess that he regarded your domain as his last realm to participate as a para-professional. My Dad reminded me to not get between a man and his money. The idiotbastard Bernath became so paranoid as to be unable to distinguish between adversity and business as usual.

I have to admit that I was somewhat impressed that Bernath was able to pass the bar exam, a second time. So much for the validity of base standards!

If MCPO, Don & Diane, Seavey, Jonn and others get together and quantitize the cost of dealing with a loose canon on deck… just image the cost to YELP or whoever it was that DeadDan tried to work a class action extortion pogrom, against.

How much was John Kerry’s running mate, John Edwards, of the same character as Bernath? For Bernath, winning had become a measure of inflicting harm as revenge.

MAY all of your nights from here on out be restful and peaceful, Your Honor. I’m sure that D. Bernath’s passing is a relief for all of those he bullied and tormented via the legal system and those of us who looked forward to his next incarceration (me included) I say this: In this life, many receive only the law, sometimes one has to wait until the next life until one receives Justice.

rgr1480

Hi Judge!

What are our lawyers up in your neck of the woods saying about the recent decrease in the population of Florida?

Probably humming a happy tune …

GDContractor

I hope HS Sophomore survived all this bullshit. I always felt bad that he, and presumably his family, got caught up in it.

Just An Old Dog

Pretty sure he did. Perhaps he’s moved on to other teen endeavors such as sports and chasing skirts instead of hanging out with us old fuddy duddies.

“Here’s MCPO NYC USN once more, HE SHOOTS, HE SCORES YET AGAIN…”

MrBill

You are helping to write, accurately, the final chapter of the sordid saga of Daniel A. Bernath. Well done, Master Chief.

MCPO NYC USN Ret.

If we had not been in touch with the press as this story was developing, the would have been about a poor old sod who crashed his plane.

The story is about the skills of the world’s worst lawyer and how in the end his abilities as a pilot helped right his crash and burn legacy.

Sad thing is he may never be identified, named as a subject or held to account (even in death) for his most serious crimes.

rgr769

Danny Boi’s tombstone should say, “He was one cray-cray mofo.”

Tallywhagger

I’d only ask, did he ever clerk for a judge? The stuff you don’t know when you graduate from college or pass a professional exam is there, despite your limited acumen.

Apprenticing yourself to a journeyman is invaluable. Just ask any soldier or sailor who has had to train a genius and protect him from his self.

Just An Old Dog

From what I understand from his history he worked for a Disability Advocacy Law firm for a while in Oregon as a legal clerk helping put together cases while he was in limbo.
After he was shot down by the Oregon Bar he simply paid his fee to activate his license in Ca.
SSDI doesnt require you to have a Law Licence in the state the SSDI claimant comes from.
He let the place where he worked at ( where he wasn’t very well liked) and started stealing their clients, all the while putting up fake shit about the attorneys that worked there.

MCPO NYC USN Ret.

He sued the guy he clerked with! Seriously, he did.

Tallywhagger

Now that is totally Bernathian!

Socio-pathic-son-of-bitch.

A Proud Infidel®™

Yeah, I remember reading about how he created quite a fair share of enmity by running around “Poaching” other SSDI Attorneys’ clients.

rgr769

It is highly unlikely Bernasty ever clerked for a judge or another lawyer. Any clerking he did was most likely performed at the 7-11 or an AM/PM. I clerked for an attorney who became a judge; I learned a great deal about being an effective attorney from that man. It was experience my law school contemporaries who didn’t work at a law firm never had until they were lawyers for several years. Had the departed one had that kind of first hand experience as a law clerk, he likely would not have behaved like a lunatic in a courtroom in front of a judge.

rgr1480

Great Caesar’s Ghost!

He actually did that?????

rgr769

Surprisingly, they spend little or no time teaching courtroom decorum in law school. The only course I took which touched on it was a trial advocacy class where we did a mock civil trial, and that was an elective class. I learned how to behave in a courtroom by watching the skilled lawyers for whom I worked and other lawyers, many of them screwing up in front of a judge. So I learned what to do and, most importantly, what not to do. Act a fool in court, and you are not going to like the outcome. The Departed One never learned that. I especially enjoyed reading about his antics with the Calif. State Bar.

spyhunter

My long-term opinion of Bernath is that after his incarceration there was a high probability of suicide as the period if his incarceration was not long to have a therapeutic effect or reformative effect on him, and the clinician who evaluated him, and the court who released Bernath early as largely at fault by which I feel that there is probable cause to rule this a suicide by a .38 SPL revolver shot to the head just before his “mayday mayday” Swan Song or twisted Aria

He really needed to serve the full two years, and the time in Mayland, then Missouri, and then even more time in Florida.

This mental status on his return from Norfolk to his house in 1/19/2018 was observed t be compromised, and there was his “self-murder rant” that stunned most f the days 20th and 21th and ten several dozens claim that his fuel supply here being tampered with.

OAE CPO USN Ret

“…and there was his “self-murder rant” that stunned most f the days 20th and 21th and ten several dozens claim that his fuel supply here being tampered with.”

Huh? I think your auto correct is on the fritz. Care to translate that?

MCPO NYC USN Ret.

What is the serial number on your spyhunter ID card? I am going to check you out?

IDC SARC

“there is probable cause to rule this a suicide by a .38 SPL revolver shot to the head just before his “mayday mayday” Swan Song or twisted Aria”

he shot himself in the head and then transmitted a Mayday call!?! Ummmm….gotta say, that is not likely.

IDC SARC

spot on 🙂

HMCS(FMF) ret

WTF are you trying to say, dude?

And, where are these recent”self-murder” rants you talk about?

Just An Old Dog

There is a guy claiming to be Bernath’s “Brother” whining on the News Article about how the report is unfair to him and the comments are uncalled for.
He was saying people should be more respectful and take into consideration the grieving daughter who was contacted by police and was told they would need dental or medical records to completely ID her father.
I’m not saying that I want the process of grief to be extended but her piece of shit father had no qualms about going after the Hairs wife and daughter, both via vile harassment and lawsuits. Not to mention accusing Jonn’s wife of elder abuse and stressing out Mrs Seavey while pregnant with twins.

OAE CPO USN Ret

Do you have a link to that article? I’m curious if Bernath’s “brother” tYpEs LiKe SoMeOnE wE kNoW.

Just An Old Dog

http://www.nbc-2.com/story/37343996/pilot-in-fatal-crash-was-on-probation-accused-of-stolen-valor#vuukle_div

In the comments section someone who identifies themselves as “Milo Odell” made comments about how the media wrote the crash up. His comment was too coherent to be the WItLeSSonE41.
He mourns the “loss of a brother” but I think he was probably a relative by Marriage or perhaps whatever version of a “friend” that cock-knocker Berdscum had.

OAE CPO USN Ret

Thanks for the link.

MCPO NYC USN Ret.

No mention of what he did to me, my family and the numberous Investigations and inquires.

He did one thing with purpose, that put my son a risk and cause his photo to be viewed on the Internet by ch!id p0rn troll.

He was pure evil. Not crazy. Just a criminal.

Graybeard

You are a better man than I MCPO.

I’m afraid I would have killed him and told God he died, if he put one of my kids at risk.

MCPO NYC USN Ret.

I stuck to my game plan. The truth always wins in the end.

Ex-PH2

Okay, this has to be a REAL faker, big time. Bernath posted online some place that his brother died in 1973.

I’d take this claim with more than just a grain of salt.

OAE CPO USN Ret

Yep. Here’s the post by Dan regarding that bit of info too.

http://cessna170.com/forums/viewtopic.php?f=5&t=353

Tallywhagger

Typical Bernathian fashion, Mooney has never produced multi-engine aircraft.

OAE CPO USN Ret

Danny couldn’t remember to keep fuel in a plane, so I don’t expect that he’d remember the number of engines.

However, it appears there was a prototype twin engine Mooney that never went into production. https://mooneyspace.com/topic/14032-1958-mooney-m22/

OAE CPO USN Ret

So I just searched the NTSB Database for plane crashes in Metamora Michigan between Jan 1, 1972 and Dec 31, 1973 (Yes, 1972. I fat fingered during the date entry)

Anyhoo, I got a single hit for a plane crash in Metamora Michigan. May 13, 1972. According to the report, the pilot was 27 years old. And Dan says in that cessna170 forum that his brother was 27 when he died.

Great interview. Well done, well done.

Ex-PH2

Which daughter was contacted about him?

He had children by another wife he divorced when he ran away to Oregon from California, after being disbarred for embezzling SSDI client settlements.

So which daughter is this? The name of the daughter from Oregon is Nicole.

rgr1480

“I knew he crashed, but he never even really talked about it with me,” said Melanie Diferdinando, Bernath’s daughter. She says Bernath was a registered sport pilot and started flying in 2011.

https://www.winknews.com/2018/01/25/bonita-plane-crash-victim-involved-wrecks/

The latest Tweets from Melanie DiFerdinando [redacted]. Towson University. Baltimore, MD.

Ex-PH2

Yeah, well, that’s not his Oregon daughter from his second marriage. Her name is Nicole and she hated him.

I’d view this “tweet” with suspicion.

Just An Old Dog

Bernath has 4 daughters. 3 from first Marriage and 1 from current wife.
It’s been known who they are for quite some time. People in the SV community realize that there are also people who follow these stories that go way overboard.
In a way the SV community thought more of and protected Bernath’s daughter more than he ever did. Dennis Chevalier, when he was a follower of the Hair made it a point to be really nasty to family members.

HMCS(FMF) ret

First marriage – the one that the Oregon state bar called him out for being a deadbeat dad… for failing to pay child support to his ex-wife.

I wonder how he presented that relationship to his three daughters…

Just An Old Dog

Actually he was suspended by the California Bar for failing to pay child support.
The Oregon Bar denied his application because when he filed for his licence there he failed to disclose the suspension, and several other things that he had done in Ca that got him censored.

A Proud Infidel®™

Oh, the Oregon Bar had a gracefully long list of reasons why they denied entry to him.

Just An Old Dog

The piece of dog shit got off easy. Despite the metric shit ton of stunts he pulled his main reason for disbarment in California was because he was soliciting clients for his Yelp suit while his licence was inactive.
