Judge blocks military transgender ban
Chief Tango sends us a link to The Hill which reports that Judge Colleen Kollar-Kotelly of the U.S. District Court for the District of Columbia ruled against the administration policy which blocked the Department of Defense from recruiting transgender people for military service;
“The court finds that a number of factors—including the sheer breadth of the exclusion ordered by the directives, the unusual circumstances surrounding the President’s announcement of them, the fact that the reasons given for them do not appear to be supported by any facts, and the recent rejection of those reasons by the military itself — strongly suggest that Plaintiffs’ Fifth Amendment claim is meritorious,” she wrote.
I’m not sure how the Fifth Amendment applies. It states;
No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.
As it is with most liberal defense of their behavior, I think they’re just making shit up again.
“This is a complete victory for our plaintiffs and all transgender service members, who are now once again able to serve on equal terms and without the threat of being discharged,” Shannon Minter, NCLR’s legal director, said in a statement.
“This court saw straight through the smokescreen the government tried to create to hide the bias and prejudice behind Trump’s change in military policy,” added Jennifer Levi, director of GLAD’s transgender rights project. “This clear, powerful ruling confirms that there is no legitimate reason to exclude transgender people from military service.”
The “change in military policy” just altered the policy to return to the same way it existed last year – for 240 years. It’s not like transgender people were legally able to serve openly for centuries until this president came along.
The judge did, however, deny the plaintiffs’ motion to force the government to pay for reassignment surgery – the real reason that they want to shove this whole charade down the throats of the American taxpayers.
Despite the judge’s denial of the injunction on the ban for surgical funding, Minter and Levi told reporters on a conference call that transgender service members will be able to receive all medically necessary care. They clarified that this is because the end of the ruling says the military’s policy will “revert to the status quo” before Trump policy, which includes covering surgery.
Yeah, well, reverting to the status quo would be reverting to the pre-2016 policy, the same policy that existed for the first seven years of the Obama Administration.

It would seem to me that those folks who don’t know what bathroom to use are hardly qualified to be in our Military. Something about fitness and readiness for deployment come to mind. These pussies cant’ find their own bums or remove the pacifies glued to their mouths, so how can they possibly be mentally ready and stable to Serve?
Its all a moot point anyways because these assholes only want to join for the medical benefits and hopefully recruiters are smart enough to pass them by. If they want to serve, then they must have completed all necessary surgery, psych eval and hormone treatments as well as anything else attached to “gender-assignment” before they are even eligible to set foot in a Recruiters office.
They know what bathroom to use, it’s people like you who refuse to let them use it.
As far as “only wanting to join for medical benefits”, none of the soldiers currently serving joined with any expectation of benefits, because openly Trans people have NEVER been allowed to join.
Those currently serving met all the same standards you did, and have served honorably without the expectation of medical treatment. However, just as it is wrong to kick soldiers out for having tattoo’s on their hands after being told it was okay, so too is it wrong to show Transgender troops the door for the same thing.

it is not “wrong” to enforce any policy. not liking a policy does not make it wrong. The goal is readiness, and the military has a readiness problem, like it or not.
And yes, this is about free healthcare. Deal with it or don’t, but the focus of the suit is on medical care.
A curious fact I discovered upon assuming command during the Bush II regime was that I inherited five HIV positive sailors (all male but read into that what you will)…I got a special read-in from a hospital administrator ….DON and presumably DOD policy was they could ride it out to retirement as long as they stayed on their meds and didn’t develop AIDS..but none of them were deployable….made absolutely no readiness sense and I believed then and there it was a harbinger for further changes in DOD about gays…what I never, ever anticipated was that transgendered would be the next “successful” milestone…I’m simply at a loss that my Navy can’t even drive ships anymore (except aground or into each other) and has to deal with this latest SJW (Social Justice Whiner) distraction…because, you know, everyone has a “right” to serve

Don’t join the service and then 90 days later decide you don’t like what’s between your legs or on your chest and now you need medical attention because you are just so unhappy and need to be free to live an “open life” as something that you were not born as and expect the government to pick up the tab for your frankenstein operation and then your life long Therapy session.

Negative, Actively serving troops recieve healthcare for all conditions. Pre-existing or not. Additionally, if the condition was first diagnosed while in service, it becomes service connected. I’ve seen this applied to even genetic conditions.
I had a pre-existing hernia, discovered in MEPS. Disqualified me from enlistment. Got it fixed on my dime, enlisted with no problem. 2 years later, blew out the other side. THAT one was repaired by Uncle Sam.

That depends on the condition actually. People can similarly be separated for preexisting conditions. Especially if the preexisting condition is a mental, functional structural condition that is chronic and has no reasonable expectation to be resolved.

There are already a bunch of psychotropic and other drugs the use of which disallows enlistment. What’s the big deal? We all know that a female taking massive doses of stuff following cancer would also be disqualified from service, as are males who have had prostate/testicular cancer.

Disqualified for taking hormones? Do you have any idea how common hormone therapy is outside of the Transgender and Cancer treatment.
I’d be willing to bet THOUSANDS of soldiers are prescribed hormone treatment for various conditions outside of those transitioning.

Except those treatments have an acceptable benefits/risk ratio, because the patients are actually quite ill…or safe enough, i.e. birth control that there is minimal disruption to the hormonal axes and have been proven so, because there is a huge amount of data to support it.
No one is ‘confused about which bathroom to use’. These trans* people use the correct one – that is, the one that matches their identity.

Gender in the human species is, by biology, a genetic construct of the sex chromosomes XX or XY.
Unless and until we learn to swap those chromosomes out, gender remains a biological fact. You can role-play the other one, it is a free country after all, but you cannot ignore the consequences of ignoring reality.
IDC SARC has repeatedly posted medically sound opinion on this situation, and why transitioning folks are -not- suitable for military service. The “No! Gender is a social construct!” denials have yet to refute him, in the slightest.
Folks actively transitioning are medically non-deployable. Folks who are intentionally and long-term non-deployable have -no- place in the armed forces.
The purpose of the Armed Forces is winning our nation’s wars, and deterring enemies. It is -not- some sort of fraternity or social advancement program.
Once upon a time, an idiot named McNamara thought it prudent to “rehabilitate” one hundred thousand very-low-IQ folks, by enlisting them and sending them into combat.
It was a disaster. It was an umitigated stupidity that killed many, many people, especially the folks it was supposed to help.

Two comments on this:
1) Let’s say this person get captured in the next shooting war. Where in the Geneva Convention does it specify special treatment for Trannies? Does someone really think the enemy is going to continue hormone treatment? That’s saying the next war is with a country or entity that signed the treaty.
2) It is well past the time that the checks and balances that are outlined in our Constitution are applied to the Judicial Branch. The Congress has the ability to Impeach (House) and Try (Senate) these judges. (For whatever crimes and misdemeanors these jackasses may be committing behind the scenes.)
They expect to be non-deployable during their treatment – we need more Rear-D soldiers, because there ain’t enough now.

Judge made the right decision on this one. The trans soldiers serving openly were only doing so because they were give the go ahead by their command.
The possibility of their careers being ruined because of said policy being rescinded is just plain stupid.

This has been a discussion on TAH dozens of times before including some detailed drill-downs into gender dysphoria as a form of mental illness. And every time some new aspect comes up, such as Kollar-Kotelly’s strange spin using the Fifth Amendment, the discussion has to start over again at the Barney level because the LGBT community insists on playing the emotional victim card. It’s like talking to Palestinians.
What’s also demonstrable is that the original Obama decision to open the military to transgenders had nothing to do with increased lethality. It was because the ex-President felt a pissy need to show the DoD who was boss.

I love how so many people assume that the military is going to pay for treatments, the truth is, they weren’t and they aren’t going to. There were a few lucky people who managed to weasel their way into getting it. The only thing covered is medication, that’s all.
It does bother me when they put it all in your face, but at the same time there’s all this hate. Perfectly functional people still serving, some having had to live two completely separate lives, hiding from the world, just so they’d fit in.
On that note, I DO know plenty of trans folk who are NOT stable enough to join, but then again, I know plenty of non-transgender people who are unstable too.
Other countries have no problems with transgenders serving, why is the US always so behind? Likely due to people in power who refuse to change.
